ORDINANCE NO. 11. 72
: . AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
. -MAYOR AND THE CLERK OF THE CITY OF JEFFERSON TO EXECUTE A CONTRACT
WITH THE HOUSING AUTHORITY OF THE CITY OF JEFFERSON AND THE
JEFFERSON CITY SCHOOL DISTRICT, FOR THE FUTURE PURCHASE OF CERTAIN
REAL .PROPERTY LOCATED ALONG THE NORTH AND SOUTH SIDES OF MILLER
STREET BETWEEN ADAMS AND JACKSON STREET.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
-Section' l. The Mayor and City Clerk of the City of Jefferson,
are 'hereby authorized and .directed to .execute a contract with the:
Housing'_Authority of the City of Jefferson and the Jefferson City..
''.`:School District providing for the, future purchase of certain real
property ,located' alon' the north az'4 south sides of Miller Street
between Adams and Jackson Street '.for the sum of $66,.000.00; all
as more fully set forth in an Agreement attached hereto and
marked Exhibit A and made a part hereof as though fully set forth
herein.
Section 2.... This otdinance shall take effect and be in

AG- REEMENT
This agreement made and entered into this day of
A �; � , 1974 , by and between the Housing Authority
of the City of Jefferson, Missouri, hereinafter referred to as
the "Authority, " and the City of Jefferson, Missouri, herein-
after referred to as the "City, " and the Jefferson City School
District, hereinafter referred to as the "District. "
WITNESSETH:
WHEREAS, the Authority has acquired certain real property
Located along the north and south sides of Miller Street between
Adams Street and Jackson Street in Jefferson City, Missouri, more
particularly described on the schedule hereto attached,. said. pro--
perty being located within the boundaries of an Urban Renewal
project designated Progress Project :Mo. R-45F and ,•
WHEREAS, said property has been designated .in .the -plan. for
said Urban Renewal project as public use, and ..
- WHEREAS, it is the desire of the parties hereto that the
District should have the use of said property` -for school .purposes
so. long as it desires and that the City shall have the use of
such property after it is no longer needed by the District.
NOW, THEREFORE; . it is agreed by and between the parties:

1. The Authority agrees and binds itself to sell said .pro-
perty to the District for the' price of Sixty-six Thousand Dol-
tars ($66,000.00) and the District agrees to buy the property
from the Authority for such. price, said property being described
as follows:

Housing Authority Disposition Parcel
P-4A being all of Inlots. 617, 618 , 619 ,
and 620. Subject to a 60 ft. wide storm
drainage easement, the centerline of which
lies between a point located 160.1 ft.
northerly, along the westerly right-of-way
of Jackson Street, from the southeast cor-
ner of Inlot 620; and a point located 135.7
ft. westerly, along the northerly right-of-

way of Miller Street, from the southeast
corner of Inlot 620 in the City of Jefferson,
County of Cole, State of Missouri.
Tract B:
Ail of the Inlots 728 , 729 and the
westerly 52.2 ft. of Inlot 730. Subject
to a 60 ft. wide storm. drainage easement,
the centerline of which lies from a point
203.3 ft. westerly, from northeast corner
of Inlot 731, along the southerly Miller
Street right-of-way; thence along .a line
deflecting to the right, from aforesaid
right-of-way, 130° 17 ' for a distance of' t
128 .1 ft; thence along a line deflecting
to the right from aforesaid line 14° 46 '
for a distance of 160 .0 ft. to a point
along the westerly line of, and 9 .4 .ft.:, '
northerly from the southwest corner of
Inlot 728 in the City of Jefferson,
County of Cole, State of Mi.ssouri.'
2. The Authority will convey such property to. the Dis-
trict free . and clear of encumbrances by special warranty deed
upon ,the .payment" of the purchase price, and will either deliver
to the District Abstracts of Title showing good title to be
vested in the .Authority or will . deliver to the District title
insurance assuring ,good title to the District.
3... The purchase price shall be paid as follows: July 1,
1974 -- one-half (1/2) in cash; July 1, 1975 -- one-half
in cash.
4:_ The District represents that it intends to use said
property for school purposes principally in .connection with
'Simonsen. Junior High School and Freshman High School, both.of,
:
which are located in close proximity to the property.
5.. The: District agrees that at "such time as conditions;,
within the City of Jefferson determine that: both.. Simonsen and
Freshman High School locations are no longer. used for school
purpos.ea, it will sell said property to. the City for the price'
it paid ,therefor as above set forth and the .City agrees to buy ,
such. property from the District at such time for such price;
it being understood that, in such event,the District shall have-
the right to remove any improvements or facilities on said pro-
perty prior to sale to the City or, at District' s option, be reim-
bursed for the depreciated value of any such improvements.
6. The closing of this transaction of purchase and sale
between the Authority and District shall occur at such time 'as:
the Authority shall have cleared the property which shall be as
soon as- practicable hereafter.
IN WITNESS WHEREOF, the partie.s have execiited 'this- agreement,
