HomeMy Public PortalAboutORD08304 Q�µ AIN'" 40 BILL NO, (e l 5 INTRODUCED BY COUNCILMAN ORDINANCE NO. o /1r 1 1 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR AND THE CLERK OF THE CITY TO EXECUTE A WRITTEN CONTRACT WITH THE MISSOURI STATE HIGHWAY COMMISSION RELATING TO ACQUIRING RIGHT-OF-WAY BY THE CITY FOR A NEW AIRPORT ACCESS ROAD TO MEMORIAL AIRPORT TO BE CONSTRUCTED BY THE STATE HIGHWAY COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: t Section 1 . The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City, to execute a written contract with the Missouri State Highway Commission, relating to acquiring right-of-way for a new Airport access road to Memorial Airport to be constructed by the State Highway Commission. Section 2. Said contract shall read in words and figures as follows: (SEE ATTACHED) Section 3. This ordinance shall take effect and be in force l from and after its passage and approval. " Commission, having programmed an interchange involv- ing Routes 54 and 94 in Callaway County, Missouri, including a possible relocation of Route 63, all of which will necessitate some alteration in access to the Jefferson City Municipal Air- port, and City, desiring to relocate its public access to said airport, it is agreed by the parties hereto as follows. Commission will : 1. Construct a. roadway from the vicinity of the grade in- tersection of present Routes 63 and 54 in Cedar City easterly to the parking area being maintained by City in connection with the Municipal Airport Administration Building. Said construction will be of high type pavement with- a minimum width of paved road- way of 24 feet and abutters ' rights of access will be controlled. A-11 of such construction shall be at the cost of Commission. 2. Procure the necessary right-of-way on that portion- of said proposed construction, which is to be paid for by City, as hereinafter set out upon written request by City. In the event procurement shall be effected by Commission, it will advise the - designated official- of--City --of the amount fixed by Commission as damages due property owners involved by reason of the taking in advance of acquisition. In the event, however, City shall request Commission to ;1 � ) 1 1 •''I• I l J 1 t effect said right-of-way acquisition, then City will pay the required considerations for such right-of-way. 2. After construction: of the proposed facility by Commis- sion, assume maintenance thereof on that portion of said route for which the right-of-way was procured by City and will maintain the same at its cost. 3. Maintain the said facility as a limited access highway so that its traffic utility will be retained to the same extent as upon completion of construction. City may, however, at the eastern end of such facility and on airport property, effect such changes or additions as it may consider necessary to better serve the airport facility. -It is agreed by the parties that Exhibit A attached hereto is a general plan location of the facility to be con- structed and that such construction will be effected at the time of construction of the Route 54-63 interchange shown thereon or prior thereto if Commission shall determine that it has available funds for such construction.
