Q/�o AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY 110 EXECUTE A LEASE WITH THE HOUSING AUTHORITY OF THE CITY OF JEFFERSON, MISSOURI, OF CERTAIN REAL ESTATE IN THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk of the City are hereby authorized and directed to execute a written lease with the Housing Authority of the City of Jefferson, Missouri. Section ,2. Said written lease shall read in words and figures as follows: r. LEA 3 E This lease, made and entered into this day of , 196 , by and between the Housing Authority of the City of Jefferson, Missouri, hereinafter called Lessor, and the City of Jefferson, Missouri, a municipal corporation, hereinafter called Lessee. WITNESSE.TH: 1. Description. Lessor for and in consideration of the rentals hereinafter provided and the covenants and agreements hereinafter contained, hereby lets and leases unto the Lessee the following described premises located in Cole County, Jefferson City, Missouri, the same being a part of Progress Urban Renewal Project, Mo. R-45, to-wit: Parcel No. B-11, Parking Lot No. 24, described as follows: Part of Inlots numbered 605 and 606 in the City of Jefferson, Missouri, • being the northerly half of the southerly half of said Inlots the same' fronting 49 feet 8k inches on Monroe Street and running back 208 feet and 9 inches to the easterly line of said Inlot Number 606, in the City of Jefferson, Missouri. ALSO: The Southerly part of Inlots 605 and 606 in the City of Jefferson, Missouri, Beginning at the South Westerly corner of Inlot 605, thence Easterly along Public Alley 208 feet 9 inches, thence Northerly parallel with Monroe Street 49 feet 6 inches, thence Westerly parallel with Alley 208 feet and 9, inches to Monroe Street, thence Southerly along Monroe Street 49 feet and 6 inches to the place of beginning. All located in the supporting area. c�&d additional lots or parcels in said Progress Project hereafter made available from time to time by Lessor and accepted by Lessee for use as temporary parking. Such additional entire parking lots shall become a part of this lease agreed upon written notice of availability given-by Lessor and acceptance thereof by Lessee. 2. Length of Term. To have and to hold the above described premises for a term of one year beginning on the date hereof, and as to additional lots for a term of one year from the date of acceptance of notice of availability by M►4�` Lessee of each such lot, and thereafter the terms IWO be automatically extended from month to month until purchase of all lots by Lessee as provided in, paragraph 7 hereof. 3. Rental. The rent to be paid by Lessee for the premises herein above. described shall be $ 77.00 per month. The rent to be paid by Lessee for lots added to this lease as provided in paragraph 2 shall be as follows: now _ 1 - 1) Monthly rates for single parking. spaces axe hereby established at $2.00 per month the first year, $3.00 par month the second year and $5.00 per month the third and additional ,years per space within the Prime Area; $1.00 per month the first year, $1.50 per month the second year and $2.00 per month the third and additional years per space within the Secondary Area; and $1.00 per month per space in the Supporting Area, each areas as shown on the map attached to and a part of this Agreement; it being under- stood by the parties that said rates are based on the fair reuse value of the subject land for public parking use and established in consideration of the City's agreement to accept all lots as made available and to prepare and maintain said lots for temporary parking use. No part of said .rental shall i apply to the purchase price. 2) The number of parking spaces in a parking lot shall be determined by the number of meters installed or, if no meters are installed, by the i number of useable spaces designated by the Housing Authority and accepted by the City. Upon receipt of Notice of Availability, the City shall ( promptly proceed to prepare the available spaces for temporary parking and upon completion of said preparation shall accept the parking lots as prescribed in this Agreement. The rent shall be paid by Lessee to Lessor at the end of the first year for each lot, and thereafter shall be payable f quarterly. All unpaid rent shall be due and payable at, the time of purchase � , . by Lessee. 4. Limitation on Liability of Lessor. The Lessee accepts the demised remises in their present condition, and agrees to maintain the same at its expense. The Lessor shall not be liable for any damages occasioned by failure -to f, keep the premises in repair. 5. Improvements by -Lessee. Lessee may at its own expense improve the premises as, may be required for the purposes of operating and maintaining a public parking lot. { 6. Agreement to Purchase. Lessee has heretofore entered into a cooperation agreement with Lessor, pursuant to which it was agreed to purchase said premises, . at the fair market value at the time of purchase as established by two reuse appraisals made by competent appraisers selected by Lessor. Lessor shall convey merchantable title, and shall furnish to Lessee as purchaser either an abstract title or title insurance, and shall convey title to Lessee (purchaser) free i i and clear of encumbrance. 4 ' . 2 . 7. Assum, mptionof Liabtlity,. Lessee shall be liable for any and all injuries or damages incurred on or about the premises described herein during e term of this lease, and Lessee agrees to indemnify and hold harmless the,t Lessor from and against any and all damages, costs and expenses of any kind arising out of or resulting from the use of said premises by Lessee.
