ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CLERK OF THE CITY TO EXECUTE A LEASE WITH THE D & E
REALTY & INVESTMENT COMPANY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and Clerk of the City are hereby
authorized, for and on behalf of the City of Jefferson, Missouri,
to execute a written Lease with the D & E Realty & Investment
Company.
Section 2. Said Lease shall read in words and figures
as follows:

Section 3. This ordinance shall take effect and be in
force from and after its passage and approval.

LE ASE
This Lease entered into on the _�:id, day of November,
1969, by and between D & E Realty and investment Co. , a corpor-
ation, Lessor, and the City of Jefferson, Lessee.
WITNESSETH:
That the Lessor hereby leases to the Lessee and the
Lessee takes as Lessee the premises, consisting of approxi-
mately one thousand two hundred sixty (1, 260) square feet of
office space Located on the third (3rd) floor of the building
owned by the Lessor, which is located at 238 East High Street,
Jefferson City, Cole County, Missouri. Said Lease is for a
term of twelve (12) months beginning on the day of
November, 1969, and terminating on the '' day of November,
1970, upon the following terms and conditions:
1. The rental therefor shall be Three Hundred Ten
Dollars (5310.00) per month payable in advance on or before
the /D±L day of November, 1969, and on or before the first
day of each and every succeeding month during the term of this
Lease.
2. The Lessor covenants and agrees as follows:
A. That the Lessor will put the Lessee in posses-
sion of said premises, and the Lessee paying the rent
and observing and performing the several covenants and
stipulations herein provided to be performed on his
part, shall peaceably hold and enjoy the demised prem-
ises during the term hereof without any interruption
by the Lessor or any person rightfully claiming under
him.
B. That the Lessor will maintain and make ordi-
nary repairs to the property caused by fire, hail,
windstorm or other natural causes.
C. That the Lessor will maintain and make ordi-
nary necessary repairs to any common areas of the
building held with any other tenants.
D. That the Lessor will maintain insurance on
the premises, to insure against fire, hail, windstorm,
or ether natural causes and to insure against all
types of liability.
E. That the Lessor will furnish all utilities
to the Lessee including, but not limited to, electric-
ity, heat, water and sewers. The Lessee will furnish
its own janitor service and maintain its own telephone
service.
3. The Lessee covenants and agrees as follows:
A. To pay the rent at the time and the manner
herein provided to Lessor or its order in such places
as may be designated in writing by the Lessor.
B. To use the property for office space for the
purposes of the City of Jefferson and for no other
purpose.
C. Not -to assign this Lease or sublet said prem-
ises or any part thereof or to allow any other tenant
to come in with or under him, without first obtaining
the written consent of the Lessor.
D. Not to alter or remodel said premises in any
way without first obtaining the written consent of the
Lessor. The Lessee agrees that unless otherwise
agreed in writing between the Lessor and the Lessee
that the Lessee shall restore the premises to their
former condition prior to the -time .of surrendering them
to the Lessor, ordinary wear excepted.
E. To take good care of and fairly treat the
building and premises and to keep the premises free
from filth and danger of fire or any nuisance.
F. To permit the Lessor, or its authorized
agent, to enter said premises at any time for the
purpose of inspection or making repairs, and at rea-
sonable times during the last ninety (90) days of the

term of said Lease to show prospective lessees the

premises.
G. If any default shall be made in the payment
of rent or any part thereof at the time provided, or
if after ten (10) days written notice setting forth
the default, default shall continue by the Lessee in
the performance or observance of any other covenants
herein contained to be performed by the Lessee, the
Lessee will, upon written demand, quit and surrender
to the Lessor, or its agent, peaceful possession thereof,
but that for this cause the obligation to pay rent for

the full term as herein provided shall not cease. The
Lessor, may relet the premises for the benefit of the
Lessee, or at their election, may terminate this Lease
upon giving written notice thereof.
H. At the termination of this Lease, whether at
the expiration of the term or upon forfeiture, the
Lessee agrees to surrender peaceful possession of
said premises in as good condition as the same was
received, usual wear and tear and providential
destruction excepted.
4. at is mutually agreed as follows:
A. That this Lease shall automatically be renewed
from year to year for five (5) additional years after
the regular term, on the same terms and conditions
unless the Lessee shall give to the Lessor ninety (90)
days notice prior to the anniversary date of any term
of its intention to quit the premises.
B. That in the event said premises are destroyed
with or without fault of the Lessee, this Lease shall
terminate and any prepaid rent shall be refunded to the
Lessee,
C. That if the premises are damaged with or with-
out fault of the Lessee so as to render them untenantable,

and the same cannot be restored to a condition sub-

stantially as good as prior to the damage within
thirty (30) days, either party may terminate this Lease
by giving the other party written notice thereof within
ten (10) days after the occurrence of the damage, and
prepaid rent shall be refunded as of the date of the
damage.
D. That any notice provided for herein may be
given to the party to be served by personal service, or
by registered mail addressed to the party.
E. That this agreement shall be binding upon the
parties, or their assign"s, subject always to the
restriction herein contained as to the subletting or
a6signment 'by. the Lessee.
IN WITNESS WHEREOF, the parties have hereunto
affixed their signatures in duplicate the day and year first
above written.
