ORDINANCE NO. ��q
AN ORDINANCE TO AMEND ORDINANCE. NUMBER 3268 OF THE CITY OF JEFFERSON,
MISSOURI, CREATING A CITY PLANNING AND ZONING COMMISSION, PRESCRIBING
THE NUMBER AND QUALIFICATIONS OF ITS MEMBERS AND DEFINING THEIR
DUTIES, BY REPEALING SECTION II OF SAID ORDINANCE, RELATING TO MEMBERS,
AND TO ENACT IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS SECTION
II, RELATING TO THE SAME SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. That Ordinance Number 3268 of the City of Jefferson, Missouri,
creating a City Planning and Zoning Commission, prescribing the number and
qualifications of its members and defining their duties, is hereby amended by
repealing Section II of said Ordinance, relating to Members, and to enact in
lieu thereof a new section to be known as Section II, relating to the same
subject, and to read as follows:
"SECTION II: MEMBERS. - The City Planning and Zoning Commission
shall consist of sixteen (16) members, four (4) of whom shall be the Mayor,
the City Director of Public Works, the County Director of Public Works, and a
member of the City Council. The last mentioned shall be selected by the Council
from among its number.
Nine members shall be citizens of Jefferson City qualified by knowledge
or experience to act on questions pertaining to the development of city planning,
and residents of the City of Jefferson, Missouri. The above citizen members
shall be appointed by the Mayor, subject to the approval of the Council.
Three members shall be citizens of Cole County residing in the extra-
Aft territorial two-mile zone under jurisdiction of the Planning and Zoning Commission
by virtue of Said citizen members
shall serve without voting authority and shall possess the same qualifications
as cited above. Said citizen members representing the area outside Jefferson
City shall be appointed by unanimous vote reflected in a Court Order of the
County Court of Cole County. City and County Commissioners shall be appointed
in the following manner.
Commissioners shall hold office one-third for one year, one-third for two
years, and one-third for three years, from the First of May following their
appointment, and annually thereafter, the Mayor shall before the First of
May of each year appoint as before, three (3) city resident commissioners, who
shall hold office for three years, and until their successors are appointed.
Likewise, after the initial three (3) appointments, the County Court shall appoint
one (1) county commissioner each year in the same manner.
The Mayor may, by and with the consent of the legislative branch of the
municipal government, remove any commissioner who resides in Jefferson City
for misconduct or neglect of duty. The Presiding Judge may, by and with the
consent of a majority of the County Court, remove any commissioner appointed
by the County Court for misconduct or neglect of duty.
Any and all appointments to fill vacancies shall be for the unexpired
term only, All members are to serve without pay,
Section 2. This ordinance shall be in force and take effect from and after
its passage and approval.
