N ORDINANCE OF THE CITY OF JEFFERSON RELATING TO THE 4, ,STABLISHMENT OF THE PARKING AUTHORITY FOR THE CITY OF 1 JEFFERSON, ESTABLISHING ITS POWERS, PERSONNEL AND PROCEDURES AND REPEALING ORDINANCES NO. 7436, NO. 8254 AND NO. 8345. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. There is hereby created a Parking Authority for the City of Jefferson. �f Section 2. The Parking Authority shall have the power to recommend �i o -the City Council rates for parking meters, and for all parking facilities ,owned by the City, to collect monies paid for parking. The Parking Authority Ishall also have power to collect funds from parking meters, to negotiate Teases or purchase agreements with the Housing Authority, or with private persons, for the establishment of parking facilities. �. Section 3. Establishment of Parking Authority Fund. There is ereby established a Parking Fund. All monies collected from parking meters I rand parking lots shall be deposited with the City Collector to the credit of the P g p y ,'Parking Authority Fund. All monies collected from the Municipal Garage shall 1e deposited with the City Collector to the credit of the Parking Garage Fund. I 1 11 fines for tickets issued by the Parking Authority Officers with the exception !`of those fines imposed by action of the police court shall likewise be credited Ilto the Parking Authority Fund. I� Section 4. The Parking Authority shall assume all expenses .incidental i to the operation, maintenance and construction of parking facilities, including the payment of all personnel, utilities, all other indebtedness including bonds 'which may be issued in the future for construction of parking facilities. All �xpenses shall be paid from revenues derived from parking income. The (Parking Authority shall assume all expenses incidental to the operation, repair !� � nd maintenance of the parking garage including the payment of all personnel, tilities and similar expenses, but all such payments shall be charged to the (iParking Garage Fund. �+ Section 5. Nothing in this Ordinance shall in any way relieve the City of its obligations on any bonds, or in any way relieve the City of its obligations ,on any contracts. Section 6. All contracts shall be bid in accordance with the general u ordinances of the City. All leases between the Parking Authority and �the Housing Authority or a private operator shall be approved and passed by !`.Ordinance before becoming effective. �I I I ' . f Section 7. The Parking Authority shall. consist of nine (0) members. I IIOf the nine members one shall be the Director of Public Works, one shall be lithe Chairman of the Parking and Traffic Commission, two shall be duly !elected City Councilmen. The City Councilmen and the remaining five member` i �fshall be selected by the Mayor, with the approval of the Council. Members shall serve for two (2) years, or until their successors are appointed. Two (2) members shall be appointed initially for a one (1) year term, and three (3) ► f Iimembers for a two-year term. The Mayor, with the approval of the Council, shall appoint a Chairman from among the nine member Authority. Section 8. The Parking Authority shall recommend a Supervisor and Assistant to the Mayor, who will appoint, subject to approval of the majority of the Council. e !Aa The Assistant Supervisor shall manage the Parking Ash lGarage, and shall be responsible to the Parking Authority Supervisor. The Supervisor shall be responsible for the day-to-day operation of the City Parking Garage, City parking meters and City owned parking lots. He shall see that all funds are collected, accounted for and transmitted to the City Collector. He shall supervise the activities of all ►personnel under him. f The Supervisor, with the approval of the Authority, shall 4 employ such personnel as necessary for the efficient operation of the parking ►system. The number and working conditions of employees of the Parking 'Authority shall be established by the Authority. I The employees of the Parking Authority, including the �iSupervisor, shall serve at the pleasure of the Authority and in its opinion the lAuthority shall have the power to terminate employment. The Supervisor, in Iladdition to the other duties imposed in this Section, shall have 1) Authority to I },transfer any employee from the garage operation or the meter operation in i such manner that the duties of the Parking Authority are complied with fully; I2) Shall prepare detailed recommendations for the Authority in such matters as (a) establishing hourly rates on all parking meters and (b) proposing change in present regulations; 3) To prepare and constantly update a manual of operation so that each employee is completely aware of his responsibilities, and such manual shall set forth working hours, vacation time, overtime pay, and, upon approval by the Parking Authority, these rules shall be the operating llprocedure; 4) To determine the hours of operation of the parking garage. ►Any employee required to work more than the regular forty (40) hour week j'shall be paid at an hourly rate of 1-1/2 times his regular wage and shall be `paid for only those hours actually on duty and all such overtime must be +I submitted in voucher form to and be approved by the Supervisor. f Ii -2- I ►� I �f 4� iI I s I� Section 9. All receipts and parking tickets issued in the parking !garage shall. bear an entrance and an exit time stamp and shall be retained by lithe Parking Authority Supervisor until the general city audit has been completed, ;hand upon notice of the accounting firm compiling the audit that the tickets are i; no longer required they may, at the discretion of the Supervisor, be destroyed. IlAt the close of each day, all tickets and bank deposit receipts are to be I'Idelivered to the Supervisor who shall audit and confirm the deposit and all I1tickets must be accounted for. If a ticket is lost the attendant shall prepare a l 11lost ticket voucher showing time-in, time-out, the state license number and IlIthe amount charged and such ticket is to be signed by the parking customer. Section 10. Careless and Reckless Driving within Municipal Parking Garage or on City Parking Lots. It is hereby declared to be unlawful for any person to operate a motor vehicle within the premises of Municipal Parking Garage, or on a City operated lot, in a careless and reckless manner. Careless and reckless manner is defined as such a manner as to indicate a willful disregard for the safety of persons or property within the Municipal Parking Garage, or on the City owned Parking Lots. Section 11. Improper Parking - Removal of Vehicle. It is hereby declared -to be unlawful for the operator of a motor vehicle to park the same within the Municipal Parking Garage, or on a City operated parking lot, in such manner as to obstruct or interfere with the movement and operation of other motor vehicles, and any motor vehicle parked in such manner as described above shall be towed away at the expense of the owner thereof. Any unauthorized vehicles will be towed away at the owners' expense. The Authority is empowered to use a "wheel immobilizer" for cars which cannot be towed and a charge of five ($5. 00) dollars shall be paid by vehicle owner before removal. Such charge shall be in addition to the regular charge for unauthorized parking. l' Section 12. Damage to or Destruction of Garage. It is hereby declared unlawful for any person to damage, in any manner whatsoever, any portion or j part of the Municipal Parking Garage, City Parking Meters, or City operated i Parking Lots, or any of the facilities, equipment or apparatus of any kind or description located thereon. Section 13. Failure to Pay Parking Fees. It is hereby declared unlawful for any person to operate any motor vehicle from the Municipal Parking (Garage without first paying the attendant on duty the amount due the City for the }period of time the motor vehicle was parked with the Garage; provided that this Section shall not apply to holders of currently valid parkards. Rental on Lots shall be be paid quarterly and if not paid in advance the space shall be vacated on the first day of the month when payment was due. I , I' -3- I j . �j i' i 1 i Section 14. Attendants, Conservators of the Peace, Oath, Powers. Am ;Each attendant shall be a conservator of the peace while on duty and shall have lithe same power as a policeman of the City, and may arrest any person observe H Tin violation of any provisions of this ordinance. �1 Upon making an arrest of any person within the Garage, o City operated Parking Lot, as provided above, the attendant shall immediately jcontact the Police Department and place the person arrested in the custody of 11 a City Policeman. +� Each attendant, before entering the discharge of his dutie , 11shall take the same oath as is administered to Policemen of the City by the `Police Judge, before the Police Judge or his qualified and appointed substitute. Section 15. Holidays. The following legal holidays will be observed land on these days parking meters will be free: Christmas, New Year's Day, Memorial Day, July 4th, Labor Day, Veteran's Day and Thanksgiving Day. Section 16. No parking bag fees for construction, renovation, etc. , shall be at the rate of one ($1. 00) dollar per day, and such fee shall be charged until parking bag is returned to the Parking Authority Office. The Supervisor 'shall be authorized to waive these fees for specific purposes such as church funerals or extenuating circumstances. Section 17. Penalty Clause. Anyone violating any of the terms of iithis Ordinance shall be deemed guilty of a misdemeanor, and upon conviction 11thereof, shall be punished by a fine of not less than one ($1. 00) dollar, nor ii more than one hundred ($100. 00) dollars. Section 18. Upon establishment of the Parking Authority there shall i i,be prepared by the Authority a balance sheet showing the assets and liabilities Iof the Parking Authority. Thereafter, as the Mayor and City Council may `ldirect, but not less than semi-annually, the Authority shall have prepared an income statement and balance sheet in accordance with accepted accounting practices. Section 19. Effective Date.
