AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING THE
MINIMUM HOUSING STANDARDS CODE, THE 1970 EDITION OF THE BUILDING
OFFICIALS CONFERENCE OF AMERICA (BOCA) BASIC HOUSING CODE
PRESCRIBING REGULATIONS GOVERNING ALL STRUCTURES USED FOR HUMAN
HABITATION, ESTABLISHING POWERS AND DUTIES OF THE BUILDING
COMMISSIONER AND HIS DESIGNATED HOUSING INSPECTOR(S) AND PROVID-
ING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. Adoption of Minimum Housing Standards Code.
There is hereby adopted by the City Council of the City of
Jefferson, Missouri, a Minimum Housing Standards Code specifically,
the 1970 edition of the Building Officials Conference of America
(BOCA) Basic Housing Code as supplemented herein by Section 4 of
this ordinance and which is filed in the office of the Clerk of
the City of Jefferson, Missouri, and herein referred to as the
Housing Code or "This Code" , for the purpose of protecting the
public health, safety and welfare in buildings used for dwelling
purposes as therein provided by:
1. Establishing minimum standards for basic equipment and
facilities for light, ventilation, space heating and
sanitation; for safety from fire; for space, use and
location; and for safe and sanitary maintenance; for
cooking equipment in all dwellings and multi-family
dwellings now in existence;
2. Fixing the responsibilities of owners, operators and
occupants of dwellings and multi-family dwellings;
3. Providing for administration, enforcement and penalties.

SECTION 2. Definitions.
a. Wherever the word Municipality is used in the Housing
Bode it shall be held to mean The City of Jefferson, Missouri.
b. Wherever the job title building official is used in
the Housing Code it shall be held to mean the Building Commissioner
or;� his Designee, Housing Inspector.
c. Wherever the term building department is used in the
Housing Code it shall be held to mean Building Commissioner.
d. Wherever the term legal representative is used in the
Housing Code it shall be held to mean City Attorney for the City
of Jefferson, Missouri.
SECTION 3. Duties of the Building Commissioner and his designated
Housing Inspector (s) .
a. The Housing Code shall be enforced by the Building Com-
missioner or, his designee.
b. The Building Commissioner shall recommend to the Mayor
the employment of Housing Inspectors in sufficient numbers to
assure enforcement of this code, who, when such authorization is
made, shall be selected through an examination to determine their
fitness for the position. The examination shall be open to all
AM and appointments made after examination shall be based coley on
qu merit and shall be for an indefinite term with removal only for
cause.
c. The Building Commissioner shall maintain or cause to be
maintained a written record of all inspections, violations and the
disposition thereof and to prepare therefrom an annual report
containing all proceedings under this code to be transmitted to
the Mayor of the City of Jefferson, Missouri.
d. The Building Commissioner shall serve as Secretary to
the Appeal Board as established by this code and shall make
available to said Board all documents, records and reports it
may request.
SECTION 4. Supplements.
a. The Housing Code is supplemented as follows: Every
interior wall,ceiling, door and floor or parts thereof shall be
maintained in sound condition and good repair, free of any holes,
cracks, loose plaster or other defects that would provide access
for insects or rodents. All interior surfaces shall be finished
with wall paper, paint, or other accepted material so as to be
easily cleanable, reasonably smooth, clean and tight. Floors
shall also be reasonably true and level, free of any fixed,
irregular or broken surface material that would create a tripping
hazard.
SECTION 5. Right of Appeal.
The Mayor of the City of Jefferson shall appoint and estab-
lish an Appeal Board of five (5) persons qualified by education
and experience in the building profession who shall have the duty,
responsibility and authority to decide matters referred to them in
accordance with Section H-141.0 (Right of Appeal) of this Code.
SECTION 6. Penalties.
a. Any person who shall violate any of the provisions of the
code hereby adopted or fail to comply therewith, or who shall
violate or fail to comply with any order made thereunder, or who

shall build in violation of any detailed statement of specifica-
tions or plans submitted and approved thereunder, or any certifi-
cate or permit issued thereunder, and from which no appeal has
been taken, or who shall fail to comply with such an order as
affirmed or modified by the City Council or by a court of competent
jurisdiction, within the time fixed herein, shall severally for
each and every such violation and noncompliance respectively, be
quilty of a misdemeanor, punishable by a fine of not less than
$25.00 nor more than $100.00 or by imprisonment for not less than
30 days nor more than 180 days or by both such fine and imprison-

ment. The imposition of one penalty for any violation shall
not excuse the violation or permit it to continue; and all such
persons shall be required to correct or .remedy such violations
or defects within a reasonable time; and when not otherwise
specified, each ten (10) days that prohibited conditions are
maintained shall constitute a separate offense.
b. The application of the above penalty shall not be held
to prevent the enforced removal of prohibited conditions.
SECTION 7. Repeal of Conflicting Ordinances.
All former ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the
code hereby adopted are repealed.
SECTION 8. Validity.
The City Council hereby declares that should any section,
paragraph, sentence, or word of this ordinance or of the code
hereby adopted be declared for any reason to be invalid, it is
the intent of the City Council that it would have passed all
other portions of this ordinance independent of the eliminiation
herefrom of any such portion as may be declared invalid.
SECTION 9. Date of Effect.
This ordinance shall take effect and be inforce from and
after its passage and approval.
