L.3 INTRODUCED BY COUNCILMAN ORDINANCE NO. g G 80 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND THE CLERK OF THE CITY OF JEFFERSON TO EXECUTE A CONTRACT WITH THE HOUSING AUTHORITY OF THE CITY OF JEFFERSON, FOR THE PURCHASE AND SALE OF CERTAIN REAL PROPERTY LOCATED WITHIN THE URBAN RENEWAL PROJECT, DESIGNATED AS PROGRESS PROJECT, MO. R-45. NOW,.THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON`, MISSOURI, AS FOLLOWS: AM lSection .l. The Mayor and City Clerk of the City of Jefferson are hereby authorized and directed to execute a contract with the Housing Authority of the City of Jefferson providing for the purchase of certain realproperty located along the south side of McCarty Street between Adams and Jackson Street for the sum of • $20,000.00, and `for the sale of certain property located at the intersection of Missouri Boulevard and Rex Whitton Expressway for $85,000`000; all as more fully set forth in an Agreement attached hereto and- marked Exhibit .A and.made a part hereof. as though fully :. set' forth..herein. Section 2. This ordinance shall take effect and be in force from and after its passage and approval. Passed. . Approved. Psi de o t e oun Ma r Attest: . , City Clerk AGREEMENT This agreement made and entered into this day of 1974, by and between the Housing Authority of a City of Jefferson, Missouri, hereinafter referred to as the "Authority", and the City of Jefferson, Missouri, herein- after referred to as the "City" . WITNESSETH: WHEREAS, the Authority has acquired certain real property located along the. south side of McCarty Street between Adams Street and Jackson Street in Jefferson City, Missouri, more particularly described hereinafter, said property being located within the boundaries of an Urban Renewal project designated Progress Project Mo. R-45 , and WHEREAS, said property has been designated in the plan for said Urban Renewal project as public use, and WHEREAS, it is the desire of the parties hereto that the City should acquire said property for the purpose of constructing a fire station, and WHEREAS, the present main fire station of the City, which is located at the intersection of Missouri Boulevard and Whitton Expressway,-,is .designated to be acquired by the Authority. in the execution of said project, and NOW,. THEREFORE, it is agreed .by and between the parties as follows: . 1. The Authority agrees and binds itself to sell the follow- ing described property to the City' for the price of Twenty Thousand Dollars ($20',000.00) , and the City agrees to buy the . property from the Authority for. such price, said property being . described as follows: All of the Inlots 613, 614 and the westerly 50 ft. of Inlot 615. 2. The Authority will convey such property to the City free and clear of encumbrances by special warranty deed, and will deliver to the City Abstracts of Title showing good title to be vested in the Authority. 3. The City agrees to sell to the Authority the present main fire station property located at the intersection of Missouri Boulevard and Whitton Expressway for the sum of Eighty-five Thou- sand Dollars ($85,000.00) , and the Authority agrees to buy said property from the City for said sum. 4. The City will deliver said property to the Authority upon completion of the new fire station upon the property herein- above. described which is being purchased by.the City from the Authority. 5.. . It is agreed that the Authority will convey the property hereinabovs -described to the City upon the execution of this agreement, so that the City may proceed with the construction of the new fire station, and it is further agreed that when the new fire, station is completed the City will convey the old fire station property to the Authority, at which time the Authority will pay to the City the sum of Eighty-five Thousand Dollars (.$85',000.00) and the City will pay, to the Authority the sum of Twenty Thousand Dollars ($20,000.00) , in full payment of .the respective purchase prices.
