THE MAYOR AND CLERK OF THE CITY TO EXECUTE A CONTRACT WITH
PROST BUILDERS , INC.

BE IT ORDAINEL BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk of the City are hereby
authorized and directed, for and in the name of the City, to
execute a written contract with PROST BUILDERS, INC.
for the improvement of
CITY COUNCIL CHAMBERS 6 JUDGES CHAMBERS
for the sum of $5,960. 00
SECTION 2. A copy of said contract is attached hereto.
SECTION 3. This ordinance shall take effect and be i;i
force from and after its passage and approval.

CONTRACT FOR PUBLIC WORK
THIS CON'T'RACT, made and entered into this 16th day of January
1973 by and between John G. Christy, President of the City Council of the
City of Jefferson, Missouri, a municipal corporation of the third class of
the State of Missouri, Party of the First Part , and who acts for and on be-
ha of the City of Jefferson, PROST BUILDERS, INC.
Party of the Second Part, WITNESSETH:
THAT, WHEREAS, the City Council . of the City of Jefferson, Missouri, did
on the 15th day of JANUARY 19 73 , award to the Party of the
Second Part, PROST BUILDERS, INC. , the contract
for the improvement of THE CITY COUNCIL CHAMBERS � JUDGES CHAMBERS
NOW, THEREFORE, for and in consideration of the awarding of this con- ,
tract and the work thereunder by said First Party hereto, the City of
Jefferson, Missouri, to the Second Party, PROST BUILDERS, INC.
the said Second Party does hereby contract
an agree to do and perform said work, above specified and referred to, for
tlWfollowing prices and to accept in payment therefor monies now in the
treasury of the First Part, upon the acceptance of said work by the City
Council of the said City of Jefferson.

WOW, BY THESE PRESEN'T'S , it is agreed and understood by the parties
hereto, that this contract is entered into subject to all existing ordinances
of the City of Jefferson pertaining to the work awarded and subject to the
plans and specifications and estimates of the costs for such work on file in
the office of the City Clerk, and which shall be considered a part and parcel of
this contract; that all questions arising as to the proper performance of this
contract of such work in accordance with the plans and specifications therefor ,
and estimates thereof, shall be decided by the Director of Public Works of
the City of Jefferson, Missouri, or by such competent person appointed by the
Mayor and the City Council of the City of Jefferson to supervise and superin-
tend said work in the place of and instead of such Director of Public Works;
that in the case of improper construction, the City of Jefferson reserves the
right at any time to suspend, re-let or order an entire reconstruction of the
work,- that Contractor agrees to commence work on or before a date to be
spffilfied in a written "Notice to Proceed" and to fully complete the project
within 30 consecutive thirty days thereafter. The City
reserves the right at any time to suspend, re-let or order an entire recon-
struction of the work awarded and to declare the contract forfeited; but that
such suspension, re-letting or reconstruction or forfeiture shall not affect
the right of the City to recover all damages and penalties accruing or due
it by reason of the Contractor 's non-compliance with this contract. Liquidated
damages of $100. 00 per day will be assessed against the Contractor for
each day the work remains incomplete following the completion date or extension
thereof.
The Second Party agrees to pay all classes and crafts of labor used
in the performance of this contract the prevailing hourly rate of wages
as termined by the Department of Labor and Industrial Relations and
Second Party acknowledges that he knows the prevailing hourly rate of
wages for all the classes and crafts of labor to be used in the performance
of this contract because he has obtained the prevailing hourly rate of
wages from the contents of Special Wage Determination No. 17906 /l , in which
the rate of wages are set forth.
The Contractor further agrees, as the Second Party, that he will keep
an accurate record showing the names and occupation of all workmen employed
by them in connection with the work to be performed under the terms of this
contract, which record shall show the actual wages paid to each of said
workmen in connection with the work to be performed under the terms of this
contract, and agrees further that the aforementioned accurate record shall be
available and open at all reasonable hours for the inspection by "'the Director
of rAmlic Works or any other authorized employee of the City of Jefferson,
Missouri. In compliance with the Prevailing Wage Law, as Amended in Sections
290. 210 to 290. 340 inclusive, Revised Statutes of Missouri, 1969, effective
October 13, 1969, not less than the prevailing hourly rate of wages in the
Jefferson City area shall be paid to all workmen performing work under this
contract, Section 290 .250. The Contractor shall forfeit to the City Ten

Dollars ($10.00) for each workman employed, for each calendar day, or portion
thereof, such workman is paid less than the stipulated rates for any work
done under said contract, by him or any subcontractor under him. Section
290.250.

The Second Party agrees to completely indemnify and hold harmless the
City of Jefferson for any and all damages, injuries , actions, costs,
attorneys ' fees and all other expenses whatsoever, arising out of the
performance of said work whether the property or persons damaged are the
servants and employees of the Second Party, or third parties in no manner
connected with said work. All interlineations, corrections, deletions and
changes herein have been made prior to the execution of this contract .
IN WITNESS WHEREOF, the parties have hereunto set their hands and

SPECIFICATIONS FOR REMODELING OF )COUNCIL CIIANIBERS AND JUDGE' S CI-IA?IBER
1 . Paneling: All walls in the Council Chambers and the Judge ' s
it ambers are to be paneled with I:lm Paneling wi t}hin a price
of from $7 . 00 to $8. 00 per 4 ' x 8' sheet . Paneling is to be
from the floor to the ceiling and all necessary matching trim
j and finish is to be provided by the contractor.
2. Seating: Existing theathre seats in the Council Chambers shall
Fe removed and forty-one (41) seats , the same as or equal to ,
Massey Seating Company' s Model No . 54- 76P, shall be installed
as per floor layout diagram. Massey Seating Company' s Catalog
can be found in Sweets 1972 Architectual Catalog File, volumn ) ll .
3. Drapes : Drapes and drapery fixtures are to be hung at all windows
in the Council Chambers and Judge ' s Chambers . We would like to
specify; The Siearra Collection' s Palladino Pattern, Color: Red
Leaf Pattern, Approximate - width 45" , Approximate repeat 24" ,
60% Rayon, 32% Cotton and 896 Flax.
4. Carpets : Carpeting is to be installed over the entire floor of
the. Council Chambers and Judge ' s Chambers , We would like to
specify: Trend Mills Style : Sheer Delight 1801 , Color: Rebel
+ Red 1801.
S. Painting Ceiling: The accoustical the in the Council Chambers
an the ceiling 1n the Judge ' s Chambers shall be painted with a
white latex semi-gloss paint.
6. Removal of Sinks and Cabinet: Two sinks located in the Judge ' s
Chamber s all be removed and the water lines plugged at floor
' level . The large cabinet extending the length of the Judge ' s
Chamber shall be removed.
7 , Doorway into Judge ' s Chambers : A doorway shall be cut into the
partition Uetween the Council Chambers end the Judge ' s Chamber
where a door existing previously. All necessary framing shall
be installed to match paneling and a door is to be hung to open
into the Judge' s Chambers . The door is to be stained to match
paneling.
8. Doorway from Hall into Council Chambers : A new door is to be
Hung w here the current Council Chambers—entrance is opening out-
ward into the hallway. New framing is to be installed to match
paneling and door is to be stained to match paneling.
9. Radiator Covers : The existing radiators in the Council Chambers
and tFie Ju ge ' s Chambers shall be covered as per sketch attached.
10. Light Fixtures : A now light fixture is to be installed in the
u ge s Clam er Ihavin- at least the capacity for thy-e (s) bulbs .
Nothing fancy is required here , just a simple fixture and shade .
11 . Barricade : The barricade extending across the middle of Council
Viers shall be removed .
12. Doors Rack of Council Chambers : The two doors located at the hack
