HomeMy Public PortalAboutORD08232 BILL N0. 80 (AS AMENDED) r INTRODUCED BY COUNCILMAN Borgmeyer ORDINANCE NO. 8232 AN ORDINANCE OF THE CITY OF JEFFERSON REQUIRING THE CONSTRUCTION OF SIDEWALKS FOR ALL NEW CONSTRUCTION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : Section 1. All new construction of residences, duplexes, apartment houses, commercial buildings of every kind and description, and any other structures , shall include plans and there shall be constructed a sidewalk along that portion of the land abutting any city street. Section 2. No certificate of occupancy shall be issued to any owner or contractor until said sidewalk is constructed and approved by the Building Department. Section 3 . All sidewalks shall be constructed of portland cement concrete and shall have a brush or broom finish. The sidewalk shall be minimum of four (4) feet wide and a minimum o four (4) inches thick. Section 4. So far as practical, the sidewalk shall be constructed parallel to the street, on public right of way, a minimum of two (2) feet from the curb line, and the maximum distance from the curb shall be the property owner's property line nearest the street. The sidewalk shall connect to existing sidewalks on adjacent properties. Section 5. The City Planning Department may authorize a deviation from the requirements as listed in Section 4, where terrain features may warrant such deviation. Section C . The requirements established within this ordinance shall not apply in the following cases : A. Where development has occurred, as of the effective date of this ordinance, on fifty (50%) percent or more of the frontage on one side of a street between two intersecting streets, sidewalks shall not be re- quired along the remaining frontage on that side of the street. However, sidewalks shall be required even though a block is currently more than fifty (50%) percent developed if any continuous undeveloped front- age in this block totals 300 feet or more as of the effective date of this ordinance. B. Where, by exceptional topographical conditions, the strict application of this ordinance would result in an extreme hardship upon the owner of said property. Section 7 . This ordinance shall apply and be in full ,- force and effect for all new construction for which a building permit has not been issued prior to the date this ordinance is passed and approved.
