Home My Public Portal AboutOrdinance No. 1239-12 10-16-20123A-6 ORDINANCE NO. 1239-12 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1214-11 AND THE FISCAL YEAR 2011-12 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1214-11 on September 13, 2011 approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2011-12; and WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable diligent thought and attention, have necessitated a certain amendment to Ordinance No. 1214-11, and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 2011- 12 budget contemplated has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section II of said Ordinance No. 1214-11 be amended to increase the general fund appropriation from $4,909,551 to $5,338,176 with such increase allocated and appropriated as follows: $222,832 purchase of property; $22,000 Planning Consultant Agreement; $45,309 increase in legal fees; $81,066 Sales Tax Audit Consultant; $44,716 City Manager agreement; $34,324 parks maintenance. That Section VII of said Ordinance No. 1214-11 be amended appropriating $155,900 out of the 2007 Waterworks Revenue Bond Interest and Sinking Fund for the repayment of water and sewer works long term debt principal and interest. 10/11/2012 10:22 AM 3A-7 That Section X of said Ordinance No. 1214-11, be amended appropriating $46,950 out of the 2007 Contractual Obligation Interest and Sinking Fund for the repayment of general long term debt principal and interest. IV. That Section XI of said Ordinance No. 1214-11 be amended appropriating $407,122 out of the Drainage Utility Fund for drainage system improvements in accordance with the City's drainage ordinance and state law. V. That Section XIV of said Ordinance No. 1214-11 be amended appropriating $133,350 out of the 2001 Certificate Obligations Interest and Sinking Fund for the repayment of general long term debt principal and interest. VI. That Section XV of said Ordinance No. 1214-11 be amended appropriating $195,800 out of the 2010 Certificates of Obligation Drainage Revenue Interest and Sinking Fund for the repayment of long term debt principal and interest. VII. That Section XVI of said Ordinance No. 1214-11 be amended appropriating $577,602 out of the Crime Control and Prevention District Expense Fund for the purpose of acquiring capital assets and equipment and supporting crime reduction. programs throughout the City. VIII. That Section XX of said Ordinance No. 1214-11 be amended appropriating $36,500 out of the Animal Shelter Donation Fund for the purchase of capital equipment and assets. IX. That Section XXI of said Ordinance No. 1214-11 be amended appropriating $167,801 out of the Hotel Occupancy Tax Fund for the purpose of promoting tourism to attract visitors to the City. 10/11/2012 10:22 AM 3A-8 X. That Section XXIII of said Ordinance No. 1214-11 be amended appropriating $387,374 out of the Traffic Safety Fund for the purpose of constructing traffic quieting pavement improvements and crash construction equipment. XI. That Section XXIV of said Ordinance No. 1214-11 be amended appropriating $58,265 out of the Electronic Meter Reading Lease Purchase Expense Fund for the purpose of repaying long term debt. XII. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-A appropriating $9,450 out of the Municipal Court Technology Fund for the purpose of acquiring capital equipment and assets. XIII. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-B appropriating $250 out of the Law Enforcement Fund for the purpose of funding law enforcement operations. XIV. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-C appropriating $15,000 out of the Library Grants Fund for the purpose of funding special library programs and events. XV. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-D appropriating $65,421 out of the FEMA Grants Fund for the purpose of funding equipment for the fire department. XVI. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-E appropriating $181,435 out of the Facility/Capital Improvement Fund for the purpose of funding improvements to city hall building, community center building, library building, and new servers. 10/11/2012 10:22 AM 3A-9 XVI1. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-F appropriating $5,731 out of the Baker Boulevard Intersection Capital Project Fund for the purpose of funding capital outlays in conjunction with street improvements. XVIII. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-G appropriating $2,222 out of the Oil and Gas Lease Fund for the purpose of funding system improvements. XIX. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-H appropriating $5,000 out of the Police Grants Fund for the purpose of funding improvements to remodel emergency operations area. XX. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-I appropriating $426,700 out of the 2011 Revenue Bonds Refinance Interest and Sinking Fund Library Grants Fund for the repayment of wastewater and water works long term debt principal and interest. XXI. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-J appropriating $1,600,000 out of the 2010 Drainage Construction Fund for drainage systems improvements in accordance with City's drainage ordinance and state law. XXII. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-K appropriating $360,827 out of the Enterprise Improvement Project Fund for the purpose of funding constructing improvements to the water and wastewater systems. XXIII. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-L appropriating $67,809 out of the 2001 Capital Projects Fund for the purpose of funding capital outlays in conjunction with street improvements. 10/11/2012 10:22 AM 3A-10 XXIX. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-M appropriating $26,940 out of the 2007 Revenue Bonds Construction Fund for the purpose of funding improvements to the water and wastewater systems. XXX. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-N appropriating $29,805 out of the 2011 PPFCO Acquisitions Fund for the purpose of purchasing capital equipment. XXXI. That Section XXV of said Ordinance No. 1214-11 be amended by creating Section XXV-O appropriating $75,000 out of the Safe Routes to School TXDOT Grant Fund for the purpose of funding safe routes to school sidewalk project. XXXII. Severability Clause. That it is hereby declared to the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXXIII. Saving Clause. That said Ordinance No. 1214-11 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. 10/11/2012 10:22 AM 3A-11 XXXIV. Effective Date. This ordinance shall be in full force and effect from and after its passage. XXXV.
