HomeMy Public PortalAboutORD08081 BILL NO. - G INTRODUCED BY COUNCILMAN - _ '-.Y Auk ORDINANCE NO. d S / ,�,,c,»•.�,� AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CLERK OF THE CITY T4 EXECUTE IN BEHALF OF THE CITY AN AGREEMENT WITH THE CONSULTING ENGINEERING FIRM OF WILBUR SMITH AND ASSOCIATES, INC., KANSAS CITY, MISSOURI , RELATING TO DESCRIBED PROFESSIONAL SERVICES TO BE FURNISHED BY WILBUR SMITH AND ASSOCIATES, INC. , TO THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Mayor and Clerk of the City are hereby authorized and directed, in behalf of the City of Jefferson, Missouri, to execute an agreement with the Consulting Engineering firm of Wilbur Smith and Associates, Inc. , Kansas City, Missouri, for an engineering service contract for traffic engineering services. SECTION 2. The agreement shall read in words and figures as follows: (SEE ATTACHED AGREEMENT) SECTION 3. This ordinance shall take effect and be in force from and after its passage and approval. Passed: Approved: P s dent of t ounc ill Ma r Attest: City Clokk ::a AGREEMENT This AGREEMENT, made and entered into this —,f,20. day of 1968, by and between the City of Jefferson City, Missorri, hereinafter referred to as the CITY, and Wilbur Smith and Associates, Inc. , Consulting Traffic Engineers, with offices at 822 Commerce Tower, Kansas City, Missouri, hereinafter re- ferred to as the CONSULTANT WITHESSEDs WHEREAS, the CITY desires to engage the services of the CONSULTANT to perform continuing consulting traffic engineering ® services, and WHEREAS, the CONSULTANT is agreeable to providing the necessary services based on the terms and for the consideration hereinafter described: NOW, THEREFORE, for and in the consideration and mutual convenants hereinafter stipulated, it is agreed between the parties as followss . SECTION I - The CONSULTANT agrees to provide the CITY with sustained traffic engineering consulting services relative to traffic operations and parking matters, including but not limited to the followings A. Treatments relative to high accident and congested locations B. Application of basic traffic regulations such as one-way streets, restricted turns, truck routes, parking controls, etc. C. improvement of traffic signals and other control devices. D. Analyses and technical advice relative to traffic com- plaints. E. Mass Transportation problems. F. Assistance with local planning and engineering agencies as well as liaison with the Missouri State Highway Department on plans for new or improved roadways and operational improvements. G. Improvement in parking, both curb and off-street. H. General traffic engineering advice. SECTION II - The CONSULTANT shall comply with all Federal and state laws and city ordinances applicable to the work to be performed under this agreement and ggrees to save harmless the CITY from all claims and liability due to the negligence of the CONSULTANT, his agents, and employees. SECTION III - All of the work will be performed by the CONSULTANT under the CITY'S direction and in close cooperation with all municipal agencies. The CONSULTANT will be expected to report directly to the Director of Public Works. - e SECTION I V The CITY agrees to provide the CONSULTANT access to pertinent data, records, and reports applicable to the services provided under this agreement. SECTION V - The CONSULTANT shall furnish the CITY with copies of all reports and other information provided for in this Wgreement and all of the data and material collected as part of the services shall become the property of the CITY. SECTION VI - The CITY agrees to pay the CONSULTANT, for sustained traffic engineering services requested by the CITY on the basis of the per diem rate set forth in the RATE SCHEDULE attached hereto and by this reference is made a part of this agreement. The CONSULTANT may, as directed by the CITY, represent the CITY at public hearings, and other meetings. Compensation for such meetings shall be at the rate set forth in the attached RATE SCHEDULE, SECTION VII - This agreement is to become effective within ten (10) days after execution. The agreement may be terminated for any reason upon thirty (30) days notice in writing by either party to the other. (7) For appearances at formal hearings or court testimony the above rates are to be increased by 50 per cent. (3) Fees are payable In U.S.dollars without discount. (4) Rate includes travel time and working time up to a maximum of ten (10) hours per day. Time in excess of ten (10) hours in one day will be charged as additional time in terms of fractional days. 4•ee
