Building Committee Meeting Minutes --
Friday, August 5, 2022 Virtual Meeting 1:00 PM
I Call to Order/Agenda Changes/Recording Notification
Chair Greg Levasseur called the meeting to order at 1:06 pm and read the recording notification.
In attendance: Pat Clark, Chris Easley,Tom Faris,Tony Nannini,Jody Craven,Jim Nowack, Giovanna

A. Report and Update from Flansburgh and DaedalusZCHA on bid protest hearing and
outcome with recommendation for SBC action
Jorge Cruz reviewed that the hearing with the Attorney General's (AG) Office involved a
lot of discussion about the prequalification committee in terms of references,financial issues, and
WBMBE issues around the CTA protest. Following the hearing, we received an email.from Debra
Anderson at the AG's office determining the prequalification committee did not have the.right to
reduce the quantity amount in the financial portion of the RFQ. The committee had waived that
right and used total scores to rank, which resulted in CTA not being qualified from the project;
that was an incorrect judgement on the part of the prequalification committee. Because of the
AG's email, we would only have one contractor that would be qualified. (Fontaine Brothers) and
we cannot move forward with the bid without two qualified general contractors. Flansburgh
shared a revised schedule with the committee, asked CHA to add to the conversation and opened
up the discussion to questions from the committee.
B. SBC discussion on bid process
The AG will take several weeks for a formal ruling, pushing out our general contract bids further;
our filed sub bids are good for only thirty days, and August 22, 2022 is the 30-day deadline. Based
on the CTA Hearing and the delays that will incur, Flansburgh is recommending rebidding the
entire file sub and general contractor's package.The committee discussed the bid process. Citizen
John Kelly voiced concerns about the project and the timeline with the MSBA.
C. SBC VOTE to refect ALL filed sub bids and issue new invitation to bid with potential
languap,e modifications
Greg Levasseur motions to reject all filed sub bids and issue new invitations to bid with potential
language modifications.Tom Fitzgibbons seconds the motion. By roll call, the committee votes
unanimously.
D. SBC discussion and vote to reissue RFQ for General Contractors pursuant to MGL c.149 SS
44D% with potential language changes
After a committee discussion, Greg Levasseur motions to vote to reissue RFQ for general
contractors pursuant to MGL c. 149 SS 44D%2 with potential language changes with region counsel
involved. Chris Easley seconds the motion. By roll call,the committee votes unanimously.

Greg Levasseur motions to adjourn the meeting. Tom Fitzgibbons seconds the motion. The
committee votes unanimously by a show of hands. Meeting adjourned at 1:24pm.
