ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CALLING A SPECIAL
ELECTION IN THE CITY TO SUBMIT TO THE QUALIFIED VOTERS THEREOF A
PROPOSITION TO EXTEND THE PRESENT CORPORATE LIMITS OF THE CITY TO
INCLUDE AN UNINCORPORATED AREA OF LAND CONTIGUOUS TO THE PRESENT
CORPORATE LIMITS OF THE CITY.
f WHEREAS, the City Council of the City of Jefferson,
Missouri, adopted resolutions on January 61 1969, to annex
unincorporated areas of sand contiguous to the present city
limits, said unincorporated areas of land being described as
follows;
Beginning on the east bank of Turkey Creek (formerly
Cedar Creek) at a point lying on the westerly extension of
the south right-of-way line of Water Street, Cedar City,
Missouri ; thence southerly along the east bank of Turkey
Creek (formerly Cedar Creek) to the north bank of the
Missouri River; thence southwesterly to the centerline of
the Missouri River along a line perpendicular to the
centerline of the Missouri River; thence southeasterly
along the centerline of the Missouri River to the west
line of Section 22 , T44N, R11W; thence north along the
west line of Sections 22 and 15 , T44N, R11W, to a point
130 feet south of the south line of the old .Airport Road
(said point lying on the corporate limits of Cedar City,
Missouri) ; thence westerly along a line 130 feet south of
the south line of the old Airport Road to a point 200 feet
east of the east right-of-way line of old U.S. 54 ; thence
southerly along a line 200 feet east of the east right-of-
way line of old U.S. 54 to the north bank of the Missouri
River; thence westerly along the north bank of the Missouri
River to a point 200 feet west of the west right-of-way
line of old U.S. 54 ; thence north along a line 200 feet west
of the west right-of-way line of old U.S. 54 to a point on
the easterly extension of the south right--of--way line of
Water Street, Cedar City, Missouri; thence northwesterly
along the south right-of-way line of Water Street and the
extensions thereof to the point of beginning, all in
Callaway County, Missouri; and
Beginning at the northeast corner of Section 16, T44N,
R11W, thence Sough 4 degrees 30 minutes East along the
section line to a point 220 feet north of the north line of
the old Airport Road, (said point lying on the corporate
limits of Cedar City, Missouri) ; thence westerly along a
line 220 feet north of the north line of the old Airport
Road to a point 200 feet more or less east of the east
right-of-way line of old U.S. 54; thence north along the
corporate city limits of Cedar City, Missouri, to the
point of beginning, all in Callaway County, Missouri; and
Beginning at the northwest corner of New Madrid Private
Survey 2638 , thence North 85 degrees 03 minutes East,
343.2 feet; thence North 0 degrees 26 minutes East, 133
feet; thence North 84 degrees 18 minutes East, 1045.8 feet;
thence South 4 degrees 30 minutes East, 520. 7 feet; thence
South 54 degrees 22 minutes East, 707.8 feet; thence North
84 degrees 15 minutes East, 3456. 8 feet, to the east line
of New Madrid Private Survey 2638 ; thence north along the
east line of said Private Survey 2638 , and the northerly
extension thereof to the north right-of-way line of the
M.K. &T. Railroad; thence northwesterly along the north
right-of-way line of the M.K.&T. Railroad to Station
7569+27.2 of the M.K. &T. Railroad; thence South 56 degrees
12 minutes West to the corporate limits of Cedar City,
Missouri; thence generally easterly along the corporate
limits of Cedar City, Missouri , to the point of beginning,
all in Callaway County, Missouri..

WHEREAS# the City of Jefferson, Missouri , did cause to be
filed in the Circuit Court of Cole County, Missouri , in Case No.
28,765, a suit for a declaratory judgment authorizing the City to
annex the areas of Land described above; and
WHEREAS, on the 22nd day of September, 1970 , the Circuit
Court of Cole County, Missouri, did enter its judgment in said
suit, authorizing the annexation into the City of the unincor-
porated areas of land described above, upon the consent of a
majority of the qualified voters of the City voting at an
election to be held for such purpose in said City; and
WHEREAS, the Mayor and City Council of the City of
Jefferson, Missouri, with the consent of a majority of the legal
voters of said City, voting at an election to be held for such
purpose, by the passage and approval of a city ordinance, have
power to extend the limits of the City over territory contiguous
thereto; and
WHEREAS, the Mayor and City Council of the City of Jefferson,
Missouri , believe a special election should be held in the City to
determine if a majority of the qualified voters voting thereat are
in favor of extending the limits of the City, to include the
unincorporated areas of land hereinbefore described. NOW THEREFORI
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS:
Section 1. A special election shall be held in the City of
Jefferson, County of Cole, Missouri, on Tuesday, the 29th day of
June, 1971, in order to submit to the qualified voters of said
City the following proposition to-wit:

That the corporate limits of the City of Jefferson,
Missouri , shall be extended to include the following
described unincorporated areas of land contiguous to
the present city corporate limits:
Beginning on the east bank of Turkey Creek (formerly
Cedar Creek) at a point lying on the westerly extension of
the south right-of-way line of Water Street, Cedar City,
Missouri; thence southerly along the east bank of Turkey
Creek (formerly Cedar Creek) to the north bank of the
Missouri River; thence southwesterly to the centerline of
the Missouri. River along a line perpendicular to the
centerline of the Missouri River; thence southeasterly
along the centerline of the Missouri River to the west
line of Section 22, T44N, R11W; thence north along the
west line of Sections 22 and 15 , T44N, R1.1W, to a point
130 feet south of the south line of the old Airport Road
(said point lying on the corporate limits of Cedar City,
Missouri) ; thence westerly along a line 1.30 feet south of
the south line of the old Airport Road to a point 200 feet
east of the east right-of-way line of old U.S. 54 ; thence
southerly along a line 200 feet east of the east right-of-
way line of old U .S. 54 -to the north bank of the Missouri
Raver; thence westerly along the north bank of the Missouri
River to a point 200 feet west of the west right-of-way
line of old U.S. 54; thence north along a line 200 feet west
of the west right-of-way line of old U.S . 54 to a point on
the easterly extension of the south right-of-way line of
Water Street, Cedar City, Missouri; thence northwesterly
along the south right-of-way line of Water Street and the
extensions thereof to the point of beginning, all in
Callaway County, Missouri; and
Beginning at the northeast corner of Section 16 , T44N,
R11W, thence South 4 degrees 30 minutes East along the
section line to a point 220 feet north of the north line of
the old Airport Road, (sayd point lying on the corporate
limits of Cedar_ City, Missouri) ; thence westerly along a
line 220 feet north of the north line of the old Airport
Road to a paint 200 feet more or less east of the east
right-of-way line of old U.S. 54; thence north along the
corporate city limits of Cedar Cityc ' Missouri , to the
point of beginning, all in Callaway County, Missouri; and
Beginning at the northwest corner of New Madrid Private
Survey 2638 , thence North 85 degrees 03 minutes East,

feet; thence North 84 degrees 18 minutes East, 1045 . 8 feet;

M.K.&T. Railroad; thence northwesterly along the north
right-of-way line of the M.K. &T. Railroad to Station
7569+27.2 of the M.K. &T. Railroad; thence South 56 degrees
12 minutes West to the corporate limits of Cedar City,
Missouri; thence generally easterly along the corporate
limits of Cedar City, Missouri , to the point of beginning,
all in Callaway County, Missouri.

Section 2. That the said election shall be held in all
wards and precincts in the city at the polling places selected by
the City Council and published as
provided for in Sections 10.080
and 10. 090 of Ordinance No. 7593 of the city, as amended. Polls
of said election shall be open at the hour of six A.M. , and
continue open until the hour of seven P.M. , on said date. Said
election shall be held and conducted and the results thereof
shall be certifiedo canvassed, and declared in all respects in
conformity with the Constitution and Laws of the State of
Missouri governing elections in said City of Jefferson and in
accordance with the ordinances of said city.
Section 3. That the City Clerk be and she is hereby
authorized and directed to give notice of said election by
publication in the Jefferson City Post--Tribune , a daily newspaper
printed and published in the City of Jefferson and of general
circulation therein. Said notice shall be published in said
newspaper once a week for four consecutive weeks, and on the
same day in each week. Tha first publication of said notice
shall be made at least twenty--one (21) days before the date of
said election and the last publication shall be made within ten
(10) days of the date of said election. The notice to be
published shall be substantially in the following form, to-wit:

CITY OF JEFFERSON, MISSOURI.
Notice is hereby given that a Special Election shall be held in
the City of Jefferson, Cole County, Missouri, on Tuesday,
June 29, 1971, to submit -to the qualified voters of the City the

southerly along a line 200 feet east of the east right-of-
way line of old U.S. 54 to the north bank of the Missouri
River; thence westerly along the north bank of the Missouri
River to a point 200 feet west of the west right-of-way
line of old U.S. 54 ; thence north along a line 200 feet west
of the west right-of-way line of old U.S. 54 to a point on
the easterly extension of the south right-of-way line of
Water Street, Cedar City, Missouri; thence northwesterly
along the south right-of-way line of Water Street and the
extensions thereof to the point of beginning, all in
Callaway County, Missouri,; and
Beginning at the northeast corner of Section 16 , T44N,
RllW, thence South 4 degrees 30 minutes East along the
section line to a point 220 feet :north of the north line of
the old Airport Road, (said point lying on the corporate
limits of Cedar City, Missouri) ; thence westerly along a
line 220 weet north of the north line of the old Airport
Road to a point 200 feet more or less east of the east
right-of--way luxe of old U.S. 54; thence north along the
corporate city limits of Cedar City, Missouri, to the
point of beginning, all in Callaway County, Missouri; and
Beginning at the northwest corner of New Madrid Private

The election will be held at the voting places in each precinct
of each ward of the city to be selected by the city council and
.. published in the manner provided by ordinance.

The polls at said election shall be open at the hour of six
o'clock A.M. and will continue open until the hour of seven
o' clock P.M. on said date.
All persons who are legal voters in said city will be entitled
to vote at said election
Given under my hand and corporate seal of the City of
Jefferson, Missouri, this day of , 1971.
Section 4. The City Clerk is hereby authorized and
directed to furnish the judges and clerks of said election with
all poll books, tally sheets, ballots , ballot boxes and all
other materials and supplies necessary and required for the
conduct of said elections , and the ballot to be so provided
shall be printed in substantially the following form:
