BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON AS FOLLOWS: Section 1. The Mayor and City Clerk of the City of Jefferson ' Missouri are hereby authorized and directed to execute a contract lifor and behalf of the City with the Mid-Missouri Regional Planning Commission for a period of one year commencing on the first day of June, 1974 and ending on the thirty first day of May, 1975 for a total consideration of Eleven thousand, four hundred i ' ($11,400. 00) as more fully set forth in Exhibit "A" attached to this ordinance and incorporated herein as though fully set forth. I Section 2. This Ordinance shall be in force and take effect from and after its passage and approval. Passed Approved G� r PrVdbht of a unci Lyo V Attest: City Clerk i +I i I I 1 CITY PLANNING SERVICES CONTRACT MID-MISSOURI REGIONAL PLANNING COMMISSION and CITY OF JEFFERSON CITY, MISSOURI THIS AGREEMENT, entered into this 1st day of June 1974 by and between the Mid-Missouri Regional Planning Commission, hereinafter referred to as the "Planning Agency" and the City of Jefferson City hereinafter referred to as the Municipality". The Mid-Missouri Regional Planning Commission has principal offices located at 830 East High Street, Jefferson City, Missouri. WHEREAS, it is the intention of the Planning Agency to use the funds provided for by the City of Jefferson City; NOW THEREFORE, in consideration of the foregoing and of the mutual covenants and agreements hereinafter set forth, the parties hereto, and legally intending to be bound thereby, do covenant and agree for themselves and their respective successors and assigns as follows: ARTICLE I EMPLOYMENT AND DUTIES OF THE PLANNING AGENCY (a) The Municipality hereby agrees to engage the Planning Agency and the Planning Agency hereby agrees to do, perform, and carry out, in a professional manner as set out in services set forth in "Scope of Services" as defined in the attached Appendix A (which is appended hereto and made a part of this contract). (b) The Planning Agency shall perform all the necessary services provided under this contract in connection with and respecting the following Municipality and the area, or areas herein called the "planning area": All of that area lying within the corporate limits of the City of Jefferson City, Missouri, and any adjoining area or areas that may directly affect the planning of the city. (c) The Planning Agency will furnish a professionally qualified person or persona who shall be called the Planners-in-Charge. All of the services required hereunder shall be performed by the Planners-in-Charge or under their direction. The Planners-in-Charge shall furnish personal services and time in the amount necessary to accomplish effectively the planning work proposed in this contract. The Planning Agency shall secure at its own expense all personnel required to perform the services under this contract. The Planners-in-Charge of the work program covered by this Contract shall be Robert C. Simonds and/or Darrell K. Danner, each of whom is approved under the State of Missouri Planning-in-Charge requirements. (d) None of the work or services covered by this contract shall be subcontracted without prior written approval of the Planning Agency and the Municipality. Page 1 of 3 pages ARTICLE II MUNICIPALITY (a) The Municipality agrees to make available to the Planning Agency all maps, records and data on file that will assist the Planning Agency in the discharge of the services herein contracted. (b) The Municipality, its officials and employees and the members of the Municipality's Planning Commission shall cooperate with the Planning Agency in the discharge of their responsibilities under this contract and will be available for consultation with the Planning Agency at such reasonable periods as not to conflict with their own responsibilities. (c) The Municipality agrees that the services of the Municipality's Attorney shall be used in preparing zoning and subdivision changes in the form of ordinances and/or regulations in accordance with applicable State Statutes and local legal requirements and in a form suitable for adoption by the City's Governing Body. (d) It is agreed between the parties that the Municipality shall cause to be paid to the Planning Agency the sum of $11, 400. 00 which monies represent the contribution by the Municipality for its portion of the planning service. The contribution provided herein shall be paid by the Municipality to the Planning Agency on a monthly basis in equal amounts of $950. 00/month commencing with the first month. ARTICLE III EQUAL EMPLOYMENT OPPORTUNITY In carrying out the project work the Planning Agency will not discriminate against any employee or applicant for employment because of race, `sex, religion, color or national origin. The Planning Agency will take affirmative action to insure that applicants are employed, and that employees are treated during employment, without regard to their race, sex, religion, color or national origin. Such action shall include, but not be limited to the following: employment, upgrating, demotion, or transfer, recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Planning. Agency agrees to post in conspicuous places, available to employees and applicants for employment notices to be provided by the Planning Agency setting forth the provisions of this nondiscrimination clause. The Planning Agency will, in all solicitations or advertisements for employees placed by or on behalf of the Planning Agency, state that all qualified applicants will receive con- sideration for employment without regard to race, sex, religion, color or national origin. The Planning Agency shall include similar provisions in all subcontracts for services covered by this contract. ARTICLE IV INTEREST OF MEMBERS OF PLANNING AGENCY AND OTHERS No officer or employee of the Planning Agency or member of its governing body who exercises any function or responsibility in connection with the under- taking or carrying out of the project shall, prior to the completion of the project, voluntarily acquire any personal interest, direct or indirect, in any contract or proposed contract in connection with the project. If any such member, officer, or employee presently has, or in the future involun- tarily acquires any such personal interest, he shall immediately disclose r Page 2 of 3 pages such interest to the Planning Agency. Upon such disclosure such member, officer or employee shall not participate in any action by the Planning Agency affecting the carrying out of the project. The Planning Agency shall promptly advise the Municipality of the facts and circumstances concerning any disclosure of interest made to it pursuant to this paragraph. No official or employee of the Planning Agency and no official or employee of the Municipality or of its governing body and no other public official of the locality or localities in which the project is situated or being carried out who exercises any functions or responsibilities in the review or approval of the undertaking or carrying out of the project shall, prior to the completion of the project, voluntarily acquire any personal interest, direct or indirect, in any contract or proposed contract in con- nection with the project. ARTICLE V COPYRIGHT No reports, maps or other documents produced in whole or in part under this contract shall be the subject of an application for copyright by or on behalf of the Planning Agency. ARTICLE VI OFFICE SPACE The Planning Agency hereby agrees to make available to the Municipality the space needed for carrying out this city planning service. The space shall be furnished only with available furniture and shall not include special equipment. ARTICLE VII TIME OF PERFORMANCE The services of the Planning Agency are to commence on June 1, 1974 for a period of (12) twelve consecutive calendar months and end on May 31, 1975. IN WITNESS WHEREOF, the parties hereto have executed this agreement the day and year first above written. To attend all city planning commission meetings. To act in the capacity of the city's advisor on all matters that would normally come before the planning commission. To make such written reports as may be needed on the matters referred to the planning commission. To review and report on subdivisions and zoning requests for council action. 2. To attend City Council meetings and act as counsel and advisor on matters of planning relative to the city. To make written reports on matters affecting the city at present and in future years. To present materials which may be requested by the City Council and give reason for planning decisions. 3. To be available and on call to advise the city relative to matters of planning as well as to work with citizen requests about planning program and matters of subdivision and zoning. 4. To review the city's comprehensive plan with the intent toward updating areas of it- which have changed or for which changes and revisions are needed. To coordinate those areas of the comprehensive plan with the purpose of preparing capital improvements programs in connection with the needs of the city. 5. In all matters to coordinate with the other city departments which have direct or indirect effects upon the city planning functions. 6. To assist as spokesman on the city's planning and development. To speak to interested citizen groups and coordinate the city's various studies such as the riverfront study, renewal program, parks and recreation program, Missouri Boulevard project, , transportation plan and city beautification plan to name a few but not limited only to these named.
