HomeMy Public PortalAboutORD-CC-2007-08ORDINANCE #2007-08 AN ORDINANCE TO AMEND TITLE 17.24, THE C-3 COMMERCIAL ZONE, TO PERMIT GROUND FLOOR RESIDENTIAL DWELLINGS UNDER SPECIFIC CONDITIONS. WHEREAS, there is a need for additional affordable workforce housing in the City of Moab; and, WHEREAS, the City of Moab General Plan calls on the City to "provide or make available affordable housing for all Moab residents"; and WHEREAS, the City of Moab General Plan calls on the city to "encourage private/public partnerships for the development and management of affordable housing. Special consideration should be shown to non-profit sponsors of affordable housing and special use housing"; and WHEREAS, there exists an opportunity to assist the Housing Authority of Southeastern Utah in increasing the availability of affordable housing by expanding number of affordable ground floor dwelling units currently allowed as a non -compliant use within the C-3 Zone. NOW THEREFORE, the City Council hereby amends Title 17.24 of the Moab City Land Use Code, the C-3 Commercial Zone by adding the following: 17.24.020 (30). Ground floor dwellings shall be allowed in the C-3 Zone when all of the following conditions exist: a) The owner of the property is a legally constituted Housing Authority as recognized by the State of Utah, Grand County, or the City of Moab, or alternatively, the owner of the property is a legally recognized nonprofit land trust operating under a signed property management contract with a legally constituted Housing Authority as recognized by the State of Utah, Grand County, or Moab City; b) The dwellings are limited to affordable housing units, which shall be defined as housing occupied or reserved for occupancy by households with a gross household income equal to or less than 80% of the median gross income of Moab City or Grand County for households of the same size; c) Non -complying ground floor dwellings already exist on the property; and d) No existing commercial or retail activities shall be displaced. Ground floor dwellings permitted under the provisions of this chapter shall be exempt from the designated recreation area requirements of Section 17.09.670. Ordinance #2007-08 Page 1 of 2 The Moab Planning Commission shall have authority to waive or alter off-street parking requirements for projects allowed under the provisions of this section provided the developer can show that the waiver or alteration of off-street parking requirements will socially benefit the community through the enhancement of the quality and/or quantity of affordable dwelling units.
