AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES AT ONE ELM PLAZA IN
JEFFERSON CITY, MISSOURI.
WHEREAS, by an easement dated March 30, 1979, and recorded in
Book 257, Page 57, of the Records of Cole County, Missouri, a sewer
easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of sewer in, under
and through the lots, tracts or parcels of land described in
Section 1;
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
A strip of land ten (10) feet of even width across part of
Outlot Nos. 74 and 75, Township 44 North, Range 11 West, in
the City of Jefferson, County of Cole, Missouri; the
centerline of said ten ( 10) foot strip being more particularly
described as follows:
From the Southeast corner of said Outlot No. 75; thence
N54°02105" W along the Southerly Line of said Outlot No. 75,
1657. 82 feet to the POINT OF BEGINNING for this centerline
description; thence leaving the Southerly Line of said Outlot
No. 75 on a bearing of N35 057155"E, 368.39 feet; thence
N08 033146" W, 188.33 feet; thence N09 009132" W, 400.00 feet;
thence N26 011115" E, 100.00 feet; thence N09 045114" E, 337.17
feet; thence N530151521' W, 90.41 feet; thence N1101111511 E,
213.49 feet; thence N35 046108" W, 31 .21 feet to the POINT OF
TERMINATION of this centerline description.
EXCEPTING, a strip of land ten (10) feet of even width across
part of Outlot No. 74, Township 44 North, Range 11 West, in
the City of Jefferson, County of Cole, Missouri; the
centerline of said ten ( 10) foot strip being more particularly
described as follows:
From the aforementioned POINT OF TERMINATION; thence
S35 046108" E, 31.21 feet; thence S11°11 ' 15" W, 213.49 feet;
thence S53 015152" E, 77.59 feet to the POINT OF BEGINNING of
this exception; thence continuing S53 015152" E, 12.82 feet;
thence S0904511811 W, 32.22 feet to the POINT OF TERMINATION
of this exception.
EXCEPT, a strip of land ten (10) feet of even width across
part of Outlot No. 75, Township 44 North, Range 11 West, in
the City of Jefferson, County of Cole, Missouri; the
centerline of said ten (10) foot strip being more particularly
described as follows:
From the Southeast corner of said Outlot No. 75; thence
N54 002105" W along the Southerly Line of said Outlot No. 75,
1657.82 feet to the POINT OF BEGINNING for this centerline
description; thence leaving the Southerly line of said Outlot
No. 75 on a bearing of N35 057155" E, 188.40 feet to the POINT
OF TERMINATION of this centerline description.
EXCEPT, a strip of land ten (10) feet of even width across
part of Outlot No. 75, Township 44 North, Range 11 West, in
the City of Jefferson, County of Cole, Missouri; the
centerline of said ten ( 10) foot strip being more particularly
described as follows:
From the Southeast corner of said Outlot No. 75; thence
N54 002105" W along the Southerly Line of said Outlot No. 75,
1657.82 feet; thence leaving the Southerly Line of said Outlot
No. 75 on a bearing of N35 057155" E, 368.39 feet; thence
N08 033146" W, 188.33 feet; thence N09 009132" W, 93.24 feet to
the POINT OF BEGINNING for this centerline description; thence
continuing N09 009132" W, 32.48 feet to the POINT OF
TERMINATION of this centerline description.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon whatever
interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to
execute any necessary legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect
from and after the date of its passage and approval.
