iAN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDIN-
'; ANCE NUMBER 7809 RELATING TO THE KEEPING OF DOGS AND OTHER ANIMALS,
SAND ENACTING A NEW ORDINANCE RELATING TO THE SAME SUBJECT, AND
PROVIDING A PENALTY.

Sect-.ion 1. Definitions. As used in this ordinance, the I
ji
following terms shall mean:
I (a) Owner: Any person, group of persons, firm or cor-
poration owning,, keeping or harboring a dog
or dogs .
(b) Dog: Any member of canine family over six months
` of age.

Ifs (d) Exposed to Rabies: Any dog, whether licensed and
4 vaccinated for rabies or not, which has been
bitten by, been fighting with or has
consorted with an animal known to have rabies.
(e) Impound: To apprehend, catch, trap or net a dog an

II (f) Euthanize: To put to death in a humane way.
1j (g) Registration -� Vaccination; The procedure of
i vaccinating for rabies and issuing an
appropriate certificate. The words shall
!� be interchangeable.
Ii (h) Tag: Any object, regardless of shape or size, '
f which bears a registration number and the ,
words "registered and vaccinated for rabies"{,
which has been issued by any licensed �"
veterinarian in the City of Jefferson.
j (i) At Large: Any dog shall be at large when it is off
of the premises of its owner and not under
the reasonable control of the owner, or any
member of his immediate family, or his agent .
(j) Reasonable Control: Any dog shall be under reason-
able control when the dog is on the premises!
of its owner or, when the dog is not on its
owner's premises, when the dog is with and
obedient to its owner, his or her agent, or
some member of the owner's family.
1 (k) Not Under Reasonable Control: A dog shall be deemed
f to be "not under reasonable control" when
not upon the premises of its owner and not
i within the immediate custody of, and
I obedient to, its owner, the owner's agent,
or some member of the owner's family, or,
when the dog damages the person or property
of anyone other than the owner, except when
the dog is in defense of its owner, the
owner's family or property.

I, Section 10. Licensing Procedure. The owner of a dog shall
;!present to the City Collector a certificate from a licensed veter-
Jnarian in the City of Jefferson, Missouri, showing that said dog
! has been immunized from rabies within forty-five (45) days prior to

the date on which application for the license is made.
I� Upon payment of the sum of one ($1.00) dollar. , the City
,!Collector shall immediately enter in the City Dog Register the date
l
I;of payment, the number of entry, by whom paid, the breed, sex,
jlcolor, age and size of said dog, and then furnish to the applicant a
I,, I+metallic plate on which shall be plainly marked, cast or engraved
i1 thereof words and figures indicating the year for which the tax hasi
lfbeen paid, and a number corresponding with the number of entry in
Ilsaid City Dog Register. , and further that the owners name and
''address be placed upon the collar. .

i Section 11. Display of Identification. Each dog shall have
I�
,!securely attached, by means of a secure collar or harness, a
±jlicense, a rabies vaccination tag and an identification tag, stat-
�I
�ing the name, address and telephone number of the owner.
Section 1.2. Humane Officer - Registry Entries. The City
;!Collector shall make out and deliver to the Humane Officer, on the
i?
1115th day of July annually, a copy of all entries made and entered
II
lin said Dog Register, and each week thereafter the subsequent
i
jlentries as may be entered into said Dog Register.
(i Section 13. Canines reaching age of six months and dogs

'brought into City. Any canine attaining the age of six (6) months,
for any dog brought into the City between July 15th and June 1st of
! the following year, shalt be subject to the regulations and provi-
ilsions of this ordinance upon the happening of either such event.
Section 14. Dogs prohibited from Running at Large. It shall
be unlawful for the owner o; any dog to let such dog run at large,
!'whether licensed or not, at any time within the City of Jefferson, ,
IMissouri. In any prosecution for a violation of this provision of
I
; this ordinance, proof that the dog described in the complaint was
owned by the person named as defendant in the complaint shall con-
Istitute a prima .facie presumption that the owner of the dog let i
J�such dog run at large during the time when, and at the place where,
; such violation occurred.

Section 15. Female dogs to be confined when. It shall be
,lunlawful for the owner, or any person in control or custody, of any
!ifemale dog, to fail to keep said dog confined on the premises of
!the owner, or the person in control or custody, during the dog's
period of salacity.
Section 16. Vicious Dogs to be muzzled. It shall be unlawful

iffor any person to keep or harbor within this city any dangerous or
(vicious dog, or suffer or permi.;: such dangerous or vicious dog to
be or run at large upon any public street, sidewalk or thoroughfare
for on the premises occupied by the owner or keeper of said dog, or
on the premises of any other person, within this city, unless such
j� !dog is properly and securely muzzled.
iSection 17. Barking or Howling Dogs. It shall be unlawful
for any person to keep or harbor within this city, any dog, which
by loud, frequent or habitual barking, howling or yelping, shall
annoy or disturb any neighborhood or persons.
Section 18. Dogs putting Persons in Fear. It shall be unlaw

ful for any person to keep or harbor within this city, any dog

which by habitually jumping upon or threatening persons upon any
public street, sidewalk, or thoroughfare within this city, shall
(cause such person or persons to be put in fear of injury.

Section 19. Dogs on School Premises. It shall be unlawful
i
1`for the owner or keeper of any dog to fail to keep said dog from
(linterfering with the normal and usual activities of the teachers
i
and students in any public, parochial or private school within this
city.
Section 20. Impoundment of Dogs. All dogs found in this city,
in violation of any provision of this ordinance, shall be impounded
by the Humane Officer in some suitable place provided by him or the
•City Council.
Section 21. Notice of Impoundment. The Humane Officer shall
exert all effort to identify any dog impounded and to notify the
)owner thereof of such impoundment and the reason therefor.

Section 22. Redemption of Impounded Dog. The owner of any
;;impounded dog, or any other person, with the authority of the owner,!,
' I
I;may redeem said dog within a period of seventy-two (72) hours afterl
jJmpoundment by paying to the Humane Officer the sum of five ($5.00)
;dollars for each twenty-four (24) hour period, or fractional por-
I
; tion thereof, for the expense of keeping, feeding and sheltering
said dog during the term of impoundment.
Any impounded dog which does not have proof of rabies
(vaccination, shall be released only upon the payment of a twenty-

five ($25.00) dollar bond. Said bond shall be returned upon proof
iof vaccination being furnished to the Humane Officer.
Section 23. Failure to Redeem. Any dog that is impounded and

±not redeemed within seventy-two (72) hours after notice thereof is
`given to the owner, or, in the event the owner of the dog cannot be
I'determined, any dog that is not redeemed within seventy-two (72)

hours after impoundment, aha4A be euthanized by the Humane Officer,
or given to any person who asks for said dog, upon payment of the
accrued fees above provided for and execution of an affidavit that

�, this ordinance within forty-eight (48) hours.
Section 24. Animal Bite Procedure. The owner of any dog or
l! cat which bites any person, regardless of the circumstances or
i
whether the animal is vaccinated or not, shall be required to place!
the animal in a veterinary hospital maintained by a licensed veter-}
inarian for a period of fourteen (14) days following the evening of
the day of the bite, ' for clinical observation. All expenses shall.
be borne by the owner of the animal. If such animal develops
Isymptoms of rabies, it shall be allowed to die a natural death, or,
if the animal shall die while within confinement for any reason,
the head of such animal shall be removed by the veterinarian and
submitted to any qualified official laboratory. If at the end of
( said fourteen (14) day period the animal is alive and healthy, it
may be released to its owner, if said dog fulfills all other condi-

r � tions of this ordinance prior to said release, but said animal
fshall not be permitted to run at large thereafter.

Section 25. Suspected Rabid Animal. Any dog, cat or pet
rodent which exhibits clinical symptoms of rabies, may, after
notice is given to the owner, be impounded by the Humane Officer
on or off the property of the owner. The animal may be held for
fourteen (14) days at the city's impounding facilities for clinics
observation and, if alive and free from rabies at the expiration of
that period, shall be returned to the owner at no expense.
As an alternative procedure the owner may designate any
veterinary hospital in the City as a place of detention for said
n: fourteen (14) day period. All expense, under this procedure, shat

be borne by the owner.
Section- 26. Exposed to Rabies. Any dog, cat or pet rodent,
which has been exposed to rabies, should be immediately destroyed
unless otherwise provided. If the owner is unwilling to have said
dog destroyed by the Humane Officer, one of the following alterna-
tives must be followed:
(a) Strict isolation in an animal hospital for six (6)
months.
(b) If no previous vaccination has been given within a
period of three (3) years with LER (flury strain)
vaccine, or within one (1) year using vaccine of
nervous tissue origin, administer post-exposure
treatment and confine in a kennel for three (3)
months . Post exposure treatment may consist of
administration of anti-rabies serum (0.5 ml./ Kg.
b.w.) , followed by one (1) to three (3) doses
chicken embr o vaccine within seven (7) days, or
fourteen (lU injections of nervous tissue vaccine.
(c) If the animal has been vaccinated previously within
one (1) year with nerve tissue or kelev strain
vaccine, or within three (3) years with flury strain
vaccine, it is recommended, that the animal be
revaccinated and restrained by a. leash or confined
at home for thirty (30) days.
Section 27. Quarantine. Whenever the Mayor shall deem it
necessary, because of the prevalence of rabies among the animal
population of the City, County or State, strict quarantine may be
placed on all dogs in the City. Upon such proclamation by the
Mayor, all dogs shall be confined in the owner's home, tied up or
placed on a leash and under the direct physical control of a compe-
tent person at least fifteen (15) years of age. Any dog Found
otherwise shall be impounded, or if impossible to capture shall be
shot and killed by any policeman of the city.

Section 28. Right of Entry. The Humane Officer, and his
designee, shall have the right of entry to any property or premises
within the City, for the purpose of determining if the provisions
of this ordinance are being complied with, and for the further
purpose of examining and impounding any dog exposed to or exhibit-
ing clinical symptoms of rabies .
Section 29. Poisoning Animals Prohibited. No person, or
persons, shall feed or place so as to constitute a direct or
obvious hazard to man or animal, or shall offer or tempt any dog or
pet animal with any liquid, or meat, of any food product which
sha° ' (a) cause prostration, convulsion, pain or suffering as a
prelude to death, (b) death, or (c) be proven to be toxic or lethal
in the amount present to any man or domestic animal by competent
medical or veterinary authority.
Section 30. Refusal to Deliver Dogs to Humane Officer. No
person shall refuse to deliver up to the Humane Officer his dog, or

dogs, when requested to do so under the provisions of this
ordinance.
Section 31. Notices of Dog Licenses . During the month of
Jur,_- of each year, the City Collector shall cause notice to be
given to the owners of dogs within this City that the annual dog
licenses must be secured between July lst and July 15th of the same
year.
Section 32. Collector. to Settle Accounts. The City Collector
shall settle for all monies received by him under the provisions o:_
this ordinance in the same manner and at the same time he accounts
for other monies received by him. '
Section 33. Humane Officer to Settle Accounts. Upon redemp-
tion of any dog by the owner, the Humane Officer shall execute a
receipt in triplicate showing the amount of the money received by
' him for feeding, sheltering and caring for said dog during the
period of impoundment. One copy thereof shall be given to the

owner, one copy shall be retained by the Humane Officer, and on
the last day of each month, the third copy shall be filed with the
ity Collector along with the monies so received, and the City
ollector shall issue a. receipt therefor.

Section 34. Any person, firm or corporation violating any of
the terms of this ordinance shall be deemed guilty of a misdemean-
or and shall be fined not more than one hundred ($100.00) dollars
or imprisoned not more than ninety (90) days, or by both such fine
and imprisonment.
Section 35. Repeal Clause. Ordinance Number 7809 of the
City of Jefferson, Missouri, be, and the same is hereby repealed.
Section 36. This ordinance shall be in force and effect from
and after its passage and approval.
