AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROHIBITING RIOTS WITHIN THE CITY, PRESCRIBING THE POWERS OF THE MAYOR AT THE TIME OF ANY RIOT, UNLAWFUL ASSEMBLY OR ANY THREATENED PUBLIC DISTURBANCE OR COMMOTION, PROVIDING FOR THE ISSUANCE OF PROCLAMATIONS BY THE MAYOR AND DECLARING VIOLATIONS THEREOF TO BE MISDEMEANORS, PROVIDING PENALTIES FOR VIOLATIONS, AND REPEALING SECTION 1185 OF THE REVISED ORDINANCES OF THE CITY OF JEFFERSON, MISSOURI, 1956 RELATING TO RIOTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Riots prohibited. Any two or more persons who shall in this city assemble together, or being assembled shall act separately or in concert, with intent to do or commit any unlawful act with force or violence against any property of the city or the person or property of another, or against the peace, or to the terror of others, or who shall make any movement, preparation or demonstration to that end, either separately or in concert, and every person present at such meeting or assembly, with intent by: his or her presence or otherwise to aid, abet, assist, encourage or countenance the commition or perpetration of such unlawful act, or any such movement, preparation or demonstration is declared to be engaged in. a riot, and shall be deemed guilty of a misdemeanor. Section 2. Riots, powers of the mayor. In case of any Am riot, unlawful assembly, or threatened public commotion, the mayor shall have the right and power to direct the action of all police and law enforcing agencies of the city and to call to his aid all citizens in suppressing same, and in case of urgent necessity, to employ special police. The mayor shall have power to make arrests, or have arrests made, in cases where he shall have good reason to believe )that-any riot, unlawful assembly or public disturbance or commotion has been or is about to be committed and to summons citizens to his aid in making such arrests. He shall also have power in such cases to issue procla- mations in the interest of the public peace and safety: a) Ordering the closing of all establishments in the city licensed for thesale of alcoholic beverages or non-intoxicating beer either by the drink or in the original package during the period of time specified in the proclamation, b) Prohibiting the sale, rental or distribution of any ;ammunition, firearms or weapons of any kind by any establishment in the city engaged in the sale, rental or display, thereof for the period of time specified in the proclamation. c) Imposing a curfew on all persons in the city during such hours and for such period of time specified in the proclamation. -L- (d) Suspending all permits previously issued by the Chief Wof Police for any march, parade or procession on any public street, roadway, highway or sidewalk in the city. (e) Prohibiting the assembly of three or more persons any- where in the city for any purpose described in Section 1 of this ordinance. (f) Prohibiting the sale of gasoline except for direct delivery into the gasoline tank of motor vehicles. Any person called to the aid of the Mayor in the suppression of any riot, unlawful assembly or threatened public commotion or disturbance who shall refuse to aid and assist the Mayor in suppressing such unlawful or threatened activity shall be deemed guilty of a misdemeanor. Any person violating the provisions of any proclamation issued by the Mayor under the provisions of this section shall be eemed guilty of a misdemeanor. Section 3. Penalty. Any person convicted of a misdemeanor under the provisions of this ordinance shall be punished by a fine of not more than One Hundred ($100.00) Dollars, or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment. Section 4. Repeal Clause. Section 1185 of the Revised Ordinances of the City of Jefferson, Missouri, relating to riots is, and the same is hereby, repealed. Section 5. Effective Date.
