AN ORDINANCE REGULATING THE CONSTRUCTION ALTERATION AND EQUIPMENT
OF BUILDINGS AND OTHER STRUCTURES IN THE CITY OF JEFFERSON,
MISSOURI, ADOPTING THE BOCA BASIC BUILDING CODE, AND PROVIDING
PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. Adoption of BOCA Basic Building Code.
There is hereby adopted by the City Council of the City of
Jefferson, Missouri, for the purpose of regulating the construction,
alteration and equipment of buildings and other structures, that
certain code known as the BOCA Basic Building Code, Fifth Edition
1970-1971 Supplement, save and except such portions as are here-
after deleted, modified or amended, which code is filed in the
office of the City Clerk, and referred to herein as the Building
Code or this Code, and from the date on which this ordinance
shall take effect the provisions thereof shall be controlling
within the limits of the City of Jefferson, Missouri.
SECTION 2. Definitions.
a. Wherever the word Municipality is used in the Building
Code, it shall be held to mean the City of Jefferson, Missouri.
b. Wherever the job title building official is used in the
Building Code, it shall be held to mean the Building Commissioner
or, his designee, Building Inspector.
c. Wherever the term building department is used in the
Building Code, it shall be held to mean Building Commissioner.
d. Wherever the term legal representative is used in the
Building Code, it shall be held to mean City Attorney for the
City of Jefferson, Missouri.

e. wherever the term chief appointing authority is used
in this Code it shall mean the Mayor of the City of Jefferson,
Missouri.
SECTION 3. Department of Building Inspection.
The Department of Building Inspection of the City of Jefferr•-
son, Missouri, is hereby created and the Executive Official in
charge thereof shall be known as the Building Commissioner who
shall be appointed by Mayor.
SECTION 4. Duties of the Building Commissioner and his designated
Building Inspector (s) .
a. The Building Code shall be enforced by the Building
Commissioner or his designee.
b. The Building Commissioner shall recommend to the Mayor
the employment of Building Inspectors in sufficient numbers to
assure enforcement of this code, who, when such authorization is
made, shall be selected through an examination to determine their
fitness for the position. The examination shall be open to all
and appointments made after examination shall be based soley on
merit and shall be for an indefinite term with removal only for
cause.
Aft c. The Building Commissioner shall maintain or cause to be
maintained a written record of all inspections, violations and
the disposition thereof and to prepare therefrom an annual report
containing all proceedings under this code to be tran:tmitted to
the Mayor of the City of Jefferson, Missouri.
c. The Building Commissioner shall serve as Secretary to
the Appeal Board as established by this code and shall make
available to said Board all documents, records and reports it
may request.
SECTION 5. Sections in the BOCA Basic Building Code not applicable.

The following sections of the BOCA Basic Building Code are
deleted: Section 107.0 (107.1 to 107.9 inclusive) Article 1 and

Section 1500. 2 of Article 15 and Article 17.

The Mayor of the City of Jefferson shall appoint and estab-
lish an Appeal Board of five (5) persons qualified who shall have
the duty, responsibility and authority to decide matters referred
to them in accordance with Section 127.0 (Right of Appeal) of
this Code.
SECTION 7. Penalties.
a. Any person who shall violate any of the provisions of the
code hereby adopted or fail to comply therewith, or who shall
violate or fail to comply with any order made thereunder, or who
shall build in violation of any detailed statement of specifica-
tions or plans submitted and approved thereunder, or any certifi-
cate or permit issued thereunder, and from which no appeal has
been taken, or who shall fail to comply with such an order as
affirmed or modified by the City Council or by a court of competent
jurisdiction, within the time fixed herein, shall severally for
each and every such violation and noncompliance respectively, be
quilty of a misdemeanor, punishable by fine of not less than
$25.00 nor more than $100 .00 or by imprisonment for not less than
30 days nor more than 180 days or by both such fine and imprison-
ment. The imposition of one penalty for any violation shall
not excuse the violation or permit it to continue; and all such
persons shall be required to correct or remedy such violations
or defects within a reasonable time; and when not otherwise
specified, each ten (10) days that prohibited conditions are
maintained shall constitute a separate offense.
b. The application of the above penalty shall not be held
to prevent the enforced removal of prohibited conditions.
SECTION 8. Fees.
a. New construction and alterations: the fees for building
permits shall be in accordance with the following schedule:
New Buildings
Fees based on gross area including garages, carports and
finished basements.
1. Buildings of 0 to 3,000 sq. ft. - $0.015 per square
foot plus $0.0025 per square foot for unfinished
basements, with a minimum fee of $4.00.
2. Buildings of 3,001 to 10, 000 sq. ft. - $45.00 plus
$0.01 per square foot for area above 3, 000 sq. ft. ,
plus $0.0025 per square foot for unfinished basements.
3. Buildings over 10,000 sq. ft. - $115.00 plus $0.005
per square foot for area over 10, 000 sq. ft. , plus
$0.0025 per square foot for unfinished basements.
Remodeled Buildings
Fees based on estimated total construction costs.
$0.00 to $1, 000.00 ----------------------------- $2.00
$1, 000.01 to $5,000.00 ----- $2.00 per thousand dollars
of cost.
Over $5,000.00 ----- $10.00 plus $1.00 per thousand dollars
of cost over $5,000.00.
b. All other fees payable under this Code shall be as
prescribed in local ordinances or, by approved schedules established
by the Building Commissioner.
SECTION 9. Repeal of Conflicting Ordinances.
All former ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the
code hereby adopted are repealed.
SECTION 10. Validity.
The City Council hereby declares that should any section,
paragraph, sentence, or word of this ordinance or of the code
hereby adopted be declared for any reason to be invalid, it is
the intent of the City Council that it would have passed all
other portions of this ordinance independent of the elimination.

SECTION 10. Date of Effect.
This ordinance shall take effect and be inforce from and
after its passage and approval.
