INTRODUCED BY COUNCILMAN e: �G i I ORDINANCE NO. 17 R II AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CLERK OF THE CITY TO EXECUTE IN BEHALF OF THE CITY AN AGREEMENT WITH THE CONSULTING ENGINEERING FIRM OF BURGWIN, MARTIN AND ASSOCIATES, P.A. , KANSAS CITY, MISSOURI, RELATING TO DESCRIBED PROFESSIONAL SERVICES TO BE FURNISHED BY BURGWIN, MARTIN AND ASSOCIATES, P.A. , TO THE CITY, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Mayor and Clerk of the City are hereby authorized and directed, in behalf of the City of Jefferson, Missouri, to execute an agreement with the Consulting Engineering firm of Burgwin, Martin and Associates, P.A. , Kansas City, Missouri, for an engineering service contract for traffic engineering services. SECTION 2. The agreement shall.. read in words and figures as follows: (SEE ATTACHED AGREEMENT) SECTION 3. Ordinance number 7925 and such other ordinances, or parts of ordinances as are in conflict with this ordinance are, and are hereby declared to be, repealed. SECTION 4. This ordinance shall take effect and be in force from and after its passage and approval. Passed: Approved: P e ident of th ounci y r r ' I i i� Attest: city C1 rk f y i l� I I AGREEMENT FOR TRAFFIC ENGINEERING SERVICES THIS AGREEMENT made and entered into this _ day of 191, by and between the City of Jefferson City, ri Missou , ereinafter called CITY,—and Burgwin, Martin and Associates, P. A. , Consulting Engineers, 3718 Broadway, Kansas City, Misnou.ri, hereinafter called the CONSULTANT. WHEREAS, the CITY is in need of, and desires to obtain, engineering assistance on a continuing basis to e.id in solving traffic problems; and ES WHEREAS, the CONSULTANT represents that they have sufficient ex- perienced and qualified personnel to perform the traffic engineering services herein described. NOW, THEREFORE, in consideration of the mutual undertakings here- in contained, the parties agree as follows: ARTICLE I - SERVICES Sec. 1. The CONSULTANT shall render. diligently and competently the engi- neering services involved in the preparation of engineering plans and reports as directed by the CITY. The scope of work will generally include traffic engineer- ing, highway planning, and transportation-planning projects. The CONSULTANT may, as directed by the CITY, represent the CITY at public hearings and other meetings. The CITY should provide forty-eight hour notice of such meetings. Sec. 2. The CITY agrees to provide the CONSULTANT access to pertinent data, records, and reports applicable to the services provided under this agreement. Sec. 3. All of the work will be performed by the CONSULTANT under the CITY's direction and in close cooperation with all municipal agencies. The CONSUL'T'ANT will be expected to report directly to the Director of Public Works. Sec. 4. The CONSULTANT shall furnish the CITY with copies of all reports and other information provided for in this agreement and all of the data and material collected as part of the services shall become the property of the CITY. ARTICLE II - GENERAL Sec. 1. The CONSULTANT shall comply with all Federal and State Laws and city ordinances applicable to the work to be performed under this agreement. - 1 - l Sec. 2. This agreement shall become effective as of the date thereof and shall remain in effect until either party desires to terminate same. Termination may be effected by either party giving thirty (30) days notice in writing to the other of its intention to terminate. Upon such termination, the CITY shall pay the CON- SULTANT for such services as may have been performed prior to such termina- tion. Sec. 3. The CONSULTANT shall immediately upon expiration or termination of the agreement return to the CITY all engineering shidies, neaps, and other data furnished to the CONSULTANT by the CITY pursuant to this agreement. Sec. 4. The obligations of the CONSULTANT under this agreement shall not be assigned without the approval in writing of the CITY. ARTICLE III - COMPENSATION Sec. 1. The CITY shall pay the CONSULTANT for the services performed pur- suant to this agreement in the amounts provided in the schedule of rates attached hereto, and by reference made a part of this agreement. The CONSULTANT shall submit a statement to the CITY at the end of each month of all compensation due hereunder. Unless otherwise specified, the CITY shall pay the CONSULTANT within ten (10) days after approval of such statement and after approval by the CITY of any required designs, drawings, and reports. SCHEDULE OF RATES .}Zi,rw The CITY shall pay the CONSULTANT for on-site inspection in the city and to attend meetings such as City Council and P.T.A. , etc. , a,t the daily rate not to exceed the schedule shown below: Payment for collection of field data, engineering analysis, and preparation of plans, will be based on the following schedule of rates: TITLE HOURLY RATE DAILY RATE Chief Traffic Engineer $ 18.55 $ 150.00 Traffic Engineer 14. 00 110. 00 Traffic Analysts 12. 50 Senior Draftsman 10.20 Junior Draftsman 7. 55 Secretarial 6.35 rield and Clerical personnel 6. 00 Travel expenses, reproductions, telephone calls and other supplies, will be charged at actual cost. Mileage will be charged at the rate of $0. 12 per mile. Equipment charge will be made for use of traffic recording equipment as follows: Recording Traffic Counter $ 5. 00 per 24-hour period Junior Traffic Counter 1. 00 per 24-hour period Daily rate includes travel time and working time up to a maximum of ten (10) hours: Additional time will be charged as fractional days.
