ORDINANCE NO. i- � AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI , AUTHORIZING AND DIRECTING THE MAYOR AND CLERK OF THE CITY TO EXECUTE A WRITTEN AGREEMENT WITH THE JOHNSON, BRICKELL, MULCAHY AND ASSOCIATES TRAFFIC ENGINEERING FIRM ON THE TOPICS PROGRAM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS : SECTION 1. The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City, to execute a written agreement with the Johnson, Brickell, Mulcahy and Associates Traffic Engineering Firm on the TOPICS Program. Section 2 . Said agreement shall read in words and figures ;,. as follows: ' (SEE ATTACHED) Section 3 . This ordinance shall take effect and be in force from and after its passage and approval. Passed: — Approved : P ent of e C cil rbr Attest : City C rk z; i". �y1 ENGINEERING SERVICE AGREEMENT AGREEMENT made as of�� s ____, 1971 between the City of Jefferson City, Missouri ( hereinafte called the "Owner" ) and Johnson, Brickell, Mulcahy and Associates, Inc. , Transportation Consultants, 6225 Brookside Boulevard, Kansas City, Missouri ( hereinafter called the "Consul- tant" ). WHEREAS, the Owner is in need of traffic engineering assistance to establish a city-wide program to .meet the requirements of Standard 4.4. 13 "Traffic Control Devices" of the National Highway Safety Program Standards pursuant to the provisions of Section 402 of Title I of the Highway Safety Act of 1966; and WHEREAS, the Consultant represents that he has sufficient experienced and qualified personnel.to perform, and the Owner desires the Consultant to perform the traffic engineering services herein described. NOW, THEREFORE, in consideration of the mutual undertaking herein contained, the parties agree as follows: ARTICLE I GENERAL The Consultant shall render diligently and competently the engineering services described in the "SCHEDULE", attached hereto and by this reference made a part of this Agreement, upon the terms and conditions herein stated. The Owner agrees to diligently and competGntly perform such services which have been assigned to the Owner in the "SCHEDULE" , and to provide name services as dirocted by the Consultant' ARTICLE II COMPENSATION The Owner shall pay the Consultant for the services performed pursuant to this Agreement. Payments will be made monthly based on the per cent of the program completed as detailed in a progress report submitted to the Owner at the end of each month. Unless otherwise specified, the Owner shall pay the Consultant within ten ( 10 ) days after approval of such statement and after ap- proval by the Owner of any required reports. 1 The Owner shall pay the Consultant, as complete compensation for his services as set forth in the "SCHEDULE", the amount of twenty thousand three hundred ( $20,300.00 ) dollars . ARTICLE III MISCELLANEOUS Section 1: LAWS The Consultant shall comply with all. applicable statutes pertaining to engineering and shall comply with-all Federal, State, and local laws and ordinances applicable to the prosecution of the work covered by this Agreement. Section 2: TERM This Agreement shall become effective on the date thereof and shall remain in effect for a period not to exceed one ( 1 ) year or if either party desires to terminate same before that date. Termination may be effected by either party giving thirty ( 30 ) days notice in writing to the other of its inten- tion to terminate. Upon such termination, the Owner shall pay the Consultant for such services as may have been performed prior .to such termination. If, through any cause, the Consultant shall fail to fulfill in timely and proper manner his obligations under this Agreement, or if the Consultant shall violate any of the covenants or stipulations of this Agreement, the Owner shall have the right to terminate this Agreement by diving written notice to the Consultant of such termination and specifying the effective date of such termination. In such event, all finished material prepared by the Consultant shall, at the option of the Owner, become its property and the Consultant shall be entitled to receive just and equitable compensation for any satisfactory work completed or. this project. The one ( 1 ) year termination date of this Agreement may be extended by sup- elemental contract to this Agreement. Section 3: RETURN OF DATA The Consultant shall immediately upon expi- ration or termination of the Agreement return to the Owner all of the engineering studies, maps, and other data furnished to the Consultant by the Owner pursuant to this Agreement. Section 4: INSURANCE The Consultant shall take out and maintain work- men's compensation insurance covering all employees of the Consultant who shall perform any of the obligations of the Consultant hereunder, whether or not such insurance is required by the laws of the state governing the employment of any such employee. If any employee is not subject to the workmen's compensa- tion laws of such state, such insurance shall extend to such employee voluntary coverage to the same extent as though such employee were subject to such laws. The policy of insurance shall be in such form and issued by such insurer as shall be satisfactory to the Owner. 2 OR The Consultant shall assume all risks in connection with the performance of this Agreement and shall be liable for and save the Owner harmless on account of any damages to persons or property in connection with the prosecution of the work covered by this Agreement. Section 5: QUALIFIED PERSONNEL The obligations and duties to be per- formed by the Consultant under this Agreement shall be performed by persons qualified to perform such duties efficiently. The Consultant, if the Owner shall so direct, shall replace any engineer or other person employed by the Consultant in connection with the work. Section 6: ASSIGNMENT The obligations of the Consultant under this Agreement shall not be assigned without the approval in writing of the Owner. It is further agreed that this Agreement and all contracts entered into under the provisions of this Agreement shall be binding upon the parties hereto and their successors and assigns. Section 7: SOLICITATION The Consultant warrants that he has not em- ployed or retained any company or persons, other than a bona fide employee working solely for the Consultant, to solicit or secure this Agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty the Owner shall have the right to annul this Agreement without liability. Section 8: CHANGES In the event major changes in the work should be- come necessary or desirable during the progress of the contemplated work, such changes shall be made only after consultations by all parties to this Agreement. At the time of such changes in the work, equitable adjustments in the compen- sation for the work will be made by the parties to this Agreement. Section 8: CONTROL All work by the Consultant is to be done in a manner satisfactory to the Owner and in accordance with the established customs, prac- tices, and procedures of the Owner. Section 10: EMPLOYMENT OF CITY WORKERS The-.Consultant shall not en- gage, on a full, part-time or other basis during the period of this Agreement, any professional or technical personnel who are or have been at any time during the period of this Agreement in the employ of the City of Jefferson City, Missouri except regularly retired employees, without the written consent of the public em- ployer of such persons. 3 iM Section 11: SUBLETTING, ASSIGNMENT, OR TRANSFER Subletting, assign- ment, or transfer of all or part of the interest of either party of this Agreement is prohibited. Section 12: ARBITRATION Any dispute concerning a question of fact or inter- pretation in connection with the work not disposed of by agreement between the Consultant and the Owner shall be referred to the Mayor of Jefferson City, Mis- souri or his duly authorized representative, whose decision shall be final. Section 13: WORKING PROCEDURE T he Consult ant will assign to the project adequate staff to carry out the work described and to insure complete continuity and thorough administrative controls in all phases of the work. Section 14: CIVIL RIGHTS During the performance of this Agreement, the Consultant, for itself, its assignees and successors in.-interest ( hereinafter referred to as the "Consultant" ) , agrees as follows: 1) Compliance with Regulations: The Consultant will comply with the Regulations of the Department of Transportation-relative to non-dis- crimination in Federally-assisted programs of the Department of Trans- portation. ( Title 15, Code of Federal Regulations, Part 8, hereinafter referred to as the "Regulations" ) , which are herein incorporated by reference and made a part of this Agreement. 2) Nondiscrimination: The Consultant, with regard to the work per- formed by it after award and prior to completion of the Agreement work, will not discriminate on the ground (>f.race, color, or national origin in the selection and retention of subcontractors, including procurements of materials and leases of equipment. The Consultant will not participate either directly or indirectly in the discrimination prohibited by Section 8.4 of the Regulations, including employment practices when the Agreement covers a program set forth in Appendix A-II of the Regulations. 3) Solicitation for Subcontracts, Including Procurements of Materials and Equipment: In all solicitations, either by competitive bidding or negotiation made by the Consultant for work to be performed under a subcontract, including procurements of materials or equipment, each potential subcontractor or supplier shall be notified by the Consultant of the Consultant's obligations under this Agreement and the Regula- tions relative to nondiscrimination on the ground of race, color, or national origin. 4 4) Information and Reports: The Consultant will provide all information and reports required by the Regulations, or orders and instructions issued pursuant thereto, and will permit access to its books, records, accounts , other sources of information, and its facilities as may be determined by the Owner or the Department of Transportation to be per- tinent to ascertain compliance with such Regulations, orders, and in-, structions. Where any information required of the Consultant is in the exclusive possession of another who fails or refuses to furnish this information, the Consultant shall so certify to the Owner, or the De- partment of Transportation as appropriate, and shall set forth what efforts it has made to obtain the information. 5) Sanctions for Noncompliance: In the event of the Consultant's non- compliance with the nondiscrimination provisions of this Agreement, the Owner shall impose such Agreement sanctions as it or the Depart- ment of Transportation may determine to be appropriate, including, but not limited to a) withholding of payments to the Consultant under the Agree- ment until the Consultant complies, and/or b) cancellation, termination, or suspension of the Agreement, in-whole or in part. 6) Incorporation of -Provisions: The Consultant will include the provi- sions of paragraphs 1) through 6) in every subr•,ontract, including pro- curements of materials and leases of equipment, unless exempt by the Regulations, order, or instructions issued pursuant thereto. The Con- sultant will take such action with .respect to-any subcontract or pro- curement as the Owner or the Department of Transportation may direct as a means of enforcing such Provisions including sanctions for non- compliance; provided, however, that, in the event a Consultant be- comes involved in, or is threatened with, litigation with a subcon- tractor or supplier as a result of such direction, the Consultant may request the Owner to enter into such litigation to protect the interests of the Owner, and in addition, the Consultant may request the United States to enter into such litigation to protect the interests of the United States. Section 15: AUDITING The Consultant shall maintain an efficient and accu- rate cost-keeping system as to all costs incurred in connection with the subject of this Agreement and shall produce for examination books of account, bills, invoices and other vouchers, or certified copies thereof if originals be lost, at such reasonable time and places as may be designated by the Owner, or by the Department of Transportation, and shall permit extracts and copies thereof to be made. Transportation Consultants Party of the Second Part ( Consultant ) By: Predident ecretary Amok .I i1 'y. 6 SCHEDULE The City of Jefferson City, Missouri desires to undertake a city-wide program to meet the requirements of Standard 4.4. 13 "Traffic Control Devices" of the National Highway Safety Program Standards pursuant to the provisions of Sec- tion 402 of Title t of the Highway Safety Act of 1966 . The purpose of the study program is to assure the full and proper application of modern traffic engineering practice and uniform standards for traffic control de- vices in reducing the likelihood and severity of traffic accidents. The immediate benefits to the City of Jefferson City, Missouri will be the deter- mination of existing locations of traffic control deficiencies both as to applica- tion and conformity to national standards; the correlation of accident patterns and experience with existing traffic control measures; the development of pro- grams for maintaining, upgrading, and installing txaffic control devices; the establishment of uniform speed limits based on engineering study and analysis; and the development of an implementation program to improve the safety potential of the existing major street network through the proper application and improve- ment of traffic control devices. SURVEY AREA The survey area will include the major arterial and collector street system within the corporate limits of Jefferson City, Missouri. Specific attention will be given to those intersections presently controlled by traffic control devices and to those other elements of the roadway system which directly affect and contribute to the safe and efficient movement of persons and goods within and through the commu- nity. In the Central Business District, studies will be conducted to determine improvement needs in the circulation pattern, signal system operations, and park- ing control. SCOPE OF STUDIES The City of Jefferson City, Missouri is concerned with its program of traffic safe- ty and the need for factual data to correct existing traffic safety deficiencies; to effectively plan traffic safety improvement programs; and. to develop current and future programs for maintaining, upgrading, and installing traffic control devices. The objective of this safety program is the development of a comprehensive city- wide plan for traffic safety improvements including a program for implementation of control device improvements that bear directly on reducing accidents. The following studies will be completed for the survey area as part of this study progra m. 7 I. TRAFFIC CONTROL DEVICES INVENTORY In order to determine existing conditions on the application of modern traf- fic engineering practices to increase safety and uniform standards for traffic control devices, the following inventories will be completed: A. TRAFFIC SIGNAL INVENTORY . . . The Department of Public Works of the City of Jefferson City, Missouri will complete a detailed inventory of all existing traffic signal installations within the study area. A permanent form will be utilized for the collection of the physical, operational, and equipment features of the signalized locations dur- ing the traffic signal inventory. The inventory form will be designed to permit use as a permanent record as well as for the collection of traffic signal data in the field. The physical features of the intersections which will be inventoried include: right-of-way and surface width; traffic lane widths and arrangement including any channelization; parking limits and regu- lations; location of signal equipment; placement and use of auxil- iary signs; location of bus stops, sidewalks, crosswalks, and stop lines; installation date; and any other pertinent features which affect safe traffic control. The operational and equipment features which will be inventoried at each signalized intersection include: signal timing and phasing; type, location, size, and mounting of signal heads, lenses, and standards; model and type of controllers, detectors , and intercon- nection systems; and monthly cost of maintenance and operations. An engineering plan, at a suitable scale and prepared on a reproduc- ible material, will be drawn by the City to indicate the cuiTent phys- ical and equipment features of each signalized intersection. These f. plans will become part of the permanent files of the City's Public f' Works Department. The signal drawings will be prepared in such a manner as to be adaptable to corrections as modifications are made ��.. in the future. fr. 11i11i The Consultant will assist the City of Jefferson City with this phase of the study program. They will design and print all field inventory forms and will instruct field personnel in their use. The Consultant will check for accuracy all final completed forms. They will develop Ah the format for the signal drawings and check each final drawing for completeness and accuracy. 8 B. TRAFFIC SIGN INVENTORY . . . The Department of Public Works will complete a detailed inventory of all existing regulatory, warn- ing, and guide signs located within the right-of-way of the major arterial and collector street facilities of the study area. Approxi- mately forty-five ( 45 ) miles of streets will be inventoried. An inventory form will be used to record all field data and this ma- terial will become part of the permanent files of the Department of Public Works. The information to be collected includes: sign type; manual number and conformance to the Uniform Manual of Traffic Control Devices; size, color, and reflective qualities ( day- night ) of signs; visibility and mounting height; maintenance and replacement costs; and type, condition, and lateral side clearance of sign posts. The Consultant will assist the City of Jefferson City with this phase of the study program. They will design and print all field inventory forms and prepare procedure manuals for their use. All field personnel will be trained by the Consultant. They will also review all final forms for accuracy and completeness. C. TRAFFIC SPEED INVENTORY . . . The Police Department of the City of Jefferson City will obtain spot speed observations on the arterial and collector street network within the study area. The speed inven- tory will provide information on speed levels and trends; provide in- formation relative to the proper location of regulatory, warning, and _ guide signs; assist in the correlation of accident statistics and sig- nal timing; and utilized with "before and after" studies. The Consultant will assist the City of Jefferson Citywith this phase of the study program. The speed inventory statistics compiled by the City will be analyzed to determine speed levels by roadway segments and systems . Emphasis will be placed on the correlation of regulatory devices and necessary speed zones and their locations. D. TERMINAL FACILITY INVENTORY . . . To assist 'the City of Jefferson City with the implementation and development of efficient and effec- s tive traffic controls within the Central Business District, the Depart- ment of Public Works will inventory the existing parking facilities, ' both at the curb and off the street. The inventory would provide a complete record for the Central Business District showing for each facility the location, type, capacity, ownership, operation, phys- ical layout, and fees charged. The Consultant will assist the City in this phase of the study pro- gram. Parking inventory data compiled by the City will be analyzed Agh to determine parking facilities by type and the relation of on-street parking facilities to effective and safe traffic controls. 9 t e. ;s E. TRUCK TERMINAL INVENTORY , . The City of Jefferson City will inventory the existing truck routes and location of major truck terminals within the city. Information regarding the daily truck operations of each terminal will be ascertained. An exhibit will be prepared indicating routes and terminal locations. The Consultant will assist 'the City of Jefferson City in this phase of the study program. The Consultant will prepare the inventory, questionnaire and instruct City personnel in the da-ta collection and inventory. II. TRAFFIC ENGINEERING STUDIES v�. Several factors influence the safe and efficient movement of vehicles and the causation and location of accidents on the existing major street net- work. Traffic safety and accident potentials are influenced by: the nature and composition of traffic movements; roadway conditions; vehicle charac- teristics; traffic control devices; population density; land development; location of traffic generators; and by topographic features. In order to analyze existing conditions, the following studies will be pre- pared as part of this study program. A. ACCIDENTS . . . The City of Jefferson City, Missouri will prepare tabulations to indicate the top twenty ( 20 ) accident locations within the study area for the period 1968 - 1970 if adequate records are available. The tabulations will include -the number of fatalities, injury, non- injury, and total accidents at: each location during each of the three years. In addition to these top twenty ( 20 ) locations, accident data for the three-year period ( 1968 - 1970 ) will be compiled for any intersection controlled by traffic signals or four-way stop signs i; which is not included in the top twenty ( 20 ) listing and which re- -' ported five ( 6 ) or more accidents. 5 The actual accident reports for 1970 will be investigated and colli- sion diagrams will be prepared for all intersections which are sig- y�t,, 3. nalized, controlled by four-way stop signs, or are in the top twenty ( 20 ) listing. The Consultant will assist the City of Jefferson City with this phase of the study program. All accident data compiled by the City will be analyzed to determine accident trends, causation, and frequency as related to existing traffic control devices. The Consultant will determine the possible remedial programs which could be implemented to reduce accident causation due to inadequate or improper use of modern traffic control devices. 10 1 B. TRAFFIC VOLUMES . The Department of Public Works of Jefferson t City, Missouri will measure the traffic density at each of the inter- .U. sections presently controlled by traffic signals or four-way stop signs on the arterial and collector street network and in the Central Business District. Manual turning movement counts and pedestrian movements will be obtained on an average weekday ( Monday•- Friday ) between the hours of 6:00 - 10:00 A.M. and 2:00 - 6:00 P.M. . Approximately one hundred- ( 100 ) 24-hour machine counts will be obtained on the arterial and•collector street system. The Consultant will assist the City of Jefferson City on this phase of the study program. A traffic flow and count map will be prepared for the collector and arterial street system. A flow map will also be prepared for the Central Business District. Vehicle and pedes- trian movements will be related to existing traffic control devices to determine warrants for various types of control and to evaluate changes required in signal equipment, timing, phasing, and opera- tions in order to serve existing txavel demands and to help reduce accident potentials. C. TRUCK ROUTE NEEDS . The Consultant, in cooperation with the Public Works Department, will utilize the previous collected data to consider the establishment of a system of truck routes. Information on truck patterns; volume and type of truck deliveries; location of terminals to the arterial and collector street networks; and existing traffic volumes will be considered. A truck route system would be considered to reduce the number of trucks on residential streets; improve rapacity of overloaded streets; and improve traffic operation on non-truck routes. ,i The Consultant will assist the City in this phase of the study pro- gram. The The Consultant will prepare the inventory questionnaires r'x and instruct City personnel in the data collection and inventory. A truck route system map will be prepared-based upon_ the need and « inventory data. D. TERMINAL TURNOVER AND USAGE STUDY . The Public Works Department will complete a detailed turnover and usage study,to r; determine the efficiency and utilization of the present parking sys- tem in the Central Business District. Between the hours of 9:00 A.M. and 5:00 P.M. specially trained personnel will be assigned to specific curb faces within the study area. At the end of the eight- hour period, a complete record will be obtained for each space ind- cating the number of different vehicles using that parking stall and the number of hours the space was used. 11 4 The Consultant will assist the City in this phase of the study pro- gram- The turnover and usage statistics will be analyzed and con- sideration given to the need for revisions in present on-street park- ing practices and traffic control devices. Items to be considered would include revisions in present parking time limits; parking pro- hibitions during peak travel periods; and the effectiveness of present traffic control devices. E. INTERSECTION SAFETY INDEX . . . The Consultant, utilizing the previous data, will study all intersections included in the study program-and identify existing deficiencies in the application of traf- fic control measures and the need for improvement in existing prac- tices to- improve traffic safety and reduce accident potentials. An intersection safety index will be developed. The safety index will provide measurable indices to compare each individual inter- section on a­common scale and serve to indicate those locations requiring immediate remedial improvements. The index, will provide a basis for establishing a priority order of improvement for each intersection,included in the study program. Existing signal timing and phasing; the operational characteristics of the existing equipment; the need for additional traffic control equipment; and the required improvements in the intersection con- trol measures-to reduce traffic accidents will be investigated. F. ROUTE SAFETY INDEX . . . The Department of Public Works will complete-an inventory of the arterial and collector street system included within the study area. Approximately forty-five ( 45 ) miles of-facilities will be studied. A: The information which will be collected includes: right-of-way and surface widths; traffic lane widths and arrangement; pavement type and condition; speed limits and speed studies; availability of curbs, sidewalks, pavement markings, crosswalks, school protection, and street lighting; and the number and location of non-intersection 6e- F,t.. cidents Individual studies will be completed at each railroad grade crossing located on the study system and at any other grade crossing within the City that reported an accident during the past three ( 3 ) years. Data to be collected includes type of protection, traffic volumes, number of trains per day, number of tracks, and sight-distance. AM The inventory data will be collected on field forms which will be- ' come part of the permanent files of the Public Works Department. 12 6 Y The Consultant will assist the City with this phase of the study program. They will design and print all field forms and prepare procedure manuals for their use. All field personnel will be trained by the Consultant. They will also review the final forms for accuracy and completeness. The Consultant will analyze the field data to,determine a route safety index for each segment of the arteriaL and collector street system which can be used to determine the priority of traffic con- trol device and traffic engineering improvements. The factors which will be considered include: .reasonable and safe speed limits based on conditions; use of modern traffic control devices; adequacy of roadway elements; accident experience; and the level of enforcement. Attention will be given to eacl-, railroad grade crossing to determine adequacy of existing regulatory controls and priority for improvement. III. PROGRAMS FOR APPLICATION OF TRAFFIC CONTROL DEVICES The City of Jefferson City, Missouri is interested in developing a continu- ing program to utilize fully the application of modern traffic control devices and other traffic engineering measures to reduce traffic accident potentials. The program will-insure the City's desire in meeting Standard 4.4.13 of the Highway Safety Act of 1966 and the benefits to be derived -- reduction of,accidents on its street network and injury to its citizens and other per- sons within the community. A. PROGRAMS . The Consultant will assist the City of Jefferson City, Missouri in establishing a program -to upgrade the present use of traffic control devices; develop a matnteriance program for these devices; and create a continuing traffic engineering program which will enable City agencies to keep the survey data current and to evaluate future needs. '4 The current.program will indicate locations requiring immediate attention to reduce the likelihood and severity of traffic accidents. ri Specific recommendations will be made as to the type and location of required traffic control, roadway, and intersection Improvements. The Department of Public Works will furnish cost estimates for nec- essary roadway and intersection improvements. A circulation systems study will be conducted in the Central Busi- ness District to determine and recommend possible revisions in existing circulation patterns and modernization of the existing traf- fic signal system. 13 A Programs will be designed to reflect those segments of street net- works which require adjustment in present traffic control devices to conform with the standards issued or endorsed by the Federal Highway Administration. The Consultant, in cooperation with local agencies, will identify program objectives and assign priorities ( new signs, markings, and signals ) for the projected traffic safety needs. The programs will include an estimate of cost for the installation of the improve- ments and also a schedule for implementation of the program with- in a definite time period. The Consultant, in cooperation with local agencies, will prepare a maintenance program which will designate the agency responsi- ble for maintaining and operating the network of traffic control k` devices and the manpower require men•ts•;o The Consultant, in cooperation with local agencies, will develop a continuing traffic engineering program by which continued review and updating of recommendations implemented under this program will be-periodically evaluated by local persorinel and the National Highway Traffic Safety Administration,.. They will serve as a basis for additional budgetarZ requests to expand the-traffic improvement and safety program in the community. B. REPORT . .. The Consultant will prepare a report for the City of t. Jefferson City, Missouri which will document in narrative, graphic, and tabular form the program which should be established and main- tained in the City in order to satisfy the requirements of Section 4.4.13-of the Highway Safety Y Y Act of 1966. All of the Inventories, analyses, and programs described in previ- ous pants of the "Schedule" will be documented in the report.
