AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING
ORDINANCE NO. 7153 RELATING TO CIVIL DEFENSE AND EXECUTING A
NEW ORDINANCE PERTAINING TO THE SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS :
Section 1. Definitions. As used in this ordinance , the
term:
(1) Civil Defense means the preparation for and
the carrying out of a 1 emergency functions , other
than the functions for which military personnel are
primarily responsible, to minimize and repair injury
and damage resulting from disasters caused by enemy
attack. These functions include, 'without limitation,
fire fighting services , police services , medical and
health services , rescue, engineering, air raid
warning services, communications, radiological,
chemical and other special weapons of defense ,
evacuation of persons from stricken areas , emergency
quartering, feeding and hospitalization of persons,
emergency transportation, temporary restoration of
public utility services, and other functions relating
to civilian protection, together with all other
activities necessary or incidental to the preparation
for and carrying out of foregoing functions , as
stated in revised. statutes, Missouri, 1959 , Civic
Defense.
(2) Emergency means any state of emergency
declared y t e Mayor under this ordinance upon the
occurance of an enemy attack or natural disaster,
which results in widespread damage to property and
to the death or injury of a large number of persons.
(3) End attack means an actual attack by
foreign nation by hostile air raids or other forms
of warfare upon any area of the State of Missouri
or any adjoining state.
Section 2. Civil Defense agency created: Coordinator;
duties. There is hereby created within the executive branch of
the city government of the City of Jefferson, Missouri, a
Division of Civil Defense, hereinafter called the Civil Defense
Agency, and a Coordinator of Civil Defense, hereinafter called
the Coordinator, who shall be the head thereof. The Coordinator
shall be appointed by the Mayor with the advise and consent of

the City Council. He shall not hold any other municipal office
and he shall devote such time to the duties of his office as may
be prescribed by the Mayor. He shall hold office at the
pleasure of the Mayor and shall receive such salary as may be
prescribed by the Mayor and approved by the City Council.
The Coordinator, subject to the direction and control of
the Mayor, shall be executive head of the Civil Defense
Agency and shall be responsible to the Mayor for carrying out
the program of civil defense of the City of Jefferson, Missouri.
He shall coordinate the activities of all organizations for
civil defense within this city, and shall maintain liaison with
and cooperate with civil defense agencies and organizations of
the State of Missouri and of the Federal Government, and shall
have such additional authority, duties and responsibilities
authorized by this ordinance as may be prescribed by -the Mayor.
Section 3. Advisory committee. The Mayor. may create,
establish and appoint such voluntary civil defense advisory
committee as may be responsible or advantageous in the evaluation
of technical, professional or other information which may affect
the work of the civil defense agency and which may provide
advisory assistance on any matters of civil defense.
Section 4 . City employees to assist in civil defense.
All agencies, departments, officials and employees of the city
hall. give the coordinator such assistance, aid and help in the
preparation and carrying out of a civil defense plan as may be
required by the coordinator. If called upon to do so, they shall
prepare written plans, as prescribed by the coordinator, and
thereafter train and equip themselves and their departments or
agencies to carry out all missions or functions assigned to them
by the coordinator.
In performing their duties under any plan of civil defense,
all agencies, departments, officials and employees of the city

9 are hereby directed to use all services, equipment, supplies
and facilities of their departments in any practical manner to
make the plan of civil defense most functional.
Section 5. Mobile support units. The Coordinator shall
form all emergency support units as may be provided or allowed by
the Missouri Civil Defense Act of 1969 or the survival plan of
the State of Missouri, and the coordinator shall designate the
leaders of all mobile support units. During the period that the
City of Jefferson, Missouri, has an emergency, the Mayor shall:
(1) Assume the executive role in putting into operation
all plans , rules and regulations relating to disasters
and emergency management of resources adopted under
this ordinance and to assume direct operational control
of all emergency units, organizations and volunteers
in the city.
(2) Take action and give directions to city
departments and agencies as may be reasonable and
necessary for the purpose of securing compliance with
the provisions of this ordinance and with orders,
rules and regulations made pursuant thereof.
Section 6. Mutual aid agreements. Upon the recommendation
of the coordinator and with the approval of the Governor of the
State of Missouri , the Mayor may enter into any mutual aid
agreements with other public or private agencies for the
exchange of reciprocal civil defense aid. Such mutual avid agree-
ments shall be consistent with the Missouri survival plan. in
time of emergency, the civil defense agency of the city shall
abide by such agreements and render such assistance or aid as
may be provided therein to any other public or private agency.
The Coordinator may assist in the negotiation of mutual
aid agreements with other public and private agencies.
Section 7. Cooperation with the State of Missouri. The
Civil Defense Agency of this city is directed to cooperate with
and extend such aid and services to the Civil Defense Agency of
the State of Missouri or the Governor of said state as it may be
requested to provide.

Section 8. Acceptance of federal or state assistance.
Whenever the federal government or the State of Missouri, or any
officer or agencies thereof, offer to the city any services ,
equipment, supplies , materials or funds by way of gift, grant or
loan for the purpose of civil defense, the Mayor may accept such
offer and authorize the coordinator to receive same on behalf of
the city subject to the terms of the offer.
Section 9. Emergency operations. In the event of an emer-
gency the coordinator is authorized to procure all services ,
supplies, equipment or materials necessary to continue the
effective operation of the civil defense plan without regard to
normal statutory procedures or formalities normally prescribed by
law pertaining to municipal contracts or obligations , provided that
if the City Council_ is meeting at the time, the coordinator shall
act pursuant to the orders and directions imposed on that body.
Section 10. Waiver of statutory procedures. in the event
of an enemy attack or natural disaster, the Mayor, by proclamation
may waive any time-consuming formalities or procedures required
by statute or ordinance pertaining to the advertisement of bids,
for the execution of contracts and for the performance of public
work contracts.
Section 11. Oath. Every person appointed to serve in any
capacity in the city civil defense agency shall, before entering

upon his duties, subscribe to the following oath which shall be
filed with the coordinator:
"I, , do solemnly swear (or
affirm) that I will support and defend and bear true
faith and allegiance to the Constitution of the United
States and the Constitution of the State of Missouri ,
and the territory, institutions and facilities thereof,
both public and private, against all enemies, foreign
or domestic; that I take this obligation freely, without
any mental reservations or purpose of evasion; and that
I will well and faithfully discharge the duties upon
which I am about to enter. And I do further swear ( or
affirm) that I do not advocate , nor am I, nor have I
been, a member of any political party or organization
that advocates the overthrow of the Government of the
United States and of this State by force or violence ,

and that during such time as x am affiliated with the
Jefferson City .Civil Defense Agency, Z will not
advocate, nor become a member of any political party
or organization that does advocate the overthrow of
the government of the United States or of this State
by force or violence. "
Section 12. Office Space. The Mayor is authorized to
designate space in any municipally owned or leased building for
the office of the municipal civil defense agency.
Section 13. Effective Date. This ordinance shall be
in force and take effect from and after its passage and approval.
