ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND THE CLERK TO EXECUTE A WRITTEN CONTRACT WITH HEMMEL AND
EGGERS, PAINTING AND DECORATING CONTRACTORS, FOR CERTAIN PAINTING
AT THE EAST END FIRE STATION AND AT THE WEST END FIRE STATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and the Clerk of the ,City are hereby
authorized to execute a written contract with Hemmel and Eggers,
Painting and Decorating Contractors, of Jefferson City, Missouri,
for certain painting a t the East End Fire Station and at the West
End Fire Station.
Section 2. Said Contract shall read in words and figures
as follows:

Section 3. This ordinance shall take effect and be in full
force from and after its passage and approval.

C O N T R A C T
THIS CONTRACT made and entered into this ei

day of Ne*essaor, 1969, by and between John G. Christy,
President of the City Council of the City of Jefferson,
Missouri, a Municipal Corporation of the third class, of the
State of Missouri, Party of the First Part, and who acts for
and on behalf of the City of Jefferson; .and Bill Hemmel and
, 1 Henry Eggers, doing business as Hemmel and Eggers, Painting
and Decorating Contractors, Party of the Second Part,
WITNESSETH:
That WHEREAS, the City Council of the City of
Jefferson, Missouri, did, on the 20th day of October,
1969, award to the Party of the Second Part the Contract for
the painting and decorating of the East End Fire Station,
located at 915 East Miller Street, and the West End Fire
Station, located at 500 Harrison Street, the property of the
City of Jefferson.
NOW THEREFORE, for and in consideration of the award-
ing of this Contract and the work thereunder by said First
.Party hereto, to the Party of the Second Part, does hereby
contract and agree to paint, scrape and caulk the exteriors
of each Fire Station. Said work shall include all windows and
fire escapes and all exterior wood and metal trim. Work shall
include two (2) coats of first quality house paint on wood
and metal items, and shall include two (2) coats of latex
masonry paint to the concrete block areas of the building.
All paint shall be first quality and shall be approved by the
Fire Chief prior to installation.
Contractor shall sand and caulk the areas prior to
application of paint; said areas shall be free and clean of
dirt and dust; all missing putty shall be installed and
caulking shall be applied where necessary.

Contractor shall complete the work within
days after the execution of this
Contract. Upon the completion of the work, and upon
certification by the Fire Chief that the work has been
completed in an acceptable manner, the Party of the First

. ! Part shall pay to the Party of the Second Part, one
thousand; three hundred and seven ($1,307.00) dollars,
;. , which shall be the total cost and consideration.
It is agreed and understood by the parties hereto
that this Contract is entered into subject to all existing
ordinances pertaining to the work awarded. That all
questions as to the proper performance of the work covered
under this Contract shall be decided by the Fire Chief of
the City of Jefferson, who has the duty to supervise and
superintend said work.
Party-of the First Part reserves the right, at any
time, to suspend, re-let or order an entire reconstruction
of the work, for failure of the Contractor to perform the
work in the time agreed upon in this Contract. Such re-letting
or reconstruction of this work shall not affect the right of
the City to recover all damages and penalties accruing or due
it by reason of the contractor's non-compliance with this
Contract. 'Liquidated damages of $ 0, 06 per day
will be assessed against the contractor for each day the
work remains incomplete following the completion date or any
extension thereof.
Party of the Second Part agrees to pay all classes
i ' . .. and crafts of labor used in the performance of this contract
the prevailing hourly -rate of wages, as determined by the
Department of Labor and Industrial Relations, and Second Party
acknowledges that he knows the prevailing hourly rate of
wages of all of the classes and crafts of labor to be used
in the performance *of this Contract.

Party of the Second Part agrees that he will keep an
accurate record of all workmen employed by them in connection
with work performed under this Contract, which record shall
show the actual wages paid to each of said workmen in
connection with the work to be performed under the terms of '
this Contract, and agrees further that the aforementioned
accurate record shall be open for inspection by any authorized
employee of the City of Jefferson.
Party of the Second Part agrees to maintain Workmen's
`. ' Compensation Insurance for all of its employees employed on
said project and to furnish at any time to Party. of the First
Part proof that insurance has been obtained. It is further
agreed that Party of the Second Part shall maintain sufficient
insurance and shall indemnify and hold harmless Party of the
First Part for all damages, injuries, actions, costs, attorneys '
fees and all other expenses whatsoever arising out of the
performance of said work whether the property or persons
damaged are the servants and employees of the Second Party,
or third parties, in no manner connected with said work. Party
of the Second Part shall furnish Party of the-First Part with
certificates showing insurance is in force to meet the
aforementioned agreement.
