HomeMy Public PortalAboutORD08264 t a BILL NO. : INTRODUCED BY COUNCILMAN Wildhaber ORDINANCE NO. _�, ,_ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE AN OPTION FOR LEASE OF REAL ESTATE BETWEEN THE CITY OF JEFFERSON AND THE STATE OF MISSOURI, ACTING BY AND THROUGH THE ADJUTANT GENERAL AND THE PURCHASING AGENT THEREOF, RELATING TO CERTAIN REAL ESTATE. ON THE JEFFERSON CITY MEMORIAL AIRPORT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City, to execute an option agreement for lease of real estate with the State of Missouri, acting by and through the Adjutant General and the Purchasing Agent thereof, relating to an option to lease certain real estate on the Jefferson City Memorial Airport awned by the City of Jefferson. Section 2. Said option for lease of real estate shall read in words and figures as follows: (SEE ATTACHED; Section 3. OPTION FOR LEASE OF REAL ESTATE / This agreement is made pursuant to Ordinance No. 8264 adapted by the City Council of Jefferson City on May 18, 1970, and approved by the Mayor of the City on May 199 1970, and entered into this ist day of June , 1970, by and between the City of Jefferson City, a municipal corporation organized under the laws of Missouri, hereinafter referred to as the Owner, and the State of Missouri, acting by and through the Adjutant General and the Purchasing Agent- thereof, hereinafter referred to as the State . In consideration of one dollar ($1 .00) , paid by the State to the Owner, the receipt of which is acknowledged, the Owner does hereby grant to the State for a term of five (5) years from the date hereof an option to lease the property described herein for a lease period of thirty (30) years, with such renewal rights as the parties may at that time agree upon. The property subject to this option is a portion of the Jefferson City Memorial Airport located in United States Survey 2638, Township 44 North, Range 11 West, Callaway County, Missouri, said portion particularly described as follows : Aft Beginning at the Northeast corner of present airport boundary thence West along the North airport property line approximately 1840 feet to the begin- ning of the description of subject property. Thence West approximately 760 feet, thence South approximately 170 feet, thence Southeast along a line that is 650 feet from the center- line of the present 12-30 runway for a distance of approximately 900 feet, thence North approximately 650 feet to the point of beginning. The lease to be executed by the Owner to the State under this option shall be in such form as is customarily used in such rases in the State of Missouri and shall include provisions for: (1) The amount of rental, and .its method of payment; i i j.. (2) The ownership of any improvement that �;. may be properly erected upon the leased premises during the lease; (3) The assignability of either party' s interest in the tease ; (4) The rights of cancellation of the parties . The State may elect to exercise its option hereunder at any time during the five (5) year term hereof by giving written notice of such election to the Owner, and the Owner shall thereupon, within thirty (30) days, execute and deliver to the State a lease consistent with • this agreement.
