HomeMy Public PortalAbout2008-08-05 PC Minutes VILLAGE OF PLAINFIELD PLAN COMMISSION MEETING RECORD OF MINUTES DATE : AUGUST 5, 2008 LOCATION: Village Hall Chairman Sobkoviak cal led the m eeting of the Plan Commission to order at 7:37 p.m. after adjourning the Zoning Board of Appeals meeting. ROLL CALL: Present: Commissioners , Renzi, Bonuchi, and Sanders; ex -officio Commissioners Peck and Fremarek; and Chairman Sobkoviak Absent: Commissioner s Kachel, McKay , and O’Rourke , Plainfield School District , Plainfield Park District, Plainfield Fire Pr otection District, Library District, and Plainfield Police Department Also Present: Michael Garrigan – Village Planner Village of Plainfield, Sara Leach – Planner I Village of Plainfield, Sara Javoronok – Planner I Village of Plainfield, and Carol Millan – Secr etary Village of Plainfield MINUTES: The minutes from the Plan Commission Meeting of July 15, 2008 were accepted as presented. Chairman Sobkoviak announced the resignation of Commissioner Linsey McKay. He wished her luck and thanked her for all of her hard work . He further stated possibly her experience and know how can be utilized in the future to work on short term commissions, etc. within the Village. DEVELOPMENT REPORT: Village Planner Garrigan summarized the results of the August 4, 2008 Vill age Board Meeting NEW BUSINESS: CASE: 1407 -061908.SU HERITAGE CENTER Request: Special Use (Public Hearing) Location: 24023 W. Lockport Street Applicant: Carl Bryant TIME: 7:45 p.m. Planner Javoronok summarized the staff report. She state d this is a public hearing and all notices have been posted and published per Village ordinance and State Statute. This is a request for a special use for a religious meeting place for the First Baptist Church of Plainfield in the B -5 Zoning District. Th e Church has used the facility for approximately one year and was previously located next to this site before it was demolished. This is a tem porary facility for the Church. At this time, they do not know how long the use will be. The possible parking i ssue is alleviated by the hours of service and the presence of off and on -street parking near the site. She went through the different locations for opportunities for parking. Village of Plainfield Plan Commission Minutes August 5, 2008 Page 2 of 4 Planner Javoronok went through the two findings of fact for a special use pe rmit. She found 2 of the 2 findings favorable. Staff recommends approval of the special use for the First Baptist Church of Plainfield for a period of five years and renewal will be subject to approval by the Village Board. Chairman Sobkoviak swore in t he Petitioner, Carl Bryant. He asked Petitioner Bryant if he wanted to add anything to the staff report. Petitioner Bryant said he did not want to add anything. Commissioner Peck asked Petitioner Bryant if there were any complaints from any neighbors or anyone about having this Church utilizing this facility. Petitioner Bryant stated there were no complaints . Chairman Sobkoviak stated it should be noted that the Church used to be on the corner. Chairman Sobkoviak asked if there was anyone in the audie nce who cared to ask a question or make a comment. Lynn Reichert was sworn in by Chairman Sobkoviak. She stated they own the building across the street from this building on Illinois Street . She read a statement. She was concerned that the Plainfield M oose, also a non -for -profit organization which was formerly located in the downtown area , was turned down for the very same variance being discussed this evening. She felt it was unfair that the Petitioner Carl Bryant spoke out against the Moose locating in the Reichert’s building because of parking issues and the need to bring more retail to the downtown. She further stated those issues do not seem to be a concern to him now. She stated it is time to keep personal issues and favoritism out of the Villag e decision making. It not only hurts the downtown community, but it is not fair to the dedicated members of these organizations . There was no further response from the audience. Chairman Sobkoviak asked Planner Garrigan if the question of the Moose loca ting in the downtown area come before the Plan Commission; and if so, what was the Plan Commission’s recommendation. Planner Garrigan stated in his recollection it did go to the Plan Commission with regards to the proposed Special Use and his rec ollection was that staff and the Plan Commission did recommend support of that Special Use for the Moose. There was a discussion of the issues regarding the Special Use for the Moose by Commissioner Renzi and Bonuchi. At 7:55 p.m. Commissioner Sanders made a mot ion that th e Plan Commission recommend approval of the Special Use for the First Baptist Church of Plainfield subject to the following stipulations: 1. Compliance with the requirements of the Village Engineer, 2. Compliance with the requirements of the Pla infield Fire Protection District, 3. That the Special Use permit shall be valid for a period of five years. Renewal of that Special Use shall be subject to approval by the Village Board. Commissioner Bonuchi seconded the motion. Chairman Sobkoviak calle d for a vote by roll call. Aye: Bonuchi, Sanders, Renzi, Chairman Sobkoviak Nay: 0 The motion is carried 4:0 Village of Plainfield Plan Commission Minutes August 5, 2008 Page 3 of 4 CASE: 1408 -070108.RZ VAN DYKE ENTER Request: Rezoning (Public Hearing) Location: Van Dyke Center, 24317 143 rd Street Applicant: James D. Fiala TIME: 7:56 p.m. Planner Javoronok stated this is a public hearing and notice has been published and posted as required. This is a rezoning from I -2 to I -1 to allow for additional uses not currently allowed. This is located s outh of 143 rd Street and east of Van Dyke Road. Planner Javoronok went through the 5 findings of fact for a Rezoning. She stated 5 of the 5 findings of fact are favorable. Staff recommends approval of the rezoning from I -2 to I -1. Chairman Sobkoviak sw ore in the Petitioner, James Fiala. He asked Petitioner Fiala if he wanted to add anything to the staff report. Petitioner Fiala stated he did not have anything to add. Commissioner Renzi asked Planner Javoronok about the property to the west. He ask ed if that was the property that also was approved for the Pump It Up. Planner Javoronok stated it was. Commissioner Renzi also asked if the automotive parts store was in there also. Planner Javoronok stated that was correct. Commissioner Renzi asked i f those two uses would be allowed under the present zoning in the building presently before the Commission. Planner Javoronok stated that property was rezoned from I -2 to I -1 to allow the Pump -It -Up and the automotive would not have been allowed under I -2 . Commissioner Renzi stated this rezoning is basically to al low the petitioner to be compati ble with the other buildings. Planner Javoronok stated that was correct. Commissioner Renzi then asked Petitioner Fiala if he needed the rezoning in order to be compatible and get a tenant under the present economic conditions. Petitioner Fiala said that was correct. Chairman Sobkoviak asked if there was anyone in the audience who cared to ask a question or make a comment. There was no response. Commissioner P eck stated he was pleased to provide property owners with the tools to be successful in town, whether it is to be more marketable to get a tenant, etc., as long as it is not hurting other adjoining property owners. He asked if there were any objections fr om other property owners. Petitioner Fiala stated there were no objections. At 8:05 p.m. Commissioner Bonuchi made a motion that the Plan Commission recommend approval of the request to rezone the Van Dyke Center at 24317 W. 143 rd Street from I -2 (Genera l Industrial) to I -1 (Office, Research, and Light Industrial) subject to the following stipulations: 1. Compliance with the requirements of the Village Engineer, 2. Compliance with the requirements of the Plainfield Fire Protection District. Commissioner Sanders seconded the motion.
