AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING ORDINANCE
NO. 8608 RELATING TO THE COLLECTION, REMOVAL, TRANSPORTATION AND
DISPOSAL OF GARBAGE AND TRASH FROM PREMISES WITHIN THE CITY BY
ADDING THERETO AN ASSIGNMENT OF THE CONTRACT THEREIN CONTAINED TO
DAS DISPOSE-ALL SERVICE, INC. , A. MISSOURI CORPORATION, AND AUTHORIZ-
ING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE SAID ASSIGNMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS �FOLLOWS:
Section 1. Whereas, the Mayor and City Clerk of the City
of Jefferson were authorized and directed to execute a contract and
dial execute a contract on behalf of the City of Jefferson with Clyde
IGarvin relating to the collection, removal, transportation and the
disposal of garbage from the premises within the City of Jefferson.
Section 2. Whereas, said Clyde Garvin has advised the City
that due to ill health, he desires to assign his contract with the
City to DAS Dispose-All Service, Inc. , a Missouri corporation.
Section 3. Whereas, DAS Dispose-All Service, Inc. , a
Missouri corporation, has expressed the desire to accept the assign-
ment of said contract.
Section 4. Ordinance 8608 is hereby amended to contain a
new provision to be known as Section 17 of Ordinance 1608 and said
provision shall read as follows:
Section 17. Assignment.. In mutual consideration each
received from the other, this contract is hereby .assigned
from Clyde Garvin and the City of Jefferson to DAS -Dispose-
All Service, Inc. , a Missouri corporation, and DAS Dispose
All Service, Inc. , hereby accepts said assignment. DAS
Dispose-All Service, Inc. , has or will pledge this contract
as partial collateral for a loan from First Missouri
Development Finance Corporation, a Missouri corporation.
In the event of the failure of DAS Dispose-All Service, Inc. ,
to repay said loan according to its terms then First Missouri
Development Finance Corporation may substitute an operator
to perform said contract for the balance of its term but only
with the consent of the City of Jefferson, which shall not be
unreasonably withheld. All rights and liabilities under this
contract shall remain in full force and effect as though the
contract was originally entered into between the City of
Jefferson and DAS Dispose-All Service, Inc. This assignment
shall be effective on the 15th day of July, 1974.
IN WITNESS WHEREOF, the parties to this assignment
have hereunto executed the same this d'day of July,
1974.

Section 5. This ordinance shall take effect and be in
force as of July 15, 1974, from and after its passage and approval,
