BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City of Jefferson, Missouri hereby adopts the Parking and Traffic Code of the City of Jefferson, Missouri for the purpose of regulating the parking and operation of motor vehicles in the city. ARTICLE XIII ® PENALTIES ■ 13.010 Penalty. ' f ffs ARTICLE I GENERAL PROVISIONS Section 1.010 Title 1.020 Definition. Section 1.010. Title. Section 1.010 through Section 13.010 shall be known ess the Parking and Traffic Code of the City of Jefferson, Missouri. Section 1.020. Definitions. The following words and phrases in the Parking and Traffic Code have the following meanings: (1) Abandoned Motor Vehicle, any motor vehicle left unattended at the same place on any roadway in the city for a period of time in excess of 72 consecutive hours. (2) Alley or alleyway, any street with a roadway of less than twenty feet in width. (3) Authorized emergency vehicle, a vehicle publicly owned and operated as an ambulance, or a vehicle publicly owned and operated by the state high- way patrol, police or fire department, sheriff or constable or deputy sheriff, traffic officer or any privately owned vehicle operated as an ambulance when responding to emergency calls. (4) Business District, the territory. contiguous to and including a highway when within any 600 feet along the highway there are buildings in use for business or industrial purposes, including but not.l.imited to hotels, banks, office buildings, railroad stations, stores and public buildings, which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the roadway. (5) Commercial vehicle, every vehicle designed, maintained, or used primarily for the transportation of property, which bears the name of the owner or business prominently and permanently displayed on the side thereof. (6) Controlled access highway_, every..highway, street or roadway, in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same except at such points only and in such manner as may be determined by the public authority having juris- diction over the highway, street or roadway. (7) Cross walk, (a) That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable roadway; (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. r t (8) Delivery Truck, a vehicle primarly used to pick up or deliver goods, wares or merchandise, which bears the name of the owner or business prominently and permanently displayed on the side thereof. (9) Disabled Motor Vehicle, any motor vehicle in a non operative con- dition left unattended at the same place on any roadway in this city for a period of time in excess of 48 consecutive hours. (10) Driver, every person who drives or is in actual physical control of a vehicle. (11) Highway, the entire width be the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. (12) Intersection, (a) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approxi- mately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict; (b) Where a highway includes two roadways thirty feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways thirty feet or more apart, then every crossing of two roadways of such highways shall be regarded as a separate intersection. (13) Laned roadway, a roadway which is divided into two or more clearly marked lanes for vehicular traffic. (14) Motor vehicle, any self-propelled vehicle not operated exclusivelAh upon tracks, except farm tractors. (15) Motorcycle, every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor. (16) Official time standard, whenever certain hours are named herein they shall mean standard time or daylight-saving time as may be in current use in the city. (17) Official traffic control devices, all signs, signals, markings and devices not inconsistent with this ordinance placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic. (18) Owner, the person or persons in whose name the title of a vehicle is registered with the registration agency of the State in which the title to the vehicle is registered. -2- f (19) Park or parking, the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in the loading or unloading passengers. (20) Parking meter, any mechanical.device, placed or erected for the regulation of parking, that indicates the legal parking time permitted and when operated shows the balance of legal parking time remaining, and at the expiration of the authorized legal parking time indicates that the parking of a vehicle is unlawful. (21) Parking meter spaces, any space within a parking meter zone, adjacent to a parking meter, and duly designated for the parking of a vehicle within a specified area by lines painted or otherwise durably marked on the surface of the roadway adjacent to a parking meter. (22) Parking meter .zone, any roadway, or portion thereof, next to which parking meters have been installed adjacent thereto and are subject to oper- ation. (23) Pedestrian, any person afoot. (24) Person, every natural person, firm., copartnership, association or corporation. (25). Police officer, every officer of,the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of- traffic regulations. (26) Private road or driveway, every way or place in private ownership and used for vehicular travel by the owner and those having express or im- plied permission from the owner, but not by other persons . (27) Railroad, a carrier of persons or property upon cars, other than streetcars, operated upon stationary rails. (28) Railroad train, a steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars. (29) Right of way, the right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other. (30) Roadway, that portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to all such road- ways collectively. (31) Service truck, a vehicle primarily used to carry tools or equipment to service or repair personal property. -3- (32) Sidewalk, that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use of pedestrians. (33) Stand or standing, the halting of an occupied vehicle for the purpose of and while actually engaged in receiving or discharging passengers. (34) Stop, when required, complete cessation from movement. (35) Stop or stopping, when prohibited, any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid confl with other traffic, or in compliance with the directions of a police office or traffic control signs or signal. (36) Street or highway, the entire width between the lines of every way publicly maintained when any part thereof is open to the uses of the public for purposes of vehicular travel. "State Highway", a highway maintained by the state of Missouri as a part of the state highway system. (37) Traffic, pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either singly or together while using any highway for purposes of travel. (38) Traffic control signal, any device, whether manually, electrically or mechanically operated by which traffic is alternately directed .to stop and to proceed. (39) Traffic division, the traffic division of the police department of the city, or in the event a traffic division is not established, then said term whenever used herein shall be deemed to refer to the police department of the city. Ah (40) Vehicle, every device in, upon or by which, any person or property is or may be transported or drawn upon a highway, excepting devices moved by human power or used exclusively upon stationary rails or tracks. -4- �r ARTICLE II PARKING AND TRAFFIC COMMISSION Section 2.010 Parking and Traffic Commission 2.020 Membership of Commission 2.030 Appointment of Members 2.040 Term of Members Ab, 2.050 Meetings of the Commission 2.060 Rules of the Commission .2.070 Jurisdiction of the Commission 2.080 Powers of the Commission 2.090 Duties of the Commission 2.100 Reports and Recommendations 2.110 Action by the City Council Section 2.010. Parking and Traffic Commission. There is hereby created a Parking and Traffic Commission. Section 2.020. Membership of Commission. The Parking and Traffic Commission shall consist of the following seven members: (a) A member of the City Council. (b) The,Director of Public Works, or his delegate. (c) The City Street Commissioner. (d) The Chief of Police, or his delegate. (e) Three resident freeholders of the city. Section 2.030. Appointment of Members. The Mayor, with the approval and consent of a majority of the elected members of the City Council, shall appoint the member of the city council and the three citizen members to serve on the.Com- mission. The Mayor shall designate the Chairman and Vice-Chairman of the Commission from its three citizen members. Section 2.040. Term of Members. Each citizen member shall be appointed for and serve a period of three years except that of the three citizen members first appointed hereunder, one shall be appointed. for a term of one year, one shall be appointed for a term of two years and one shall be .appointed for a term of three years respectively. Any vacancy in the Parking and Traffic Commission shall be filled by appointment and approval in like manner for the unexpired portion of the term. All members shall continue to serve until their successors shall have been appointed and qualified. Section 2.050. Meetings of the Commission. The Parking and Traffic Com- mission shall hold a regular business meeting at least once each month at such time and place as shall be established by the Rule of the Commission. The Com- mission may hold additional business meetings from time to time as it feels necessary. -5- General public hearings shall be held at least twice annually for the pur- pose of hearing all suggestions, complaints and comments from citizens and officials on matters relating to traffic and parking. A majority of the Commission's members shall constitute a quorum for the transaction of its business. Section 2.060. Rules of the Commission. The Commission may establish such rules and procedures as it believes is 'reasonably necessary for expeditious transaction of its business and affairs. Section 2.070. Jurisdiction of the Commission. The Commission shall have jurisdiction over all matters concerning the planning, coordination, supervision, control and regulation of all parking and traffic activities of motor vehicles within this city. All petitions and requests, from whatever source, concerning parking and traffic activities of motor vehicles shall be referred to the Com- mission for its study and consideration. The Commission shall act upon each petition or request within forty-five days upon receipt of same; provided that if additional time is necessary to study and consider the.matter, the Commission shall be given an additional forty-five days upon written request to the City Council. Section 2.080. Powers of the Commission. The powers of the Commission shall generally include, but not be limited to, the following: (A) To consider and recommend the establishment and regulation of speed zones, one way streets, loading zones, reserved or restricted parking zones, limited period parking zones, non parking zones, taxicab stands, delivery and service vehicles, truck and bus routes, school zones, school cross- walks, pedestrian crosswalks, parking meter zones whether AMIL on street or off street, and stop signs, whether electrical or non electrical. (B) To consider and recommend the location, type, timing and specifications of all traffic control devices, including but not limited to electrical signals, signs, markers, pavement and curb painting and parking meters. (C) To consider and recommend the establishment of any motor. vehicle traffic or parking regulation which, in the opinion of the Commission, promotes traffic safety and/or decreases traffic congestion within the city. (D) To call upon and receive the cooperation and assistance of all departments, officers and. employees of the city. (E) To provide for the attendance of one of. its members at Traffic and Parking forums, seminars or institutes where special instruction courses in the field of traffic and Parking may be offered. (F) To recommend the employment of a qualified consultant either -6- on a per diem basis or a regular retainer when the need for trained technical assistance on parking and traffic matters arises. Section 2.090. Duties of the Commission. The duties of the Parking and Traffic Commission shall generally include, but not be limited to, the following: (A) To promote the cooperation and coordination of all govern- mental agencies in the planning and control of traffic and parking matters. (B) To develop and keep current a master plan for traffic control and parking. (C) To prepare engineering surveys showing present traffic and parking conditions within the city and future needs in these fields. (D) To review all present city ordinances relating to traffic control and parking of motor vehicles. (E) To consider all requests, petitions or suggestions concern- ing the regulation of traffic and parking, and upon study and consideration of same to make a report to the City Council of go its action thereon. (F) To recommend desirable regulations concerning the activities of motor vehicles as mentioned in Section 2.080 (A) above. (G) -To take all necessary and reasonable action to promote traffic safety and to eradicate traffic congestion. (H) To submit an annual report to the City Council showing the progress in traffic control and parking improvements and stating matters of importance to traffic and parking which should be considered and accomplished in the coming year. Section 2.100. Reports and Recommendations. Each month the Parking and Traffic Commission shall make a report to the City Council. This report shall contain the recommendations of the Commission for the establishment of traffic or parking regulations which, in the opinion of the Commission, will best promote traffic and/or parking safety, or lessen traffic congestion within the city. Section 2.110. Action by the City Council. The City Council, at the first meeting following receipt of the report and recommendations of the Commission, shall review and consider same. If the. Council finds that all or any part of the recommendations of the Commission .should be approved, it shall. instruct I' the City Attorney to prepare the necessary ordinances to make the recommenda- tions effective. All ordinances passed to implement the recommendations of the Parking and Traffic Commission shall remain in force and effect for a minimum period of ninety days; provided that the City Council may amend or repeal said ordinances ®prior to that time if so requested by the Parking and Traffic Commission. -7- ARTICLE III TRAFFIC ADMINISTRATION Section 3.010 Traffic division established. 3.020 Traffic division, duties. 3.030 Records of traffic violations. 3.040 Investigation of traffic accidents. 3.050 Traffic accident studies. 3.060 Traffic accident reports. 3.070 Driver's files to be maintained. 3.080 Traffic safety report. 3.090 . Identification for funeral processions. 3.100 City Traffic Engineer. 3.110 Emergency and experimental regulations. Section 3.010. Traffic division .established. There is hereby established in the police department a traffic division to be under the control of a police officer appointed by and directly responsible to the chief of police. Section 3.020. Traffic division, duties. The traffic division with such aid as may be rendered by other members of the. police department shall enforce the street traffic regulations of the city and all of the state vehicle laws applicable to street traffic in the city, make arrests for traffic violations, investigate accidents, cooperate with other officers of the city in the adminis- tration of traffic laws and in developing ways and means to improve traffic conditions, and carry out those duties specially imposed upon the division in the ordinances of the city. Section 3.030. Records of traffic violations. 1. The police department, or the traffic division thereof, shall keep a record of all violations of traffic ordinances of the city or of state vehicle laws of which any person has been charged, together with a record of the final disposition of all such alleged offenses. Such record shall be so maintained as to show all types of violations and the total of each. Said record shall accumulate during at least a five-year period and from that time on the record shall be maintained complete for at least the most recent five-year period. 2. All forms .for .records of violations and. notices of .violations shall be serially numbered. For each month and year a written record shall be kept available to the public showing the disposal of all such forms. All such records and reports shall be public records. , 3. p p Section 3.040. Investigation of -Traffic Accidents. It shall be the duty of the traffic division, assisted by other police officers of the department, to investigate traffic accidents and to arrest and assist in the prosecution of those persons charged with violations of law causing or contributing to such accidents. -8- Section 3.050. Traffic accident studies. Whenever the accidents at any particular location become numerous, the traffic division .shall cooperate with the Parking and Traffic Commission and Director of Public Works in conducting studies of such accidents and determining remedial measures. ,v Section 3.060. Traffic accidents reports. The traffic division shall maintain a suitable system of filing traffic accident .reports. Accident reports or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the use and information of the city Parking and Traffic Commission. Section 3.070. Drivers files to be maintained. The police department, or the traffic division thereof, shall maintain a suitable record of all traffic accidents, warnings, arrests, convictions, and complaints reported for each driver, which shall be filed alphabetically under the name of the driver con- cerned. Section 3.080. Traffic safety report. The traffic division shall annually prepare a traffic report which shall be filed with the mayor. Such report shall contain information on traffic matters in the city as follows: (1) The number of traffic accidents, the number of persons killed, the number of persons injured, and other pertinent traffic accident data; (2) The number of traffic accidents investigated and other pertinent data on the safety activities of the police; (3) The plans and recommendations of the division for future traffic safety activities. Section 3.090. Identification for funeral processions . The traffic division shall designate a type of pennant or other identifying insignia to be displayed upon, or other method to be employed to identify, the vehicles in funeral pro • cessions. Section 3.100. City Traffic .Engineer. The office of City Traffic Engineer is established. The Director of Public Works shall serve as City Traffic Engineer in addition to his other functions and exercise the powers and duties with respect to traffic as provided in Sections 1.010 through 13.010. The City Traffic Engineer shall determine the installation and proper timing and maintenance of traffic control devices, conduct engineering analyses of traffic accidents and devise remedial measures, conduct engineering investi- gations of traffic conditions, plan the operation of traffic on the streets and highways of the city, and cooperate with other city officials in the development of ways and means to improve traffic conditions, and carry out the additional powers and duties imposed by.ordinances of the city. Section 3.110. Emergency and .experimental .regulations. The Chief of Police by and with the approval of the City Traffic Engineer is hereby empowered to make regulations necessary to make effective the provisions of the traffic ordinances -9- ,t o£ the city and to make and .enforce temporary and•exrarimental regulations to r cover emergencies or special conditions. No such temporary .or experimental regulations shall remain in effect for more. than .ninety (90) days. The City Traffic Engineer may test traffic control devices under actual conditions of traffic. AWL -10- ARTICLE IV ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS Section 4.010 Authority of police and fire department officials. 4.020 Obedience to police -and fire department: officials. 4.030 Push carts and riding .animals to obey regulations. 4.040 Use of skates, coasters and wagons restricted, 4.050 Public employees to obey regulations. 4.060 Authorized emergency vehicles, exemptions from regulations. 4.070 Authorized emergency vehicles, duties of other drivers. 4.080 Immediate notice of accident. 4.090 Passenger to report accident. Section 4.010. Authority of police and fire department officials. 1. It shall be the duty of the officers of the police department, or such officers as are assigned by the chief of police, to enforce all street traffic laws of the city and all of the state vehicle laws applicable to street traffic in the city. 2. Officers of the police department or such officers as are assigned by the chief of police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws; provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws. 3. Officers of the fire department, when at the scene of a tire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. Section 4.020. Obedience to police and fire department officials. Police officers are authorized to direct traffic by voice, hand or signal as conditions may require in times of .emergency or in the event of a fire, or when necessary to expedite traffic or safeguard pedestrians. No person shall willfully fail or refuse to comply with any lawful order or direction of a police officer or fire department official concerning vehicular or pedestrian. traffic. Section 4.030. Push carts and ridgy animals subject to regulations. Every person propelling any push cart or riding an animal upon a roadway and every person driving an animal-drawn vehicle shall be subject to the provisions of Section 1.010 through Section 1.3.010, except those provisions which by their very nature can have no application. Section 4.040. Use of skates, coasters and wagons restricted.. No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a cross walk and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. Section 4.050. Public employees to obey traffic regulations. The pro- visions of Section 1.010 through Section 13.010 shall apply to the driver of any vehicle owned by or used in the service of. the United States government, any state government, and any county .or city government, and it shall be unlawful for the driver to violate any of these provisions, except as otherwise permitted therein. Section 4.060. Authorized emergency vehicles, exemption from regulations. 1. The driver of an authorized emergency vehicle, when responding to an emer- gency call or when in pursuit of an actual or suspected .violator of the law or when responding to but .not upon returning from .a fire alarm, may exercise the privileges set forth in this section subject to the conditions herein stated. 2. The driver of an authorized emergency vehicle may: (1) Park or stand, irrespective of the provisions of Article X of this chapter. (2) Proceed past a red .or stop signal or stop sign, but only after slowing down as may be necessary for safe operation. (3) Exceed the maximum speed limits so long as he does not endanger life or property. (4) Disregard regulations governing direction of movement or turning in specified directions. 3. The exemptions herein .granted to an authorized -emergency vehicle shall apply only when the diiver of any said vehicle while in motion sounds audible signal by bell, siren, or exhaust whistle as may be reasonably necessary, and when the vehicle is equipped with at least one lighted lamp displaying a red light visible under normal atmospheric conditions from a distance of five hundr feet to the front of such vehicle. 4. The .foregoing provisions .shall .not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions -protect the driver from the consequences of his reckless disregard for the-safety of others. Section 4.070. Authorized.emexgenc vehicles; duties of .other drivers. 1. Upon the immediate .approach of an authorized emergency vehicle making use of audible and .visual signals meeting .the requirements of the laws of this state, or of a police vehicle properly and lawfully making use of an audible signal only, the driver of every other vehicle shall yield the right of way and shall immediately drive to a position parallel to, and as close as possible to, the right-hand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the authorized emergency vehicles have passed, except when otherwise directed by a police officer. 2. This section .shall not .operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway. -12- Section 4.080. . Immediate notice .of.accident. The driver of a vehicle involved in an accident resulting in •injury to .or •death of any person or total damage to all property to an .apparent extent. of one hundred .dollars or more shall immediately by the quickest means of communication give notice of such accident to the police department if such .accident occurs within the city. Section 4,090. Passenger .to report accident. Whenever the driver of a vehicle is physically incapable of.giving immediate notice of an accident as required in section 4.080 and. there was another occupant in the vehicle at the time of the accident capable of doing so, such occupant shall give, or cause to be given, the notice not given by the driver. jr 't z -13- is ARTICLE V TRAFFIC CONTROL DEVICES Section 5.010 Authority to install traffic control devices. 5.020 Traffic control devices, type used. 5.-030 Obedience to traffic control device. 5.040 Traffic control device required for enforcement purposes. 5.050 Traffic control device; presumption of legality. 5.060 Display of unauthorized signs, signals or markings. 5.070 Traffic control devices; destruction or removal. 5.080 Traffic lanes. 5.090 Stop and yield signs. Section 5.010. Authority to install traffic control devices. The City Traffic Engineer and/or Missouri State Highway Department shall place and maintain traffic control signs, signals and devices required to implement all parking and traffic regulations of the city. The City Traffic Engineer is authorized to place markers, buttons, or signs within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and such course to be traveled as so indicated may conform to or be other than as prescribed by law or ordinance. When authorized markers, buttons or other indications are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indications. Section 5.020. Traffic control devices; types used. All traffic control signs, signals and devices shall conform to the manual and specifications approve by the state highway commission or resolution adopted, by the legislative body of the city. All signs or signals required hereunder for a particular purpose shall so far as practicable be uniform as to type and location throughout the city. All traffic control devices erected as required by Section 5.010 shall be official traffic control devices. Section 5.030. Obedience to traffic control device. The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto placed and maintained in accordance with the provisions of this article, unless otherwise directed by a -traffic or police officer, subject to the exceptions for the driver of an authorized emergency vehicle stated in Section 4.060. Section 5.040. Traffic control devices required for enforcement purposes. No provision of Sections 1.010 through 13.010, except the speed limits defined in sub- section 2 of Section 6.010 hereof, for which official traffic control devices are required shall be enforced against an alleged violator if at the time or place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Before any person shall be convicted of any provision of subsection 2 of Sec- tion 6.010 requiring the operator of a motor vehicle to drive the same at a speed less than 30 miles per hour, notice of such lesser speed limit shall be posted at � such reasonable places adjacent to the roadway as is determined by the City Traff Engineer. -14- Section 5.050. Traffic control devices; presumption of legality. 1. When- ever official traffic control .devices are placed in position approximately con- forming to the requirements of this article, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence. 2. Any official traffic control device placed pursuant to the provisions of this article and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this article unless the contrary shall be shown by competent evidence. Section 5.060. Display .of unauthorized signs, signals or markings. No person shall place, maintain or display upon or in view of any highway an un- authorized sign, signal, marking or device which purports to be or is an imitation of -or resembles an official traffic_ control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic control device or any railroad sign or.signal. Section 5.070. Traffic control device;destruction or removal. No person shall, without lawful authority, attempt to or in fact .alter, deface, injure, knock down or remove any official traffic control device or any railroad sign or signal or any inscription, shield or insignia thereon, or any other part thereof. Section 5.080. Traffic lanes. The city Traffic Engineer is authorized to mark traffic lanes upon the roadway of any street or highway where a regular alignment of traffic is necessary or desirable. Where such traffic lanes have been marked, the driver of a vehicle shall drive same within the boundaries of a marked lane except when .lawfully passing another vehicle or preparatory to making a lawful. turning movement. Section 5.090. Stop and yield signs. The driver of a vehicle approaching a yield sign if 'required for safety to stop shall stop before entering the cross walk on the -near side of the -intersection, or in the event there is no cross walk,.sha11 stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approach- ing traffic on the intersecting roadway. Section 6.010. Speed limit: careless and imprudent drivin&. 1. Every driver of a motor vehicle shall drive in a carefiil and prudent manner on the road- ways of this city and at a rate of speed so as not to endanger the property of another or the life or limb of any person and shall exercise the highest degree of care. 2. No vehicle shall be driven at a speed in excess of: A. 70 miles per hour: (a) On Highway 50-63 between Vetter's Lane underpass and the ekst city limit's line. (b) On Highway 50 between Dix Road overpass and the west city limits line. B. 55 miles- per-hour: (a) On Highway 50-63 between Vetter's Lane underpass and Dix Road overpass. (b) On Highway 54 between the Missouri River Bridge and 1 -16- r �f the south city limits line. (c) On Highway 63 between Vetter's Lane underpass and the Missouri River Bridge. (d) Highway 179 between Industrial Drive and north city limits line. C. 50 miles per hour: (a) On Country Club Drive between Highway 50 and the west city limits line. D.. 40 miles per hour: (a) On Industrial Drive between McCarty Street and North Ten Mile Drive. (b) On Ellis Boulevard between Highway 54 and Rosewood Drive. (c) On Dunklin Boulevard between a point located 500 feet west of Heisinger Road and South Ten Mile Drive. (d) On Business Highway 50 and 63 between Grant Street and the east city limits line. (e) On North Ten Mile Drive between Industrial Drive and the west city limits line. E. 30 miles per hour: On all streets or highways except where and when a different speed limit has been authorized or fixed in this subsection. F. 20 miles per hour: (a) On all roadways in any school zone between the hours of 7:00 A.M. and 5:00 P.M. on any day that a school, in or adjacent to the zone, is attended by children. ;'> .. (b) On Chestnut Street between Dunklin Street and Elm Street. ;;.:. (c) . On Elm Street between Cherry Street and Locust Street. (d) On Lafayette Street between Dunklin Street and Miller Street. (e) On Miller Street between Chestnut Street and Locust Street. -17- i (f) On Vetter's Lane between High Street and Elm Street. G. 15 miles per hour: Within any public park in the city. 3. The speed limits set by this section shall not apply to an authorized emergency vehicle as defined in Section 1.020 tinder the conditions mentioned in Section 4.060, and nothing in subsection 2 hereof shall make the speeds fixed therein lawful in a situation requiring a lower speed for compliance with the basic rule declared in subsection 1 of this section. Section 6.020. Careless and reckless driving. A vehicle shall not be operated in a careless and reckless manner. Careless and reckless manner is de- fined as such a manner to indicate a disregard for the safety of persons or property. Section 6.030. Intoxicated driving. A vehicle shall not be operated when the ability of the operator to drive the vehicle is impaired by the use of intoxicating beverages. Section 6.040. Driving while drugged or medicated. A vehicle shall not be operated when the ability of the operator to drive the vehicle is impaired by the use of drugs or medicines. Section 6.050. Leaving scene of accident. No person operating a vehicle on a roadway knowing that an injury has been caused to a person or damage has been caused to property, due to the culpability of the operator, or to accident, shall leave the place of said injury, damage or accident without stopping and giving his name, residence address, motor vehicle number and chauffeur's or registered operator's number, if any, to the injured party, ,or to any person exercising control over the damaged property. Section 6.060. Vehicles to be kept to right. 1. Upon all roadways of sufficient width a vehicle shall be driven upon the right half of the roadway, except as follows: (A) When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement; (B) When placing a vehicle in position for and when such vehicle is lawfully making a left turn. (C) When an obstruction exists making it necessary to drive to the left of the center of the highway; provided, any person so doing shall yield the right of way to all vehicles traveling in the proper direction upon the unobstructed portion of the highway within such distance as to constitute an immediate hazard; (D) Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon; or -18- l I (E) Upon a roadway designated and s•ignposted for one-way traffic. I 2. Upon any roadway having four or more lanes for moving traffic and providing for two-way movement of traffic, no vehicle shall be driven to the left of the center line of the roadway, except when authorized by official traffic- control devices designating certain lanes to the left side of the center of the roadway for use by traffic not otherwise permitted to use such lanes, or except as permitted under subsection 1. (3) hereof. Section 6.070. Improper lane use. 1. Whenever any roadway has been divided into two or more clearly marked lanes for traffic, the following rules in addition to all others consistent herewith shall apply: (A) A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety. (B) -- Upon a roadway which is divided into three lanes and provides for two-way movement of traffic, a vehicle shall not be driven in the center lane, except when overtaking and passing another vehicle traveling in the same direction when such center lane is clear of. traff is within a safe distance, or in preparation for making a left turn or where such center lane is at the time allocated exclusively to traffic moving in the same direction that the vehicle is proceeding and such allocation is designated by official traffic-control devices. (C) Official traffic-control devices may be erected directing speci- fied traffic to use a designated lane or designating those lanes to be used by traffic moving in a particular direction regardless of the center of the roadway and drivers of vehicles shall obey the directions of every such device. (D) Official traffic-control devices may be erected by the City Traffic Engineer prohibiting the changing of lanes on sections of roadway and drivers of vehicles shall obey the directions of every such device. 2. Whenever any highway has been divided into two or more roadways by leaving an intervening space or by a physical barrier or clearly indicated dividing section so constructed as to impede vehicular traffic, every vehicle shall be driven only upon the right-hand roadway unless directed or permitted to use another roadway by official traffic-control devices or police officers. No vehicle shall be driven over, across or within any such dividing space, barrier or section, except through an opening in such physical barrier or dividing section or space or at a cross- over or intersection as established, unless specifically prohibited by public authority. Section 6.080. Turning regulations. 1. The driver of a vehicle intending to turn at an intersection shall do so as follows: r A `3 ' -19- (A) Both the approach for a right turn and a right turn shall be made as close as practicable to the right hand curb or edge of the roadway. (B) The execution of a left turn •shall -be made from the marked left turn lane on the roadway or if there is no marked left turn lane on the roadway, then at any intersection where traffic is: (a) permitted to move in both directions on each roadway entering the intersection, an approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. Whenever practicable the left turn shall. be made in that portion of the intersection to the left of the center of the intersection. (b) restricted to one direction on one or more of the road- ways, the driver of a vehicle intending to turn left at any such intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of travel of such vehicle and after entering the intersection the left turn shall be made so as to leave the intersection, as nearly as prac- ticable, in the left-hand lane lawfully available to traffic moving in such direction upon the roadway being entered. (C) When signs or markings, in or adjacent to intersections, direct that Location of a vehicle for the approach and execution of a left turn or right t or the course of travel of a vehicle in, during and after the execution of a le or right turn, is different from that prescribed in the preceding paragraphs of this subsection, the driver of the vehicle shall execute the turn from the position on the roadway and in the manner directed and required by such signs or markings. 2. The driver of a vehicle shall not turn the same in a manner to proceed in the opposite direction, commonly termed a "U" turn, at any intersection where traffic lights are in operation, or in a business district, or at an intersection where a police officer is directing traffic, or at any other place unless the movement can be made safely without creating a hazard of collision with any other vehicle. Section 6.040. Following too closely. The driver of a vehicle shall not ' follow another vehicle more closely than is reasonably safe and prudent having due regard for the speed of the vehicle being followed, the traffic upon and condition of the roadway, and the amount of pedestrian traffic adjacent to the roadway. Section 6.100. Passing regulations. 1. Drivers of vehicles proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more than one line of traffic in each direction each driver shall -20- give to the other at least one-half of the main-traveled portion of the roadway as nearly as possible. 2. The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction: (A) An operator or driver overtaking and desiring to pass a vehicle shall sound horn before starting to pass. (B) Except when overtaking and passing on the right is permitted, the t driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle (C) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the over- taking vehicle on audible signal and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. (D) The driver of a vehicle shall not drive the same on the,left side of the roadway: (a) in overtaking and passing another vehicle proceeding in the same direction unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the safe operation of any vehicle an overtaken or any vehicle approaching from the opposite direction. (b) When approaching the crest of a grade or upon a curve in the street or highway where the driver's view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction. (c) When traversing any intersection or railroad grade crossing. (d) When the view is obstructed upon approaching within 100 feet of any bridge, viaduct or tunnel (e) The provisions of subparagraphs (b), (e) and (d) of this paragraph shall not apply on a one way roadway. 3. Vehicles may be overtaken and passed on their right side: (A) When making a left turn or displaying a signal showing the driver's intention to make a left turn and when there is sufficient unobstructed pavement ahead on the right to allow the overtaking vehicle to pass without leaving the roadway and without danger to any vehicle or pedestrian on the roadway. (B) Upon any laned roadway where there are two or more lanes for traffic moving in the same direction and when such overtaking and passing can be accomplished with safety to any vehicle on the roadway. -21- Section 6.110. Passing school bus prohibited. 1. The driver of a vehicle upon meeting or overtaking from either direction any school bus which has stopped on the roadway for the purpose of receiving or discharging any school children and whose driver has in the manner prescribed by law given the signal to stop, shall stop the vehicle before reaching the school bus and shall not proceed until such school bus resumes motion, or until signalled by its driver to proceed. 2. Every bus used to transport school children shall bear upon the front and rear thereof a plainly visible sign containing the words "school bus" in letters not less than eight inches in height. Each bus shall have lettered on the rear in plain and distinct type the following: "Stop while bus is loading and unloading." Each school bus shall be equipped with a mechanical and elec- trical signalling device which will display a signal plainly visible from the front and rear of the bus indicating intention to stop. 3. No driver of a school bus shall take on or discharge passengers while the vehicle is on the improved portion of any roadway unless the school bus is plainly visible for at least three hundred feet in each direction to drivers of other vehicles upon the roadway and then only for such time as is actually necessary to receive and discharge passengers. Section 6.120. Passing on Business Highway 50 Prohibited. A driver shall not overtake or pass another vehicle on the left at any point on Business Highway 50 between Elm Street and Delaware Street. Section 6.130. Hand and mechanical signals. No driver shall stop or de- crease the speed of or turn a vehicle from a straight ahead course or operate a vehicle to the right or left upon a roadway unless and until such movement can be made with reasonable safety and then only after giving an appropriate signal in the following manner. Amok (A) A driver, when stopping or checking the speed of his vehicle, if the movement or safety of other vehicles may reasonably be affected by such stopping or checking of speed, shall extend his arm at an angle below horizontal so that the same may be seen in the rear of his vehicle. (B) A driver intending to turn his vehicle to the right shall extend his arm at an angle above horizontal so that the same may be seen in front of and in the rear of his vehicle. (C) A driver intending to turn his vehicle to the left shall extend his arm in a horizontal position so that the same may be seen in front of and in the rear of his vehicle. 2. If a vehicle is equipped with a signal light or signal. device in good mechanical operating condition which displays a signal or light that is plainly visible to the front and rear of the vehicle so that the intention of the driver to stop, slow, turn to the right, or turn to the left is clearly indicated, the signals with the arm prescribed and required in this section need not be given. Section 6.140. Right of way general,y. 1. Subject to the provisions of Sections 6.150 and 6.160, the following regulations apply: -22- (A) The driver of a vehicle approaching an intersection shall yield the right of way to a vehicle which has entered the intersection from a different street. (B) When two vehicles are approaching an intersection in such a manner that they will enter the intersection from different streets at approximately the same time, the driver of the vehicle on the left shall yield the .right of way to the driver of the vehicle on the right. 2. Where there is no traffic control device present or in operation at an intersection regulating vehicles approaching each other from opposite directions on the same roadway, the driver of a vehicle intending to turn left into an inter- secting roadway shall yield the right of way to any vehicle approaching from the opposite direction that is entering or so close to the intersecting roadway as to constitute an immediate hazard. 3. The driver of a vehicle, intending to make a left turn into an alley, private road or driveway, shall yield the right of way to any vehicle approaching from the opposite direction which is so close to the alley, private road or drive- , way as to constitute an immediate hazard. 4. The driver of a vehicle standing, stopped or parked on a roadway shall keep the vehicle motionless and yield the right of way to any vehicle in motion on the roadway if failure to do so would constitute an immediate hazard. Section 6.150. Right of way; through roadways. 1. A.traffic control device is authorized and shall be installed at all roadways intersecting with "through roadways". The driver of the vehicle on the intersecting roadway shall yield the right of way to any vehicle on a "through roadway" that is either in the inter- section of said roadways or approaching so closely thereto as to constitute an immediate hazard. 2. The following roadways are declared to be "through roadways": 1. Boonville Road 8. High Street 15. McCarty Street 2. Broadway 9. Highway 50 and 63 16. Monroe Street 3. Capitol Avenue 10. Industrial Drive 17. Moreau Drive 4. Clark Avenue 11. Jefferson Street 18. Saint Mary's Boulevard 5. Dunklin Street 12. Lafayette Street 19. Southwest Boulevard 6. Dunklin Boulevard 13. Madison Street 20. Stadium Boulevard 7. Greenberry Road 14. Main Street 21. Tanner Bridge Road 3. At intersections of "through roadways," the right of way shall be con- trolled by stop signals or stop and yield signs pursuant to the provisions of Sections 6.160, 6.180 and 6.190 where applicable. Section 6.160. Right of way: specific intersections. 1. In construing the provisions of this subsection, only those provisions in Columns A, B and C identified by the same number at the left shall relate to each other.. The driver of a vehicle operated on the roadway named in Column A in any direction named in Column B shall yield the right of way to any vehicle operated -23- on the roadway named in Column C which is in the intersection of the roadways named in Columns A and C or approaching so closely thereto as to constitute an immediate hazard: Column A Column B Column C 1. The driver of a vehicle on either access road extending from Clark Avenue to Highway 50 and 63 shall yield the right of way to any vehicle on Highway 50 and 63 if a failure to do so would constitute an immediate hazard. 3. The driver of a vehicle on the access road extending from High Street north to Highway 54-63 shall yield the right of way to any vehicle on Highway 54-63 if a failure to do so would constitute an immediate hazard. -24- 4. The driver of a vehicle on the access road extending from Main Street north to Highway 54-63 shall yield the right of way to any vehicle on Highway 54-63 if a failure to do so would constitute an immediate hazard. 5. A person driving a vehicle in an easterly direction on Dunklin Boulevard, when executing a right turn into Dunklin Street, shall yield the right of way to any vehicle turning left from Harrison Street into Dunklin Street if a failure to do so would constitute an immediate hazard. 6. A person driving a vehicle in a westerly direction on Dunklin Street, when executing a right turn into Harrison Street, shall yield the right of way to any vehicle proceeding easterly on Dunklin Boulevard that continues north- easterly into Harrison Street if a failure to do so would constitute an immed- iate hazard. 7. A person driving a vehicle in a westerly direction on Highway 50 and 63, when turning right into Business Highway 50, shall yield the right of way to any vehicle on Business Highway 50 if the failure to do so would constitute an immediate hazard. 8; A person driving a vehicle in an easterly direction on Highway 50 and 63, when turning right into Business Highway 50, shall yield the right of way to any vehicle on Business Highway 50 if the failure to do so would constitute an immediate hazard. 4. A person driving a vehicle in a soiitherly direction on the ramp to the intermediate level traffic loop of the tri-level interchange of Highways 50, 54 and 63, before executing a right turn into the access ramp to Highway 50, shall yield the right of way to any vehicle on the traffic loop if failure to do so would constitute an immediate hazard. 10. A person driving a vehicle in a northerly direction on the ramp ex- tending north from Highway 54 to the intermediate level traffic loop of the tri-level interchange of Highways 50, 54 and 63, before executing; a right turn into the access vamp extending east to Highway 50 and 63, shall yield the right of way to any vehicle on the traffic loop if failure to do so would constitute an immediate hazard. 11. A person driving a vehicle in a westerly direction on the ramp ex- tending west from Highway 50 and 63 to the intermediate level traffic loop of the tri-level interchange of Highways 50, 54 and 63, before executing a right turn into the access ramp extending north into Highway 54 and 63, shall yield the right of way to any vehicle on the traffic loop if failure to do so would constitute an immediate hazard, } 12. A person driving a vehicle in an easterly direction on the access road extending east from the intermediate level traffic loop of the tri-level interchange of Highways 50, 54 and 63 to Highway 50 shall yield the right of way to any vehicle on Highway 50 if failure to do so would constitute an immed- iate hazard. 13. A person driving a vehicle in a westerly direction on the exit ramp from Highway 54 to Jefferson Street, before making a right turn to proceed north on Jefferson Street, shall yield the right of way to any vehicle on -25- :Q� Jefferson Street if failure to do so would constitute an immediate hazard. 14. A person driving a vehicle in an easterly direction on the exit ramp from Highway 54 to Christy Street, before making a right turn to proceed south on Christy Street, shall yield the right of way to any vehicle on Christy Street if failure to do so would constitute an immediate hazard. 15. The driver of a vehicle on the cross roadway separating the east and west lanes of Highway 50, at its intersection with roadways leading to and from Country Club Drive, Schellridge Road and South Ten Mile Drive, shall yield the right of way to a vehicle on Highway 50 if failure to do so would constitute an immediate hazard. Section 6.170. Right of way; crosswalks. Where there is no form of traffic control device present or in operation, the driver of a vehicle shall yield the right of way, by slowing or stopping if necessary, to (a) any pedestrian crossing the roadway at an intersection with any marked or unmarked crosswalk, or (b) any fla pedestrian crossing the roadway within a marked crosswalk. Section 6.180. Electrical traffic control signals. 1. Whenever traffic is controlled by electrical traffic control signals at intersections exhibiting different colored lights or colored lighted arrows successively or in combination, only the colors green, red and yellow shall be used, except for special pedes- trian signals carrying a word legend. Said lights and arrows shall indicate and apply to drivers as follows: (A) Subject to the provisions in paragraph (B) hereof, the driver of a vehicle: �. . Facing a circular green signal may proceed straight through, or turn right or left unless a sign at such place prohibits either such turn yielding the right of way to pedestrians lawfully within the intersection or i an adjacent cross walk at the time such signal is exhibited and yielding the right of way to any vehicle not required to stop which is either within the intersections or approaching so closely thereto as to constitute an immediate hazard. 2. Facing a green arrow signal shown alone or in combination with another indication may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as is permitted by other indication shown at the same time, yielding the right of way to pedestrians lawfully within an adjacent crosswalk and to any other vehicle lawfully using the intersection. 3. Facing a steady yellow signal is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter when vehicular traffic shall not enter the intersection, and said vehicle shall be stopped before entering the intersection. 4. Facing a steady red signal shall stop the vehicle before entering the cross-walk on or near the near side of the intersection, or, if none, then before entering the intersection and shall remain standing until a green indication is shown. -26- (B) Whenever a flashing red or yellow signal is used as a traffic con- trol signal at intersections, it shall require obedience by vehicular traffic as follows: 1. Flashing red (stop signal) -- - when a red tense is illuminated with intermittent flashes, the driver of a vehicle facing such signal shall stop the vehicle before entering the nearest cross-walk at an intersection, or at a limit line where marked, or if none, then before entering the intersection, and the right to proceed shall be subject to the provisions of Section 6.190 applying to vehicles after making a stop at a stop sign. 1. Flashing yellow (caution signal) - - when a yellow lense is illuminated with intermittent flashes, the driver of a vehicle facing such signal shall reduce the speed of the vehicle before entering the intersection and then proceed into and through the intersection with caution to any pedestrian or vehicle lawfully in the intersection and to any pedestrian lawfully within any crosswalk adjacent to the intersection. 2. Whenever traffic is controlled by electrical traffic control signals operating in or immediately adjacent to any marked school crosswalk in the city, the driver of a vehicle approaching a marked school crosswalk: (A) Facing a red light signal shall stop the vehicle with the front end of the vehicle at least three feet from the closest line of the crosswalk i and remained stopped until directed to proceed by a police officer or a different signal, yielding the right of way to any pedestrian lawfully within the cross- walk. i (B) Facing a yellow light signal shall reduce the speed of the vehicle and proceed cautiously toward and through the school crosswalk, yielding the right of way to any pedestrian.lawfully within the crosswalk. 3. In the event an electrical traffic control signal is in operation at a place other than an intersection or a marked school crosswalk, the provisions in paragraph (A) of subsection 1 of this section shall be applicable except as to those provisions which by their nature could have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking, the stop shall be made at the signal. Section 6.190. Stop signs;_ obedience to. The driver of a vehicle on any roadway first named in the following numbered paragraphs shall stop the vehicle + as prescribed in Section 5.090 on the roadway before entering the .intersection with the second roadway named in the same numbered paragraph and then proceed cautiously, yielding the right of way to any pedestrian within any crosswalk adjacent to the intersection and to any vehicle either in the intersection or approaching so closely thereto, when not required to stop, as to constitute an immediate hazard: r -27- i \ `1 A. The driver of a vehicle approaching a portable non electrical sign marked "STOP" in or adjacent to an intersection shall stop the vehicle before ' entering the nearest crosswalk and keep the vehicle motionless unless directed by a police officer to proceed or, if no officer is present, shall proceed cautiously yielding the right of way to any pedestrian in a crosswalk at the intersection. 3. The driver of a vehicle approaching a portable non electrical sign marked "STOP" in or adjacent to a marked crosswalk shall stop the vehicle with its front end at least three feet from the nearest line of the crosswalk and keep the vehicle motionless unless directed by a police officer to proceed, or -38- if an officer is not present, shall proceed cautiously yielding the right of way to any pedestrian in the crosswalk. Section 6.200. StOR on emerging from alleys,_ driveways or building. The driver of a vehicle emerging from an alley, driveway or building shall stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across any alleyway or driveway, and shall yield the right of way to any pedestrian as may be necessary to avoid collision, and upon entering the roadway shall yield the .right of way to all vehicles approaching on said roadway. Section 6.210. Stop when traffic obstructed. No driver shall enter an intersection or a marked cross walk unless there is sufficient space on the other side of the intersection or cross walk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic control signal indication to proceed. Section 6.220. Stop on approach of train. 1. Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this section, the driver of such vehicle shall stop within fifty feet but not less than fifteen feet from the nearest rail of such railroad, and shall irm not proceed until he can do so safely. The foregoing requirements shall apply when: (1) A clearly visible electric or mechanical signal device gives warning of the immediate approach of a railroad train; (2) A crossing gate is lowered or when a human flagman gives or con- tinues to give a signal of the approach or passage of a railroad train; (3) An approaching railroad train is plainly visible and is in haz- Aft proximity to such crossing. ' 2. No person shall drive any vehicle through, around or under any crossing gate or barrier at a railroad crossing while such gate or barrier is closed or is being opened or closed. Section. 6.230. Blocking crosswalks prohibited . The driver of a vehicle shall not stop it on a roadway at a point where it partially or completely obstructs a marked or unmarked crosswalk. Section 6.240. Aft Section 7.010. Following and parking near fire vehicles. The driver:,6f„a4y: vehicle other than one on official business shall not follow any fire apparatus traveling in response to a fire alarm closer than five hundred feet or drive into or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm. Section 7.020. Crossing fire hose. No vehicle shall be driven over:.any unprotected hose of a fire department when laid down on any street, private driveway or streetcar track, to be used at any fire or alarm of fire, without the consent of the fire department official in command. Section 7.030. Driving through funeral or other_ procession. No driver of a vehicle shall drive between the vehicles comprising a funeral or other author- ized procession while they are in motion and when such vehicles are conspicuously designated as provided in Section 3.090. This provision shall not apply at intersections where traffic is controlled by traffic control signals or police officers. Section 7.040. Driving in procession. Each driver in a funeral or other procession shall drive as near to the right hand edge of the roadway as prac- ticable and shall follow the vehicle ahead as close as is practicable and safe. Section 7.050. Funeral procession to be identified. A funeral composed -43- of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such other method as may be determined and designated by the traffic division. Section 7.060. Marches, parades and processions. 1. No group of three or more persons shall march, parade or walk in procession on any public street, roadway, highway or sidewalk in this city, nor shall any parade or procession of three or more motor vehicles be operated on any public street, roadway or highway in the city unless a permit authorizing such march, parade or procession has first been obtained from the chief of police of the city. 2, Application for a permit shall be filed with the chief of police on a form to be provided by him and shall state, among other things, the purpose of the parade, march or procession, and the date, time, intended route and estiimated length and duration thereof. The application shall be filed at least seven days before the intended date of such march, parade or procession unless the chief of police, with the written approval of the mayor, waives such require- ment. 3. If the chief of police determines that such march, parade or pro- cession will not constitute an unreasonable interference with normal vehicular and pedestrian traffic along the route described in the application, he shall issue a permit authorizing the march, parade or procession; provided that, if he further finds that it is in the public interest and safety, he may issue the permit subject to such conditions, including the following, as he may deem reasonably necessary: a. That each person participating in the march, parade or procession shall conduct himself or herself in a peaceful and orderly manner and in compliance with all ordinances of the city. bo That all persons participating in the march, parade or procession shall be subject to the escort of such peace or law enforcement officers as may be available to the city for such duty. 4. If a permit to march, parade or conduct a procession is issued subject to any conditions, the person to whom the permit is issued shall notify each participant in the march, parade or procession of all conditions in the permit, and in any prosecution for a -violation of any condition in the permit, ignorarice of the conditions shall not:.be deemed a defense to the charge preferred. 5. Whenever the chief of police issues a permit under this section, no non-participant in such march, parade or procession shall obstruct or in any way interfere with the order of such march, parade or procession by any means whatsoever. 6. No person, in a group of three or more persons, shall march, parade, or walk or run in procession on any public street, roadway, highway or sidewalk in this city, nor shall any person operate or ride in a motor vehicle in any parade or procession of three or more motor vehicles on any public street, -44- roadway or highway in the city unless a permit authorizing such march, parade or procession has been issued by the chief of police as hereinabove provided. 7. No person participating in any march, parade or procession for which a permit has been issued as hereinabove provided shall violate any of the con- ; ditions, if any, contained in the permit. Gs Section 7.070. Vehicle shall not be driven on a sidewalk. The driver of s a vehicle shall not drive within any sidewalk area except as a permanent or temporary driveway. Section 7.080. Driving on new roadways and sidewalks. A driver shall not operate a vehicle upon any newly improved or surfaced roadway or sidewalk where a barricade has been erected to protect the roadway or sidewalk, or where a sign has been erected either warning against such operation or advising that the t roadway or sidewalk has been closed to traffic; provided however, in an emergency, a vehicle may be operated over a newly improved sidewalk, to the abutting property, {c if the owner of the property or the operator of the vehicle shall beforehand place boards or metal across and upon the newly improved sidewalk to protect the same from the weight of the vehicle. Section 7.090. Limitations on backing. The driver of a vehicle shall not back the same unless such movement can be made with reasonable safety and with- out interfering with other traffic. Section 7.100. Opening and closing vehicle doors. No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, nor shall any person leave a door open on the side of a motor vehicle available to moving traffic for a period of time longer than. necessary to load or unload passengers. Ask Section 7.110. Unattended vehicle; keys to be removed from. No person shall leave a motor vehicle parked or stopped on any roadway in this city un- attended with the keys to the vehicle in the ignition switch. Section 7.120. Unattended vehicles; engine to be stopped: No person:. shall leave a motor vehicle parked or stopped on any roadway in this city with its engine running unless a person qualified and able to operate the vehicle is in same. Section 7.130. Ridingron motorcycles. A person operating a motorcycle shall ride only upon the permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger may ride upon the permanent and regular seat if designed for two persons, or upon another seat firmly attached to the rear or side of the operator. Section 7.140. Riding bicycle on sidewalks. 1. No person shall ride a bicycle upon a sidewalk within a business district existing under the city zoning code. 2. Whenever any person is riding a bicycle upon a sidewalk, such person -45- shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. Section 7.150. Clinking to vehicle. No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself to any vehicle upon a roadway. Section 7.160. Limited access roadways; restrictions on use. 1. All four lane highways divided into two 2-lane highways for traffic moving in opposite directions, together with all access roads and exit ramps leading to and from same, are considered to be limited access roadways for the purposes of this section. 2. No person shall drive a motor vehicle onto or from any limited access roadway except at such entrances and exits established by public authority. 3. No person shall stop a motor vehicle within the limits of the right of way of any limited access roadway except when required by law or when the motor vehicle becomes non-operable, in which event the operator thereof shall have the vehicle removed with all possible speed. 4. The operator of a bicycle or motor scooter shall not drive the same on any limited access roadway except to cross same at right angles by the most direct route at crossings designated by public authority. 5. No pedestrian shall use any limited access roadway except to cross same by the shortest and most direct route at crossings designated by public authority. Section 7.170. Railroad trains not to block streets. It shall be un- lawful for the directing officer or the operator of any railroad grain to direct the operation of or to operate the same in such a manner as to prevent the use of any street for purposes of travel for a period of time longer than five minutes; provided that this section shall not apply to a moving train or to one stopped because of an emergency or for repairs necessary before it can proceed safely. Section 7.180. Towing vehicles. When the driver of a vehicle is towing another, the two vehicles shall not be separated by more than fifteen feet and shall be coupled by a line on which there shall be displayed a white cloth or paper so that the same will be clearly visible to other users of the roadway. During the time that lights are required by Section 11.010 the required lights shall be displayed by both vehicles. Section 7.190. Materials escaping on roadway. No person shall throw or deposit, or permit to escape on or upon, any roadway, any tacks, nails, wire, scrap metal,, glass or crockery, or other substances injurious to the tires of vehicles, or any materials or substances of any kind carried in or upon the vehicle. The driver of a vehicle, who has purposely or accidentally permitted any material or substance of any kind carried in or upon the vehicle to escape upon the roadway, shall immediately stop and clear the roadway of same before proceeding further. -46- �,n Section 7 200. Gasoline carriers, regulation of. 1. The driver of any tank vehicle, or of any tractor pulling a tank trailer, containing gasoline, kerosene, fuel oil or other flammable liquid shall not remain in the vehicle while it is being filled or discharged but he shall stay in the immediate vicinity of the vehicle. A delivery hose, when attached to a tank vehicle, shall be deemed a part of the tank vehicle. 2. No tank vehicle having a capacity of 1,000 gallons or more, when containing gasoline, kerosene, fuel oil or other flammable liquid shall be operated or propelled within the limits of the city except on Highways 50, 54 Wnd 63; provided that such vehicles may depart from these highways to load, unload or secure repairs by using the most direct route to and from the place where the loading or unloading is to be done or the repairs are to be made. Should it be necessary for such a vehicle to depart from the above numbered highways for any purpose other than mentioned above the operator of the vehicle shall first obtain permission from the fire department before making such departure. 3. A tank vehicle shall not be left unattended for a period in excess of two (2) hours on any highway, roadway, street, avenue or alley in this city, provided that stops for rest or meals exceeding two (2) hours in duration may be made during the day and at night if the roadway is well lighted at the point of parking. 4. Tank vehicles containing liquefied petroleum gases or any flammable or combustible liquid, shall not be parked out of doors at one point off of the roadways of the city for longer than two hours unless kept at least 25 feet from all buildings.' 5. Tank vehicles shall not be garaged or parked in any building in the city unless the building has been specifically approved for that purpose by the fire chief. Section 7.210. . Weight restrictions; streets and bridges. The driver of a vehicle: 1. Having a gross weight, when loaded, in excess of 18,000 pounds shall not operate the same without first obtaining a permit from the Director of Public Works on the following named roadways: A. Stadium Boulevard between U. S. Highway 54 and the west corporate limits of the city. B. Southwest Boulevard between the south corporate limits t of the city and a point on Southwest Boulevard located eleven hundred feet south of U. S. Highway 50. 2. Having a gross weight in excess of 16,000 pounds, when loaded, shall _ not operate the same over or upon the bridge at the south end of the 700 block of Ohio Street. 3. Having a manufacturer's rated capacity in excess of one ton shall On ot operate the same upon or over the alley lying between and extending -47- parallel to Cottage Lane and Dunklin Street. Section 7.220. Through traffic Prohibited. The driver of any truck or tractor licensed by the State of Missouri for a gross weight in excess of 6,000 pounds shall not drive the same: A. On Dixon Drive unless the vehicle is moving from, or destined to, a point on Dixon Drive. B. On !Willow Drive unless the vehicle is moving from, or destined to, a point on Willow Drive. C. Section 9.010. Pedestrian control si&nals. Wherever special pedestrian control signals exhibiting the words "Walk" or "Don't Walk" are in place, such signals shall indicate as follows: 1. "Walk" -- pedestrians facing such signal may proceed across the roadway in any direction and shall be given the right of way by the drivers of all vehicles. 2. "Don't Walk" - pedestrians facing such signal shall not start to cross the roadway, but any pedestrian who has partially completed his crossing on the walk signal shall proceed to the sidewalk while the "Don't Walk" signal is showing. Section 9.020. Electrical traffic control signals. 1. Unless otherwise directed by a pedestrian control signal as provided in Section 9.010, pedestrians facing any: (A) Green signal, except when the sole green signal is a turn arrow, may proceed across the roadway within any marked or unmarked crosswalk. (B) Steady yellow signal are advised that there is in- sufficient time to cross the roadway before a red signal is to be shown and no pedestrian shall then start to cross the roadway. (C) Steady red signal alone. shall not enter the roadway. Section 9.030. Pedestrian's use of school crosswalks. When electrical traffic control signals are in operation in or adjacent to marked school cross- walks, a pedestrian shall not enter the roadway within the crosswalk until and unless a steady red signal is being exhibited by the electrical traffic control . signal. -53- i Section 9.040. Right of way in crosswalks. 1. When traffic control sig- nals are not in place or not in operation the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a cross walk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. 2. No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield. 3. Subsection 1 shall not apply under the conditions stated in subsectio 2 of section 9.070. 4. Whenever any vehicle is stopped at a marked cross walk or at any un- marked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle. Section 9.050. Pedestrians to use right half of cross walks. Pedestrians shall move, whenever practicable, upon the right half of crosswalks. Section 9.060. Crossing at right angles. Except when pedestrian control signals mentioned in Section 9.010 are in operation, a pedestrian shall not cross a roadway at any place other than by a route at right angles to the roadway or by the shortest route across the roadway, except in a crosswalk. Section 9.070. When pedestrian shall yield. 1. Every pedestrian crossing a roadway at any point other than within a marked cross walk or within an un- marked cross walk at an intersection shall yield the right of way to all vehicles upon the roadway. 2. Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right of way' to all vehicles upon the roadway. 3. The foregoing rules in this section have no application under the con- ditions stated in section 9.080 when pedestrians are prohibited from crossing at certain designated places. Section 9.080. Prohibited crossing. 1. Between adjacent intersections at which traffic •control signals are in operation, pedestrians shall not cross at any place except in a cross walk. 2. No pedestrian shall cross a roadway intersection diagonally unless authorized by official traffic control devices; and, when authorized to cross diagonally, pedestrians shall. cross only in accordance with the official traffic control devices pertaining to such crossing movements. Section 9.090. Obedience of pedestrians to bridge and railroad signals. 1. No pedestrian shall enter or remain upon any bridge or approach thereto beyond the bridge signal, gate, or barrier after a bridge operation signal indication has been given. . 2. No pedestrian shall pass through, around, over, or under any crossing gate or barrier at a railroad grade crossing or bridge while such gate or barrier is closed or is being opened or closed. Section 9.100. Pedestrians walking along roadways. 1. Where sidewalks are provided it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway. 2. Where sidewalks are not provided any pedestrian walking along and upon a highway shall when practicable walk only on the left side of the roadway Or its shoulder facing traffic which may approach from the opposite direction. Section 9.110. Blind pedestrians. 1. No person, unless totally or par- tially blind, while on any public street or highway, shall carry in a raised or extended position a cane or walking stick which is white in color or white tipped with red. 2. Whenever a pedestrian, guided by a guide dog or carrying in a raised or extended position a cane or walking stick which is white in color or white tipped with red, is crossing or attempting to cross a roadway, the driver of every vehicle approaching that part of the intersection such pedestrian is attempting to enter or cross, shall bring his vehicle to a full stop before arriving at such place of crossing, and before proceeding shall take such pre- cautions as may be necessary to avoid injuring such pedestrian. 3. Subject to the provisions of subsection 3 hereof, where the parking of a vehicle is permitted, on any one way roadway named in Section 6.240, the , vehicle may be parked with its right or left side parallel to and within one foot of "the curb, curbline or edge of the roadway. 3. On the following roadways, a vehicle shall be parked so that: -56- r� (A) The right side of the vehicle forms a thirty (30) degree angle with the curb with the front end of the vehicle at the curb, curbline or roadway edge: (10) On Bolivar Street between State Street and Main Street. (20) On the east half of Jefferson Street between State Street and Capitol Avenue. (30) On Monroe Street between State Street and Capitol Avenue. (40) On the west half of Washington Street between High Street and Wall Street. (B) The right side of the vehicle shall form a thirty (30) degree angle with the curb with the rear wheels of the vehicle at the curb or curbline: (10) On the west half of Broadway Street between Main Street and High Street. (C) The left side of the vehicle shall form a thirty (30) degree angle with the curb with the front wheels of the vehicle at the curb or curbline: (10) On the east half of Adams Street between High Street and McCarty Street. The driver of any vehicle exceeding twenty (20) feet in length shall not park the same on any roadway where angle parking is authorized. Section 10.020. Stopping, standing or Parking prohibited where. Except where necessary to avoid conflict with other traffic or when complying with the directions of a police officer or traffic control device, no person shall: 1. Stop, stand or park a vehicle: (a) On the roadway side of any vehicle stopped or parked at the edge or curb of a roadway; -57- (b) On a sidewalk; (c) Within an intersection; (d) On a crosswalk; (e) Alongside or opposite any street excavation or obstruction when traffic would be further obstructed thereby; (f) Upon any bridge or elevated structure or upon any highway, gob viaduct, or ramp; (g) Upon any access road to or exit road from, a federal or state highway, that is on highway right-of--way; (h) On any railroad track; (i) At any place where signs prohibit stopping. 2. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers: (a) In front of a public or private driveway; (b) Within 15 feet of a fire hydrant, unless in a parking meter space; (c) Within 20 feet of a crosswalk at any intersection; (d) Within 25 feet upon the approach to any flashing signal, stop sign or traffic control signal located at the side of a roadway; (e) Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance (when properly signposted) ; (f) At any place where official signs prohibit standing. , 3. Park a vehicle, whether occupied or not, except temporarily for the purpose of, and while actually engaged in, loading or unloading passengers or merchandise: (a) Within. 50 feet of the nearest rail of a railroad crossing; (b) At any place where official signs prohibit parking. Section 10.030. Parking, obstruction of traffic. No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to leave available less than ten feet of the width of the road- way for free movement of vehicular traffic. -58- Section 10.040. Parking in alleys prohibited when. No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand or parka vehicle within an alley in such position as to block the driveway entrance to any abutting property, Section 10.050, Parking for certain purposes prohibited. No person shall park a vehicle upon any roadway for the principal purpose of (1) Displaying such vehicle for sale; or to (2) Repair such vehicle except repairs necessitated by an emergency. Section 10.060. Parking near school crosswalks prohibited. The operator of a vehicle shall not park the same within a distance of twenty-five (25) feet of any marked school crosswalk established by ordinance. Section 10.070. Parking in excess of 48 hours prohibited. Where the parking of a vehicle is authorized, the operator shall not permit the same to be parked at the same place on the roadway for a period of time in excess of 48 consecutive hours. Section 10.080. Parking non licensed vehicle prohibited. 1. The operator of a vehicle, owned by a resident of the city, shall not park the same on any roadway unless a currently effective city license is displayed on the .lower right hand corner of the windshield of the vehicle. 2. The operator of a vehicle shall not park the same on any roadway unless a currently .effective registration (license) plate, issued by the United States of America, a state of the United States of America, or a foreign country, is attached thereto and displayed thereon. Section 10.090. Parking of trucks, etc. ,_ prohibited. 1. The operator of any truck, tractor, trailer, tractor-trailer or bus shall not park the same on Cliff Drive between Bolivar Street and Clay Street. 2. The operator of any truck, having a capacity of one and one-half (1-1/2) tons or greater, tractor, trailer, tractor-trailer or bus shall not park the same at any place on the east half of Clark Avenue between Dunklin Street and Elm Street. Section 10.100. Parking prohibited at all times where. The driver of a vehicle shall not park it at any point on the following roadways: A. STREETS AND HIGHWAYS. (10) On the east half of Adams Street, south and within 80 feet, of the south curb of Dunklin Street. The street commissioner is hereby authorized and sirected to mark off individual parking spaces in the parking zones described in ubsection 1 of this section and in such other zones as may be hereafter estab- lished, the parking spaces to be designated by lines painted or durably marked on surface of the roadway. -71- 3. Installation of parking meters. Parking meters shall be installed in the parking meter zones upon the curb, parking or sidewalk, adjacent to the park- ing spaces provided for above, and the street commissioner shall be responsible for the regulation, maintenance and operation of the meters. Each meter shall be so located as to show the time of legal parking upon the deposit of the appropriate coin or coins, lawful money of the United States of America. Each meter shall be so constructed that upon the expiration of the lawful time limit, it will indicate by a visible signal that the lawful parking period has expired and in such cases the right of the vehicle to occupy such space shall cease. 4, Parking meters to be observed. Except in a period of emergency deter- mined by an officer of the police or fire department, or in compliance with the directions of a police officer or traffic control signal or sign, when any vehicle shall be parked in any parking space along side or next to a parking meter, the operator of said vehicle, upon entering the parking meter space, shall immediately deposit or cause to be deposited in said meter such proper coin of the United States as is required by such parking meter and as is designated by directions on the parking meter. Upon the deposit of such coin the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for that part of the roadway in which said parking space is located, provided that any person placing a vehicle in a parking meter space adjacent to a parking meter which indicates that unused time has been left in the meter by the previous occupant of the space, shall not be required to deposit a coin so long as his occupancy of said space does not exceed the indicated unused parking time. 5. Operation of parking meters. Parking meters shall be operated in the parking meter zones every day between the hours of 9:00 A.M. and 6:00 P.M. except- ing Sundays and Holidays, and on Fridays from 9:00 A.M. until 9:00 P.M.. The word 'Holidays' shall include only the following days: January 1st, February 12th and 22nd, April 13th, May 30th, July 4th, the first Monday in September, October 12th, November 11th, Thanksgiving Day, December 25th, any state primary election day o state general election day. V 1 6. Parking time period; cost. Parking meter spaces within the parking meter zones hereinabove established may be used for the parking of a vehicle for the time period hereinafter established upon the deposit of the sum of money here- inafter prescribed: (A) Parking meter spaces within parking meter Zone A may be used for thirty (30) minute parking upon deposit of five (.05¢) cents, or sixty (60) minute parking, upon deposit of tern (.10�) cents. (B) Parking meter spaces within parking meter Zone B may be used for sixty (60) minute parking upon deposit of five (.O5p) cents, or two hour parking upon deposit of ten (.10(,%) cents. 7. Parking meter, violations. It shall be unlawful and a violation of this ordinance for any person: (A) To fail to deposit the correct coin in a meter upon parking a vehicle in the parking space adjacent thereto where there is no unused time remaining on the meter. -72- ' f� (B) To cause, allow, permit or suffer any vehicle registered in the name of or operated by such person, to be parked overtime or beyond the period of legal parking time that is established for any parking meter. (C) To park a vehicle within any parking meter space for a period of time in excess of that allowed by the parking meter, and parking for successive period of time within the same parking meter space is prohibited. (D) To park a vehicle in such a way that the vehicle is not entirely within the limits of a parking meter space. (E) To deface, injure, tamper with, open or break, destroy or impair the usefulness of any parking meter. (F) To deposit or cause to be deposited in any parking meter any slugs, devices or metal sub- stances, or any other substitute for lawful money. 8. Restricted parking areas. All bus zones, taxicab stands, loading zones, non-metered reserved or restricted parking zones, or no parking zone, located within the area of any parking meter zone designated in Subsection 1 of this section shall continue in effect until repealed by ordinance. Section 10.140. One Hour Parking. The driver of a vehicle shall not park for longer than one hour between the hours of 7:00 A.M. and 5:00 P.M. on any day, except Sunday or a legal holiday, at any point on the following named roadways: (10) On the east half of Ash Street south, and within 195 feet, of the south curb of High Street. (20) On the west half of Ash Street south, and within 97 feet, of the south curb of High Street. (30) On the north half of Capitol Avenue west, and within 152 feet, of the west curb of Lafayette Street. (40) On Dunklin Street 'between Jefferson Street and Madison* Street. (50) On the south half of High Street between Jackson and Lafayette Street. (60) On the north half of High Street between Jackson and Marshall Street. -73- (70) On the north half of High Street between points 20 and 112 feet east of the east curb of Adams Street. (80) On the south half of High Street east, and within 45 feet, of the east curb of Lafayette Street. (90) On the north half of High Street between points 50 and 135 .feet east of the east curb of Bolivar Street. (40) On the north shoulder of Dunklin Boulevard between 1 Georgia Street and Virginia Street. (50) On the south shoulder of Dunklin Boulevard east, and within 72 feet, of the east improved edge of Virginia Street. (60) On Dunklin Street between Jefferson Street and Washington Street. The driver of a vehicle shall hot park it longer than four hours, between the hours of 7:00 A.M. and 7:00 P.M., ,i -75- MIKE= '101111MM north of the north curb of State Street between points 95 and 180 feet east of the extended east curbline of Monroe Street. Section 10.170. Reserved Parking. The driver of a vehicle shall not park it at any point on the following roadways except as hereinafter authorized: (10) Airport Limousine. On the west half of Madison Street between points 10 and 30 feet south of the south curb of Capitol Avenue; provided that the operator of the Airport Limousine, under a franchise granted by the city, may park said vehicle within said area. (20) County Jail. On the east half of Monroe Street south, and within GO feet, of the south line of Commercial Avenue; provided that the Cole County Sheriff and his deputies while engaged in the performance of their duties may park a vehicle within said area. (30) Police Department. On the east half of Monroe Street south, and within 96 feet, of the south curb of McCarty Street; provided that Police Department per- sonnel and law enforcement officials may park vehicles within said area while in the performance of their duties. Section 10.180. Loading Zones. 1. Any person desiring a loading zone on the roadways in. this city shall file a written application with the Director of Public Works on a form to be provided by his office. A filing fee of $10.00 shall accompany the application. The Director of Public Works shall review the applica- tion and endorse his recommendation thereon and forward same to the Parking and Traffic Commission, which shall review the application and endorsement and make its recommendation to the city council, who shall grant or deny the application. The applicant shall be notified in writing of the action of the city council. If the application is denied, the filing fee shall be refunded. If it is granted, the applicant shall pay all additional fees due under subsection 2 of this section within fifteen days of the date of the notice of the granting of the application. 2. The annual fee for a loading zone shall be based on a minimum rate of $3.50 per foot per year. A loading zone shall normally be established for a period of one year which shall coincide with the calendar year. The annual fee for a loading zone shall be paid in advance on or before December 15th for the following year. The fee for a loading zone established after January 1st of any year may be prorated on a quarterly basis. ' 3. All loading zones in the city shall be subject to the following regula- tions: (a) Loading zones shall only be used by commercial vehicles and delivery trucks. (b) A loading zone shall not be used for longer than fifteen consecutive minutes by any authorized vehicle. (c) A loading zone may be used by an authorized vehicle only while same is being loaded or unloaded. -76- (d) A loading zone shall be subject to all other parking regulations applicable in the area of the loading zone. (e) An authorized vehicle shall be parked parallel to the curb or edge of the roadway while in a loading zone. 4. A loading zone shall not be established (a) if an alley or off-street parking space is reasonably available for use by an applicant therefor, or (b) if there is an existing loading zone on the same side of the roadway within 100 feet of the location of the proposed loading zone. 5. All loading zones, except those established under the provisions of sub- section 1. of Section 10.190, shall be subject to the following additional pro- visions: (a) Loading zones shall be either 18 feet or 36 feet long. (b) No more than three loading zones shall be established in one block. (c) No more than thirty (30%) per cent of the lineal length of a block shall be used for loading zones. 6. Any loading zone that is not used on an average of at least ten times between the hours of 8:00 A,M. and 5:00 P.M. every day of each month, excluding Saturday, Sunday and legal holidays, shall be abolished by the city, upon the recommendation of the Parking and Traffic Commission at the end of the current year. Section 10.190. Loading Zones; Location of. 1. The described area on the liollowing roadways are loading zones between the hours of .8:00 A.M. and 5:00 P.M. very day except Sunday. The driver of a vehicle shall not park it in any of these named loading zones except that commercial vehicles and trucks shall be permitted to park in these 'loading zones for fifteen minutes or less while loading or unload- ing materials at business places in the area: (10) On the east half of Jefferson Street north, and within 73 feet, of the north curb of High Street. (20) On the east half of Jefferson Street south, and within i. 52 feet, of the south curb of High Street. (30) On the east half of Madison Street north, and within 62 feet, of the north curb of High Street. (40) On the east half of Madison Street south, and within 64 feet, of the south curb of High Street. . (50) On the west half of Madison Street north, and within 76 feet, of the north curb of High Street. (60) On the west half of Madison Street south, and within 40 81 feet, of the south curb of High Street. -77- t (70) On the west half of Monroe Street north, and within 51 feet, of the north curb of High Street. (80) On the west half of Monroe Street south, and within 52 feet of the south curb of High Street. 2. The described areas on the following roadways are passenger loading zones or special loading zones. A driver of a vehicle shall not park it in any of these loading zones for a longer period and/or for a purpose other than prescribed herein: Ak (10) Governor Hotel. On the west half of Madison Street AM between points 30 and 82 feet south of the south curb of Capitol Avenue; provided that patrons of the Governor Hotel may park in said zone for 15 minutes or less. (20) Missouri Hotel. On the south half of High Street between points 60 and 130 feet east of the east curb of Adams Street; provided that patrons of the Missouri Hotel may park in said zone for 15 minutes or less. (30) Missouri Pacific Depot. On the north half of State Street between the west curb of Monroe Street and a point 22 feet east of the east curb of Monroe Street; provided that the driver of any vehicle, other than a taxicab, discharging or picking up passengers, baggage or express at the Missouri Pacific Railroad Depot may park in said area for 15 minutes or less. (40) Paul Griffen Body Shop. On the north half of Commercial Avenue between points 180 and 234 feet west of the west curb of Adams Street; provided that patrons of the Paul Griffen Body Shop may park in said zone for 15 minutes or less. (50) United States Post Office. On the south half of High Street between points 50 and 175 feet east of the east curb of Washington Street, or on the east half of Washington Street between points 20 and 96 feet south of the south curb of High Street; provided that patrons of the United States Post Office, while on postal business, may park in either of said zones for 10 minutes or less. (60) U. S. Mail Drop Boxes. On the north half of High Street between points 50 and 173 feet east of the east curb of Washington Street, or on the south half of High Street west, and within 30 feet, of the west curb of Washington Street, or on the east half of Washington Street north, and within. 40 feet, of the north line of Wall Street; provided that any person, depositing mail in a United States Drop Box at any of the above areas, may park a vehicle in any of the three i zones for 2 minutes or less. -78- 3. The described area on the following roadway is a passenger loading zone. A driver of a vehicle shall not park it in said loading zone at any time between the hours prescribed on any day, except Sunday, unless loading or unloading passengers: (10) On the south half, of McCarty Street between points located 163 and 198 feet west of the west curb of Jefferson Street, between 7:00 A.M. and 9:00 A.M. or between 4:00 P.M. and 6:00 P.M. on any day of the week except Sunday. Section 10.200. Taxicab stands and loading zones. 1. The following areas &-e taxicab stands: (A) Governor Hotel. The west half of Madison Street between points 30 and 66 feet north of the north curb of Capitol Avenue. (B) Missouri Hotel. The south half of High Street between points 21 and 61 feet east of the east curb of Adams Street. (C) City Cab Company. The west half of Madison Street between points 3.90 and 210 feet north of the north curb of High Street. (D) Missouri Pacific Depot. The north shoulder of State Street between points 37 and 146 feet west of the extended west curb of State Street. 2. The following area is a taxicab loading zone: Missouri Pacific Depot. The north half of State Street f'k.. west, and within 25 feet, of the west curb of Monroe Street. yqi 3. The driver of a vehicle, other than a taxicab, shall not stand or park it e� in any taxicab stand or taxicab loading zone. Y 4. The driver of a taxicab, other than a taxicab of City Cab Company, shall not park it in the taxicab stand described in subsection 1 (C) of this section. ` S. The driver of a taxicab shall occupy it while it is standing or parked in a taxicab stand or taxicab loading zone. . 6. Only one taxicab of the same company shall be parked at the same time Y P s in any taxicab stand. 4�; .. 7. , The driver of a taxicab shall not park it within a parking meter space on any roadway. Section 10.210. City bus zones. The driver of a vehicle, other than a bus AbI the Jefferson City Transit Authority, shall not park it in any bus zone at any ime on any day the city busses are operating provided that the bus zone has been clearly signed or otherwise identified. -79- Section 10.220. School bus zones. The driver of a vehicle7than school bus, shall not park it at any time between the hours on any y herein at any point on any of the following roadways: (10) Freshman High School. On the south half of Miller, Street between Madison and Monroe Streets between 7:30 and 8:30 A.M. or between 3:00 and 4:00 P.M. on any day the school is attended by children; also On the west half of Madison Street south, and within 200 feet, of the south curb of Miller Street between 3:00 and 4:00 P.M. on any day the school is attended by children. (20) St. Joseph's School. On the south shoulder of Main Street between points 220 and 554 feet east of the east curb of Westmore Drive between 7:00 A.M. and 4:00 P.M. when school is attended by children. (30) St. Peter's School. On the north half of High Street between points 50 and 233 feet west of the west curb of Broadway Street between 7:00 A.M. and 4:00 P.M. when school is attended by children. (40) Thorpe Gordon School. On the east half of Jackson Street south, and within 50 feet, of the south curb of Woodlawn Street between 7:00 A.M. and 4:00 P.M. when school is attended by children. (50) West School. On the west half of Dix Road between two points 244 and 314 feet south of the south curb of Main Street, between 7:00 A.M. and 4:00 P.M. when school is attended by children. Section 10230. Commercial Avenue, parking prohibited between Adams Street and Jefferson Street. 1. The driver of a vehicle, other than a. law officer delivering or receiving prisoners at the Cole County jail, shall not park it on the north half of Commercial Avenue between Adams Street and Jefferson Street. 2. The driver of a vehicle, other than a person delivering or picking up materials, shall not park it on the south half of Commercial Avenue between Adams Street and Jefferson Street. Section 10.240. Wall Street, parking Rrohibited between Adams Street and Jefferson Street. 1. The driver of a vehicle shall not park it on the south half of Wall Street between Adams Street and Jefferson Street. 2. The driver of a vehicle, other than a person delivering or picking up materials, shall not park it on the north half of Wall Street between Adams Street and Jefferson Street. Section 10.250. I.am_ps on parked vehicles. 1. Whenever a vehicle is law- 0 fully parked upon a street or highway during the hours between a half hour after -80_ sunset and a half hour before sunrise and in the event there is sufficient light to reveal any person or object within a distance of five hundred feet upon such street or highway no lights need be displayed upon such parked vehicle. 2. Whenever a vehicle is parked or stopped upon a roadway or shoulder adja- cent thereto, whether attended or unattended, during the hours between a half hour after sunset and a half hour before sunrise and there is not sufficient light to reveal any person or object within a distance of five hundred feet upon such highway, such vehicle so parked or stopped shall be equipped with one or more lamps meeting Na the following requirements: At least one lamp shall display a white or amber light Sisible from a distance of five hundred feet to the front of the vehicle, and the ame lamp or at least one other lamp shall display a red light visible from a distance of five hundred feet to the rear of the vehicle, and the location of said lamp or lamps shall always be such that at least one lamp or combination of lamps meeting the requirements of this section is installed as near as practicable to the side of the vehicle which is closer to passing traffic. The foregoing provisions shall not apply to a motor driven cycle. 3. Any lighted 'head lamps upon a parked vehicle shall be depressed or dimmed. Section 10.260. Permits to load or unload at an angle. 1. The police depart- ment is authorized to issue special permits to permit the backing of a vehicle to the curb for the purpose of loading or unloading merchandise or materials subject to the terms and conditions of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of the vehicle and shall grant to such person the privilege as therein stated and authorized herein. 2. It shall be unlawful for any permittee or other person to violate any of the special terms or conditions of any such permit. Section 10.270. Parkin suns required. Wherever any parking time limit is posed or parking is prohibited on designated streets or roadways, it shall be the duty of the street commissioner to erect appropriate signs giving notice thereof and no parking restriction or regulation shall be effective unless said signs are erected and in place at the time of an alleged offense. Section 10.280. Parking regulations non-exclusive. The provisions of Sections 10.010 through 10.270 are cumulative, and a provision limiting the time during which a vehicle may be parked shall not relieve a driver of a vehicle from compliance with more restrictive applicable provisions limiting or prohibiting stopping, standing or parking of a vehicle for specific times, in specific places or for specific purposes. ?' Section 10.290. Abandoned or disabled vehicles; removal. 1. Any police {?' officer may have any abandoned or disabled motor vehicle towed away and stored by any service station or garage licensed to do business in the city. A report showing the location of the stored vehicle shall be filed by the police officer who authorized its removal with the Chief of Police, who shall notify the owner and any holder of a security interest appearing on the title of said vehicle, of the location of the vehicle by certified mail. 2. The owner of any vehicle removed from any roadway in this city under the provisions of subsection 1 of this section, or the holder of a security interest in the leehicle, which interest is in default, may reclaim it from the service station or garage -81- e upon proof of ownership, or valid security interest which is in default, and full payment of all charges for the towing and storage of the vehicle. 3. No service station or garage towing and storing a motor vehicle under the provisions of subsection 1 of this section shall charge a fee in excess of $10.00 for towing the vehicle and $:1.00 per day for each day the vehicle shall be stored. 4. The owner of the service station or garage towing and storing a vehicle under to provisions of subsection 1 of this section may sell the vehicle at public auction if it is unclaimed for at least 90 days after coming into his possession after first posting public notices for at least 10 days prior to the sale at his place of business, on Che bulletin board in the City Hall building and at the Cole County courthouse. The notice shall include a description of the vehicle, including any identifying marks or numbers, the date and place where it was found, the time -and place of the public auction, and the accrued charges against the vehicle. 5. The proceeds of the sale shall first be used to pay the cost of the sale, all towing and storage costs accrued against the vehicle, and the balance, if any, shall be paid into the general revenue fund of the city. 6. Neither the city nor any officer, employee, police officer, nor the owner of any service station or garage towing and storing a motor vehicle under the pro- visions of subsection 1 of this section shall be responsible for the issuance of a certificate of title for any motor vehicle sold under the provisions of subsection 4 of this section, Section 10.300. Removal of vehicles. 1. Police officers are authorized to have a motor vehicle removed from a street or highway to a service station, garage or other place of safety: (A) When any vehicle is left unattended upon any bridge, viaduct, or causeway, or in any tube or tunnel where such vehicle constitutes an obstruction to traffic; (B) When a vehicle upon a highway is so disabled as to constitute an obstruction to traffic and the person in charge of the vehicle is by reason of physical injury incapacitated to such an extent as to be unable co provide for its custody or removal; (C) When any vehicle is left unattended upon a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic. 2. Anv motor vehicle removed from a street or highway under the provisions of subsection 1 of this section shall be considered an abandoned or disabled motor vehicle and the provisions and procedures in Section 10.290 shall apply and be observed. Section 10.310. Vehicles Left on private property: removal. 1. No person in charge or control of any property within the city, whether as owner, tenant, occupant, lessee, or otherwise, shall allow any partially dismantled, non-operatic wrecked, junked or discarded vehicle to remain on such property for longer than 7* -82- consecutive hours. No person shall leave any such vehicle on any property in the city for' a period exceeding 72 consecutive hours, except (A) when in an enclosed building, or (B) on the premises of a business operating in a lawful place and manner when necessary to the operation of such business, or (C) in an appropriate storage place or depository maintained by the city. 2. No person shall park or leave standing any motor vehicle upon any privately owned land, parking lot or driveway, after notice has been posted as hereinafter pro- vided by the owner, occupant, lessee or licensee, prohibiting, restricting or limiting such parking, without the express or implied consent of such owner, occupant, lessee r licensee of the land. A suitable sign or signs, not less than 18 inches by 24 nches in dimension, bearing the words "No Parking", together with any qualifications or restrictions on such parking, if any, shall be conspicuously displayed on such land, parking lot or driveway by the owner, occupant, lessee or licensee, to make this subsection effective. 3. Upon written complaint by any owner, occupant, lessee or licensee, or any other person adversely affected, that a motor vehicle has been parked or left stand- ing in violation of any provision of this section, such vehicle shall be considered an abandoned or disabled motor vehicle and the provisions and procedures in Section 10.290 shall apply and be observed. Section 10.320. Presumption to apply. In any prosecution for a violatidn of any of the provisions of Section 10.010 through 10.310, proof that the vehicle described in the complaint was parked in violation of any provisions of those sec- tions, together with proof that the defendant named in the complaint was at the time of such parking the owner of the vehicle, shall constitute in evidence a prima facie presumption that the owner of the vehicle was the person who parked the vehicle at the point where, and for the time during which, such violation occurred. j r Y+� I� -83- �7 t ARTICLE XI EQUIPMENT REGULATIONS Section 11.010 Lights required. 11.020 Other equipment required. 11.030 Motorcycles and motor bikes. 11.040 Tampering with motor vehicles. 11.050 Damaging motor vehicles. Section 11.010. Lights required. 1. For the purpose of revealing its position and direction while being operated on a roadway, when lights are required: A. Every vehicle, other than a motor drawn vehicle or a motorcycle, . shall be equipped with at least two headlamps, with at least one headlamp mounted at the same level on each side of the front of the vehicle, displaying white light illuminating the roadway ahead. B. Every motorcycle shall be equipped with at least one and not more than two headlamps mounted on the front of the vehicle and displaying white light illuminating the roadway ahead. C. Every vehicle shall be equipped with at least two lamps mounted at the rear and displaying red lights plainly visible at least five hundred feet to the rear of the vehicle. 2. All motor vehicles and trailers, required to carry a state license plate in on the rear, shall have a rear lamp so constructed, mounted and adjusted to prod sufficient white light to illuminate and make clearly legible the license Plate from a distance of fifty feet_ to the rear when lights are required. an 3. Any motor vehicle may be equipped with not to exceed one spot lamp but every lighted spot lamp shall be so aimed and used as not to be dazzling or glaring to any person. 4. The phrase "when lights are required" shall mean at any time from a half- hour after sunset to a half-hour before sunrise and at any other time when there is not sufficient light to render clearly discernible persons and vehicles on the road- way. 5. No person operating a motor vehicle, a motorcycle or pulling a motor drawn , vehicle shall fail to comply with the applicable provisions of this section. Section 11.020. Other equipment required. 1. Signaling devices: Every motor vehicle shall be equipped, with a horn, directed forward, or whistle in good working order, capable of emitting a sound adequate in quantity and volume to give warning of the approach of such vehicle to other users of the roadway and to pedes- trians, Such signaling device shall be used to warn only and shall not be used to make any unnecessary noise, and no other sound-producing signaling device shall used at any time. -84- 2. Muffler cutouts: Muffler cutouts shall not be used and no motor vehicle shall be operated in such manner or condition that excessive and unnecessary noises shall be made by its machinery motor, or other parts, or by any improperly loaded cargo. The motors of all motor vehicles shall be fitted with properly attached mufflers of such capacity, condition and construction as to quiet the maximum pos- sible exhaust noise as completely as is done in modern gas engine passenger motor vehicles. Any cutout or opening in the exhaust pipe between the motor and the muff- ler on any motor vehicle shall be completely closed and disconnected from its operating level, and shall be so arranged that it cannot automatically open, or be opened or operated while such vehicle is in motion. 3. Brakes: All motor vehicles, except motorcycles, shall be equipped at all imes with two sets of adequate brakes, in good working order, and motorcycles shall be equipped with one set of adequate brakes in good working order. 4. Mirrors: All motor vehicles which are so constructed or loaded that the operator cannot see the roadway behind the vehicle by looking back or around the side of the vehicle shall be equipped with a mirror so mounted and adjusted as to reveal the roadway behind and be visible from the seat of the operator. 5, Projections on vehicles: All vehicles carrying poles or other objects, which project more than five feet from the rear of the vehicle, shall during the period when lights are required, as defined and provided in Section 11.010, carry a red light at or near the rear end of the pole or object so projecting. At other times a red flag or cloth, not less than sixteen inches square, shall be displayed at the end of the pole or object projecting. 6. No person shall operate a motor vehicle which is not equipped as herein- above provided, and no person, while operating a motor vehicle, shall fail to comply with all applicable provisions of this section. Section 11.030. Motorcycles and motor bikes. 1. No person shall operate, Oarry a passenger on, or ride as a passenger on, any motorcycle, motor scooter or motor bike upon any roadway, or in any public park, in the city unless the operator and passenger,if any, is wearing a safety helmet approved by the Chief of Police with a chin strap firmly fastened while the vehicle is in motion. 2. No person shall rent, lease or lend a motorcycle, motor scooter or motor bike to another without first ascertaining that such person is equipped with a safety helmet of a type approved by the chief of police and is the holder of a currently effective license from the State of Missouri or another state authorizing the opera- tion of such a vehicle. 3. No operator of, or passenger on, a motorcycle, motor scooter or motor bike shall ride upon same "sidesaddle" and every operator and passenger on such a vehicle shall sit upon same in such manner as to have a leg on each side of the frame of the vehicle at all times while the vehicle is in motion. Section 11.040. Tampering with motor vehicles. No person shall drive, use or tamper with a motor vehicle in this city without permission of the owner thereof. No person shall climb upon or into or swing upon a motor vehicle or trailer, or sound the horn or attempt to manipulate any lever, starting device, steering wheel, brakes or any part of the machinery of a motor vehicle, or set the machinery in motion with- ut the permission of the owner or person in charge thereof. -85- Section 11.050. Damaging motor vehicles. No person shall damage or injure a motor vehicle in this city by cutting, slashing, breaking, twisting or puncturing any part thereof or by throwing, placing, painting or wiping any substance thereon, or by placing any substance in a vehicle, or any part thereof, that might damage, foul up or ruin said motor vehicle, or any part thereof. t. i f -86- ARTICLE XII MOTOR VEHICLE LICENSE Section 12.010 Motor vehicle license, 12.020 Exemptions; vehicles operated outside of city, etc. 1 2.030 Delinquent licenses, penalty. 2.040 Resident dealers license. 12.050 Issuance of license, conditions. 12.060 Horsepower rating, 12.070 License renewal. 12.080 Semi-annual or quarterly registration. 12.090 New residents, delinquent license, penalty. 12.100 Display of license. 12.110 Duplicate licenses obtainable. 12.120 License not transferrable. 12.130 Penalty. Section 12.010. Motor vehicle license. Every resident of this city owning a motor vehicle that is operated upon any street or highway in this city shall re- gister the motor vehicle with the city collector and purchase a city license on or before the first day of July of each year for the privilege of operating said motor vehicle within said city for all or any portion of the twelve month period beginning on the first day of July in the year in which said license is required, and the cost of said city license shall be as follows: Adh (a) For Motor vehicles other than commercial motor vehicles: Less than 12 horsepower--------------------------------- --------------$2.50 12 horsepower and less than 24 horsepower-T------------- 3.50 24 horsepower and less than 36 horsepower- 5.50 36 horsepower and less than 48 horsepower--------------- 7.50 48 horsepower and less than 60 horsepower--------------- 8.50 . 60 horsepower and less than 72 horsepower-v-------------10.50 72 horsepower and more----------------------------------12.50 Motorcycles---------------------------------------------- 2.00 Motortricyc.les------------------------------------------- 2.50 (b) For commercial motor vehicles having a manufacturer's s rated capacity of_: Less than 2 tons---------------------------------------- 3.50 2 tons and less than 5 tons----------------------------- 6.00 5 tons and less than 6 tons----------------------------- 9.00 6 tons and less than 7 tons-----------------------------10.00 7 tons and less than 8 tons-----------------------------12.00 And for every ton or major fraction thereof in excess of 8 tons, $5.00 per ton. �1 -87- E l Section 12.020. Exemption., vehicles operated exclusively outside of the city: public service commission licenses. Section 12.010 shall not apply to: (a) A resident of this city owning a motor vehicle which is used exclusively outside of said city, and (b) To any motor vehicle, to which is attached an annual license issued by the Public Service Commission of Missouri, operated by either a common carrier or a contract carrier regulated by said commission. Section 12.030. Delinquent licenses, penalty, All licenses issued after t first day of July shall be considered delinquent, and the applicant for a license shall incur a penalty in the amount of $2.00 for the first month or any part thereof, and ten (10%) per cent of the amount of the license for each additional month, or part thereof, that the license is delinquent when purchased; provided however, that a license for a motor vehicle, which has been recently titled and is being licensed by the owner thereof for the first time, shall be considered delinquent upon the expiration of thirty days from the date on the bill of sale of said vehicle, and the applicant for a license for such vehicle shall incur a penalty of $2.00 for the first thirty day period, or part thereof, the license is delinquent when purchased, and an additional penalty of ten (10%) per cent for each additional thirty day period, or part thereof, that the license is delinquent when purchased. All penalties for delinquent licenses and the appropriate license fee stated above shall be paid to and collected by the city collector from the person, firm or corporation to whom the license is issued. Section 12,040. Resident dealers license. Every resident dealer of motor vehicles who, under the motor vehicle laws of the State of Missouri, shall have obtained a dealer's general distinctive number, may instead of registering each motor vehicle dealt in as provided hereinbefore, register with the Collector of City of Jefferson, on or before the first day of January of each year, such dis- tinctive number so awarded by the state, the name of the person, association or I corporation to whom assigned and the business address thereof, and on payment of the registration fee of Five ($5,00) Dollars may receive from the City Collector a certificate of registration, bearing thereon the date of issue and the year for which issued and also five license plates. Such person, association or corporation may obtain as many additional. license plates as may be desired by presenting to the City Collector the certificate of registration and paying not less than Five ($5.00) Dollars for each additional set of five license plates. It shall be the duty of the I City Collector to endorse, both on the certificate of registration and on the records retained in his office, all of the city license plate numbers issued under the certificate of registration. License plates so issued shall be placed and used only on motor vehicles bearing a state dealer's license plate. Those qualifying and regis- tering under this section shall be subject to all of the regulations imposed by Sec- tions 12.010 - 12.130 on other registrants and liable under the penalties prescribed. Section 12.050, Issuance of license: conditions. The City Collector shall issue a motor vehicle license sticker to the registered owner thereof upon payment of the amount designated in Section 12.010 and presentation to the collector of proper evidence of (a) title to the motor vehicle from the Department of Revenue -88- rM of Missouri, Division of Motor Vehicle Registration, and (b) payment of all personal property taxes by the resident owner of said motor vehicle for all previous tax years. Section 12.060. Horsepower rating. The horsepower of all motor vehicles for the purpose of determining the cost of the license sticker thereupon shall be determined according to the rating provided and established by the laws of the State of Missouri for ascertaining the cost of State license plates. Section 12.070. License Renewal, License stickers shall be renewed annually n the same manner and upon payment of the same fees as set out in Section 12.010, aid license sticker to take effect on the first day of July of each year and said license sticker shall expire on the succeeding first day of July. Section 12.080. Semi-annual or Quarterly Registration. If the application for a license sticker on a motor vehicle is made during the period beginning January 1st and ending March 31st, one-half of the annual license fee shall be paid. If the application is made during the period from April 1st to June 30th, one-fourth of the annual license fee shall be paid. Section 12-090 New residents; delinquent license, penalty. New residents of this city shall have thirty days from the date of residence in this city in which to purchase a motor vehicle license sticker, and upon the expiration of said thirty day period, said license shall be deemed delinquent and bear a penalty of Two ($2.00) Dollars if purchased within the next 30 day period, and if purchased thereafter shall bear an additional penalty of ten (10%) per cent for each additional thirty day period, or any portion thereof, expiring between the date that the license becomes delinquent and the date the license is issued. Section 1.2,100. Display of license. The owner of a motor vehicle subject to Vj he provisions of Sec.tians 12.010 - 12.130 shall conspicuously display and affix such 1 icense sticker on the lower right hand corner of the windshield of said motor vehicle. Section 12.110. Duplicate licenses obtainable. Duplicate copies of motor vehicle license stickers may be obtained from the City Collector upon satisfactory proof of the destruction or loss of the original license sticker and upon payment of the sum of One ($1.00) Dollar- Whenever the original sticker is destroyed, or the windshield upon which said sticker was placed is broken, or upon the sale of the motor vehicle carrying a city license, the City Collector, upon satisfactory proof, may issue a duplicate license sticker. Satisfactory proof shall be deemed to be the exhibiting to the City Collector of a sufficient portion of the license sticker as will disclose that the original license sticker is destroyed to such a degree as to be no longer useable. Section 12.120„ Lir.ense not transferable... City license stickers shall riot be transferable from one owner of a vehicle to a subsequent owner of the same motor vehicle and may only be used on automobiles actually owned by the purchaser of the license. Section 12,.130., Penalty Every person, firm, or corporation, or manager, agent or employee thereof violating any of the provisions of Sections 12.010-12.130 Wall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined ot less than Five ($5.00) Dollars nor more than One Hundred($100.00) Dollars, or im- prisoned in jail for not more than ninety (90) days, or shall be both so fined and imprisoned. -89- ARTICLE XIII PENALTIES Section 13.010 Penalty. Section 13.010. Penalty. 1. Any p erson violating any of the provisions o Sections 1.010 through 11.040 shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not more than $100.00, or by imprisonment in jail for not more than 90 days, or by both such fine and imprison- ment. 2, All towing and storage expense, if any, remaining unpaid by any person convicted of a violation of any of the provisions of Sections 10.010 through 10.320 shall be added to any fine assessed under Subsection 1. of this Section and collected with the fine. i I I I i . i i i i t r 7 , y i Section 3.
