ORDINANCE NO.
AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS
AMENDING SECTION 10-32 OF THE CITY CODE TO AMEND
PROVISIONS REGARDING THE MEMBERSHIP OF THE RICHLAND
HILLS ANIMAL SHELTER ADVISORY BOARD TO MODIFY THE VOTE
REQUIRED TO APPROVE A NOMINATION; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted
by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the
Local Government Code; and
WHEREAS, the City Council of the City of Richland Hills has previously authorized the
creation of the Animal Shelter Advisory Board, and provided procedures for appointment of same;
and
WHEREAS, the City Council has now determined that the provisions regarding membership
should be revised to modify how nominations are approved by the City Council; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
SECTION 1.
AMENDMENT OF SECTION 10-32
Section 10-32 of Article II of Chapter 10 of the Richland Hills City Code is hereby amended
to read as follows:
Section 10-32. Composition, appointments and terms of members.
(a) The animal shelter advisory board shall be composed of fourteen members
who shall hold designated places lA, 1B, 2A, 2B, 3A, 3B, 4A, 4B, SA, SB, 6, 7, 8
and 9.
(b) Each member of the City Council shall be entitled to nominate the two
members of the board whose places correspond to the nominating councilmember's
place on the City Council. Nominations for such places (1 A, 1 B, 2A, 2B, 3A, 3B, 4A,
4B, SA, SB) shall be subject to approval by a majority vote of the Council members
present. The term of each member of the animal shelter advisory board serving in
places lA, 1B, 2A, 2B, 3A, 3B, 4A, 4B, SA, and SB shall correspond to the term of
the member of the council nominating such board member.

(c) Place 6 shall be held by a licensed veterinarian; place 7 shall be held by a
municipal official; place 8 shall be held by a person whose duties include daily
operation of an animal shelter; and place 9 shall be held by a representative of an
animal welfare organization. Any member of the City Council may nominate a
person to Places 6 through 9, and each nomination shall be subject to approval by a
majority vote of the City Council. The city manager may recommend persons for
appointment to places 7 and 8, with the advice of the chief of police. The term of
each member of the board serving in places 6 through 9 shall serve for a term of two
years from the date of appointment.
(d) The city staff representative to the board shall be the chief of police or other
city employee as approved by the city manager.
The remainder of Article II of Chapter 10 shall remain unchanged.
SECTION 2.
PROVISIONS CUMULATIVE
This ordinance shall be cumulative of all provisions of ordinances and of the Code of
Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event
the conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
PROVISIONS SEVERABLE
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect
any ofthe remaining phrases, clauses, sentences, paragraphs and sections ofthis ordinance, since the
same would have been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage, and it is so
ordained.
