ROLL CALL: Present: Commissioners Kache l, Renzi, O’Rourke, Bonuchi, Sanders , Peck , Chairman Sobkoviak , and e x officio Commissioner Fremarek Absent: Plainfield School District, Library District, Park District, Fire District, and Plainfield Police Department Also Present: Michael Garrigan – Vil lage Planner Village of Plainfield, Jonathan Proulx – Planner II Village of Plainfield, and Carol Millan – Secr etary Village of Plainfield APPROVAL OF MINUTES: The minutes from the October 7, 2008 meeting were accepted as presented. DEVELOPMENT REPORT: Village Planner Garrigan gave the status of cases that were presented to the Village Board at their meeting on Monday, October 20, 2008. Chairman Sobkoviak read a letter to Sara Leach being sent to her on behalf of the Plan Commission to thank her for her work. OLD BUSINESS: CASE: 1421 -082208.RZ 15124 S. ROUTE 59 Request: Rezoning to BTD Location: 15124 S. Route 59 Applicant: Rick Sexton This case was to be continued to the next Plan Commission meeting on November 4, 2008. Chairman Sobkoviak aske d staff if this continuance was requested by the petitioner. Village Planner Garrigan stated it was. At 7:10 p.m. Commissioner Bonuchi made a motion that the Plan Commission continue the public hearing and discussion on Case 1421 -082208.RZ to November 4, 2008. Aye: O’Rourke, Bonuchi, Sanders, Peck, Kachel, Renzi, Chairman Sobkoviak Nay: 0 The motion is carried 7:0 CASE: 1428 -092908 RT. 30 ENHANCEMENT GUIDELINES Request: Rt. 30 Corridor Enhancement L ocation: Rt. 30 Corridor Applicant: Village of Plainfield TIME: 7:13 p.m. Village Planner Garrigan stated staff has brought this matter before the Plan Commission for input on a set of guidelines, which staff hopes to have the Village Board approve by a Resolution. These will be guidelines for the Rt. 30 Corridor between Renwick and the Interstate. Staff believes that the current development tre nds along that corridor dictate certain redevelopment of that corridor. There are two potential major develo pments in that corridor. The guidelines attempt to basically lay out a set of design criteria, which staff can work with future commercial applicants to incorporate many of the se guidelines. These guidelines not only address signage, but also architectur e, landscaping, site planning location issues, etc. Clearly, the corridor needs some type of a generation of new development along it based on its current condition. In many ways, this corridor could be defined, with the exception of two major auto sales business, somewhat as blight. It is almost the definition of blight; and therefore, staff believes there are opportunities for redevelopment. That redevelopment should be completed in a manner consistent with the higher standards established along the R t. 59 corridor. Chairman Sobkoviak asked if there was anyone in the audience that cared to ask a question or make a comment. There was no response. Commissioner Sanders wanted a clarification on Page 3 . He liked the use of the colored boxes to emphas ize certain material. He stated on Page 3 it references that Rt. 30 extends as a major north -south arterial roadway. He asked if it was an east -west roadway. There was a discussion among the commissioners. Chairman Sobkoviak stated even numbered highwa ys are east -west. Village Planner Garrigan stated that could be changed to east -west . Commissioner Kachel asked about the electrical area on Rt. 30 by the car wash. He stated that was one of the biggest eye sores in the area. Village Planner Garrigan s tated it is not going anywhere, but he stated possibly some landscaping or some type of soft or hardscape treatment around the perimeter. There are presently no plans to do that . There are no plans to incorporate or implement these guidelines until some challenges such as this are addressed. A discussion followed. Commissioner Sanders asked why on Page 10 the 2000 census figures were used instead of the recent figures. Village Planner Garrigan stated the document could be updated with the new figures. Commissioner O’Rourke asked if the Boulevard Project was consistent with these guidelines. Village Planner Garrigan stated some of the guidelines were premised on what the Boulevard proposed. Commissioner O’Rourke asked about the road improvements for Rt. 30 from Rt. 55 to Renwick and if there is anything north of Renwick to Rt. 59. He asked what happens to the traffic. Village Planner Garrigan stated long term there are hopes to make it a 4 lane profile, except for a section Village of Plainfi eld Plan Commission Minutes October 21, 2008 Page 3 of 8 between Renwick and Rt. 59. There may be some limitations along the area bordering the Rookery. There will continue to be some challenges regarding congestion and traffic flow. There was a discussion between the Commissioners about traffic . Commissioner Renzi asked if the le ft turn on Renwick should be included in this document. Chairman Sobkoviak stated that is a topic that has had much debate in the Village. He stated the guidelines presented in this package are only valid for th e area from Renwick south to I -55. Once a decision is made as to the final routing of Rt. 30, this issue can be taken up at that point. A discussion followed among the Commissioners regarding the routing of Rt. 30 . Commissioner Sanders stated he read this document as being the Lincoln Highway Hi storical Corridor portion of Rt. 30 Village Planner Garrigan stated the corridor between Renwick and the Interstate is where this document focuses. He stated the document does recognize there are a couple of potential long term considerations from Rt. 3 0. He did not think the plan really focuses on what the long term configuration of Rt. 30 would be. Village Planner Garrigan stated t he document does try to address, regardless of what the final configuration of Rt. 30 will be, future congestion and the fact that future commercial will attract additional traffic. Commissioner Renzi referred to Page 13 which talks about enhanced roadway capacity and the fact that the congestion is particularly bad at the intersection of Rt. 59. Commissioner Fre marek st ated on Page 9 it states the area of focus shall be the portion east of IL Rt. 59, stretching southeast to Interstate 55. He stated this document is clearly saying Rt. 59 instead o f Renwick . There also were references to the configuration of the Gotane G as station and re -doing the intersection. He stated they all need to be on the same page. Commissioner Renzi stated there needs to be a paragraph that says we have yet to address the lack of funding for the widening of Renwick Road and the option of mo ving left along Renwick to Rt. 30. These two traffic configurations and the impact on traffic needs to be assessed when defining future traffic flow to the south. Commissioner O’Rourke felt someone needs to come forward to say if we cannot decide whethe r its Renwick or Rt. 30 that gets widened, someone needs to put a proposal forward and say this is what is thought to be the best scenario. Chairman Sobkoviak stated there are other options also. Commissioner O’Rourke felt they should be part of the docu ment. Commissioner Sanders stated the purpose of this document is to basically set the attraction of new businesses and the re -development of others and not to address what is typically in the Comprehensive Plan, which is the transportation plan on Rt. 30 . Village Planner Garrigan stated the document addresses redevelopment of the corridor regardless of what the ultimate configuration of Rt. 30 might be . Commissioner Renzi felt there should be some sort of a recognition somewhere that there is going to be increased traffic and there is going to be a need to address it. Village Planner Garrigan stated staff can acknowledge in the document that there are open questions. Chairman Sobkoviak asked the other Commissioners if they were in agreement. The oth er Commissioners concurred. Commissioner Kachel asked if IDOT has the plans completed on Rt. 30. Village Planner Garrigan stated IDOT has long term plans for the improvements. There is just no funding to build it. Commissioner Kachel asked why the Comm ission could not look at that before it is all said and done. Village Planner Garrigan stated there is no reason why the Commission could not. He stated though the Commission’s ability to modify the plans are somewhat limited unless the Village wants t o contribute the additional money to go above and beyond. Commissioner Kachel stated other cities have done that. He further stated once IDOT has completed their engineering and stuff, the Village cannot change it at that point . He felt it was really im portant to the Village that before a plan is finalized, the Village has a chance to review it. That way it is brought into the Plan Commission and discussed and the public can hear it. Chairman Sobkoviak stated staff is going to add a paragraph to addres s the Commission’s concerns regarding the improvement of Rt. 30. Commissioner Fremarek referred to Page 17 – the document stated “The pictures at the right, and they are on the left. Commissioner Sanders had a suggestion on Page 23 – He asked if possibl y the box titled Threats should be labeled Detractions. Commissioner Renzi referred to Page 14 – He referred to the sentence “The existing corridor offers a blighted appearance” He thought possibly the word “blighted” could be changed to outdated or some thing like that. Village Planner Garrigan explained that if there is ever any opportunities for a Tax Increment Finance District, which would perhaps subsidize some of these improvements, the magical word that would be used, from a statutory perspective, is blight. Commissioner Renzi asked Village of Plainfi eld Plan Commission Minutes October 21, 2008 Page 4 of 8 if they could put something in parenthesis like , according to today’s standards. Village Planner Garrigan stated that could be done. Commissioner Fremarek disagreed with Commissioner Sanders in changing the word thr eat. He stated that is a basic SWO T analysis that is done at a lot of business levels. There are strengths, weaknesses, opportunities, and threats. Every compa ny and business out there does SWO T analysis. Commissioner Sanders referred to Page 31 – He wanted to remove the word good and use a word that better creates a vision, such as quality, etc. Commissioner Bonuchi referred to Page 35 - She really liked the design of the stores with the way that they kind of fit around the parking lot with more of a pedestrian access . She thought that was really nice compared to the typical, conventional strip mall that a person sees everywhere. She also liked the reference to the Gotane station on Rt. 59 with som e kind of an entry way; some kind of welcoming s tructure on that corner because it is kind of an eye sore as it stands right now. She also referred to Page 70 – she also loved the idea of the different historical signage also. She liked the brick monuments versus just the plain old signs. She stated there are a lot of wonderful parts to this document. Chairman Sobkoviak stated the Gotane corner will probably look similar to the corner of Rt. 126 and Rt. 59. There was a discussion among the Commissioners about the Gotane corner monument and the mon ument at the corner of Rt. 126 and Rt. 59. Commissioner Kachel referred to Rt. 30 near Lily Cache where there used to be a toll booth. Commissioner Sanders referred to Page 80 where it states, “Currently traffic traveling north on Il Rt. 59 does not ha ve the option of turning right onto Lincoln Highway.” He stated it should read “traffic traveling north of Lincoln Highway does not have the option of turning left onto Rt. 59”. Village Planner Garrigan agreed . Commissioner Renzi referred to Page 62 – H e referenced the white block that references 4 Lane Urban Cross Section for Joliet Road. He asked if it is going to be four lanes. He suggested that should be taken out. Village Planner Garrigan sta ted that was a good point. It was his understanding it would be a 2 lane profile ultimately, but he would get clarification from the Traffic Engineer. Commissioner Renzi suggested that there could be a highlight on Renwick Road west and emphasize the other options that exist . They could be highlight ed in so me way on the map on Page 62. Chairman Sobkoviak stated it is not beyond the realm of possibility that even if Rt. 30 is re -routed to some place that is not even imagined at this time, that the roadway between Renwick and I -55 would probably wind up being 4 lanes anyway. Commissioner Sanders asked Village Planner Garrigan if he was looking for any kind of motion. Village Planner Garrigan stated basically staff was looking for input from the Plan Commission. Chairman Sobkoviak stated the Plan Commission can make a motion to accept these guidelines as amended with their comments. Commissioner Sanders stated that he and Commissioner Bonuchi attended a session in Lincolnwood. Lincolnwood did not have a document like this with guidelines for the highway tha t goes through their community. They had a dilemma because of the curb cuts and everything else. They were amazed at the guidelines that Plainfield does have. He stated he felt this is going to be an effective tool for staff to work with to potential ly reshape the redevelopment of that portion of an aged part of the entranceway to our community. Commissioner Bonuchi stated that was an excellent point. She felt it would also be helpful for developers as they come into the Village to have an idea what t he expectations are and what the overall vision of the area is. She would like to see a lot of changes made along that whole area. She complemented staff as there were many suburbs represented at the meeting that day that did not have anywhere near the k ind of materials that staff has put together and brought forward for the Plan Commission to work with. Commissioner Peck referred to Page 17 – He mentioned eliminating the minimal landscaping, gravel parking lots. He stated that would be a huge improve ment to that area. Chairman Sobkoviak asked if there were any references to cross access in the parking lot. Commissioner Bonuchi stated there is. Commissioner Peck stated staff has done a wonderful job with this document. This is a step in the right d irection. At 7:55 p.m. Commissioner Renzi made a motion that the Plan Commission accept the guidelines as amended by the Plan Commission and recommend that they be forwarded to the Village Board. Aye: Bonuchi, Sanders, Peck, Kachel, Renzi, O’Rourke, Chairman Sobkoviak Nay: 0 The motion is carried 7:0 Commissioner Sanders stated the Commission looks forward to the document addressing guidelines for Rt. 126 into Downtown Main Street to see the vision staff can come up with for that area also. He stated a lot of that is outside the municipal boundaries right now. Village Planner Garrigan stated staff is working on design guidelines for Main Street and Rt. 126 bo th east and west of Rt. 59. Commissioners Sanders asked if that would be all the way to I -55. Village Planner Garrigan stated yes eventually . CASE: 1429 -093008.TA TEXT AMENDMENT Request: Regulations regarding outdoor use in the downtown Location: Downtown Plainfield Applicant: Village of Plainfield TIME 7:57 p.m. Planner Proulx gave the staff report. He stated as a proposed text amendment to the Zoning Ordinance it is a public hearing and has been posted and published per State Statute and loca l ordinance. He stated this text amendment addresses certain outdoor uses in the Downtown, such as bistro -style outdoor dining within the public right -of -way on public sidewalks in the Downtown Area. The Zoning Ordinance presently does not address what u ses could be allowed within that public right -of -way. Staff believes these outdoor uses can provide vibrancy and vitality to the streetscape while enhancing the pedestrian environment and providing a unique shopping and dining experience. Staff had submi tted this to the Village Board at a Committee of the Whole meeting and received consensus support to allow outdoor uses. They had directed staff to proceed with the formal steps to implement this. There are three main steps to be taken by the Community D evelopment Department: prepare the text amendment to allow outdoor uses, prepare design guidelines to regulate the outdoor uses, and establish a permit process to implement the outdoor uses. D esign guideline s will be presented to the Commission at a late r date . T he Police Department may pursue modifications to the Municipal Code to address outdoor alcohol beverage service. Planner Proulx went through the provisions of the text amendment. He stated there are three parts, Zoning Ordinance amendment to a llow outdoor uses, set of design guidelines, and a permit process. He summarized the high points of each of the three parts. Staff recommends approval of the proposed text amendment to the Zoning Ordinance to establish regulations to permit certain outd oor uses within the public right -of -way in the B -5 Traditional Business District Zoning District. Chairman Sobkoviak asked if there was anyone in the audience that cared to ask a question or make a comment. There was no response. Chairman Sobkoviak star ted the discussion. He stated about 2 weeks ago he had the opportunity to be in Minneapolis. They have created a mall which is about 1 -1/4 miles long. He stated it is really a delightful place. He referred everyone to Page 3 of the staff report. He st ated staff recommends market style umbrellas and discourages allowing advertising on the umbrellas. He thought that advertising for various products, such as Pepsi or various alcoholic beverages, add to the ambience. He felt they should be allowed. Co mmissioner Sanders felt the quality should be considered for the umbrellas. Chairman Sobkoviak stated a lot of these umbrellas would be promotional items given by the distributors and they can be secured for a very low cost. This would be an inducement t o the proprietor to use that type of product. Commissioner O’Rourke stated that maybe that was the reason staff indicated they did not want that advertisement because it typically tends to be promotional material and maybe not be as high of quality as sta ff is looking for. Commissioner Sanders stated there should be a certain amount of authenticity and quality. He felt just prohibiting advertising needs some consideration. Commissioner Sanders also referenced another area of this type in another commu nity , and stated every day the businesses had to clean their area. Chairman Sobkoviak also stated the area he had visited in Minneapolis cleaned up their areas every Village of Plainfi eld Plan Commission Minutes October 21, 2008 Page 6 of 8 morning. Commissioner Sanders referred to Page 4 (d) Maintenance and Cleaning, and me ntioned that Planner Proulx had mentioned something about comply with Will County Board of Health Guidelines. Commissioner Sanders wanted to add that to (d) Maintenance and Cleaning, as well as add the word sanitary to the sentence, “The business owner sh all be responsible for cleaning the sidewalk weekly or as needed to assure the sidewalk is maintained in a clean and sanitary condition.” He also suggested that weekly might be changed to daily. Chairman Sobkoviak stated there might be a day when a busin ess does not use the outdoor area because they are closed or whatever, and would not need to clean the area that day. Commissioner Sanders stated that does not mean to wash it all into the storm sewers. Commissioner Peck supported Chairman Sobkoviak’s co mments regarding the umbrellas. He felt the businesses downtown have had a financial impact from completing the streetscape downtown and if they can use free Pepsi umbrellas, etc. that would be helpful to them rather than having them purchase $600 umbrell as, etc. Commissioner Peck also felt the plastic chairs should be eliminated for a safety reason and just restricted. They blow all o ver and can blow out into the streets in front of cars. He would hope the Commission would choose the language that pl astic chairs and tables are not allowed whatsoever. Commissioner Renzi felt that plastic chairs and tables should maybe not be done away with, but that they would be of high quality. Chairman Sobkoviak stated that could be a problem then because how do y ou objectively judge. Commissioner Renzi stated he has seen plastic that is of a higher quality than wood. A discussion followed between the Commissioners. He further stated staff could make the determination and then there could be an appeals process. Commissioner Sanders stated he thought there are industry standards for seating and those could be the guidelines. Commissioner Renzi reiterated that he thought there should be an appeals process. Commissioner Kachel asked if the permitting process wou ld include the umbrellas, chairs, tables, etc. Planner Proulx stated that staff is proposing that this is an annual permit process; and if it is a second time for a restaurant and there are no c hanges, it would essentially be a renewal. There would be a n annual opportunity to review how things have been working and if there have been any issues, etc. Chairman Sobkoviak stated staff proposes that the outdoor table and chairs be permitted to remain outdoors overnight. He stated there should be a sectio n in there for seasonal storage so when the season is over , things are put away in a timely fashion. Commissioner Bonuchi asked about the smoking ban and if it would cover people eating outside. Chairman Sobkoviak stated it is a State Law. Planner Proul x stated he thought it was the Police Department’s position that smoking would be prohibited. Chairman Sobkoviak believed the State Law says smokers have to be 15’ from the enclosure. A discussion followed between the Commissioners regarding the State La w for smoking . Commissioner O’Rourke asked if the 4’ clear path and 42” to the entranceway is consistent with the ADA requirements. Planner Proulx stated it is consistent with ADA. Commissioner O’Rourke asked if staff has considered any limits of the ma ximum space allowable, such as a percentage of the size of the building or something like that. Planner Proulx stated staff has considered that. There are a few ways that could be accomplished. Commissioner O’Rourke felt there should be some language that the umbrellas should be maintained in good repair and condition. Commissioner O’Rourke referred to Page 3 and perimeter delineation. He stated it states the barrier must be free -standing. He asked if the base would be part of the clear space area or if it can encroach into the clear space area. Planner Proulx stated the base would be flat and would actually be turned into the delineated area. Commissioner O’Rourke felt that should possibly be clarified. Commissioner O’Rourke asked if there wa s any consideration given to exterior lighting for after dark. Planner Proulx stated that was a good point that is not currently addressed. Commissioner O’Rourke referred to Page 4. He asked if there should be a maximum time for the outdoor use. Chai rman Sobkoviak stated there are some establishments right now that have outdoor dining , and asked how they are regulated. Village of Plainfi eld Plan Commission Minutes October 21, 2008 Page 7 of 8 Planner Proulx stated he believes right now they are considered an accessory use. He did not know if there were specific closing times. A discussion followed by the Commissioners. Commissioner O’Rourke stated he has noticed , while walking through Downtown Chicago, most of these outdoor uses have a seasonal flower box with fresh flowers. He felt this could be encouraged, but not r equired. Commissioner Renzi stated he did not see awnings listed and felt it could be a nice extension off of the front of a restauran t, that could go onto the public right -of -way. He wondered how that would work if two business owners next to each other with different facades wanted to have awnings. He asked if the way the guidelines are written would the first one permitted win. He felt the first business setting up outdoors will define the block. He stated meandering should be discouraged and only a llowed where there would be ample pathway and some sort of articulated direction. A discussion followed. Planner Proulx stated that is consistent with staff’s expectations of how this would work. He stated he did not know if there would be one uniform pedestrian pathway. Commissioner Renzi asked why alcohol use only would necessitate fences and bollards. Planner Proulx stated it is primarily driven by the requirement in the Alcohol Code to have a clearly delineated premises. He went on to say that delineation would be required anytime there is more than 2 tables, whether there is alcohol service or not. There was a discussion among the Commissioners. Commissioner Fremarek argued against the delineation of every single business. He stated instead of having the beautiful wide open sidewalk space that was envisioned, it is now turned into “wrought iron fence land”. He stated clearly with alcohol use it is needed. He felt for an area where someone possibly is just having coffee and a bagel in the mo rning to be delineated distracts from the streetscape. Commissioner Renzi felt there should be some conceptualization and use of some words, such as discouraged or planner’s discretion in terms of the design to try to maintain some sort of a beautiful ope n look, but at the same time discouraging cut -through pedestrian traffic and creating areas for design opportunities. Commissioner Fremarek stated for the most part they are talking about spacing from the street to the building. He asked what the width was. Planner Proulx stated currently on Lockport Street it is on the order of 15’ to 18’. There are areas where there are planters that limit the functional width for some businesses. There will be obstructions, such as light poles, fir e hydrants, tras h cans, parkway benches. Commissioner Fremarek had concerns that there would be enough room. Planner Proulx stated it will be very much case specific. Commissioner Fremarek stated as far as the table and chairs, a commercial grade or high quality resi n material could be used. He also questioned why there needed to be a grace period of one year for businesses with existing furniture since he did not know of businesses presently having outdoor use. Planner Proulx stated there are a few businesses that have tables out in front. Planner Proulx stated it could potentially be a hardship thing for businesses to go out and invest several thousand dollars into equipment. Planner Proulx stated regarding umbrellas it is true distributors do provide umbrellas with log o s and that is another way of pro viding a cost -effective solution . Staff recognizes that is a great opportunity for businesses, but staff feels some regulation of the logo or advertising message will be appropriate. There may be a way of definin g it through materials, square footage limitations, etc. Commissioner Fremarek agreed with staff on this. He stated the Village has just spent a lot of money to beautify that section of the Village and to have it decorated with Miller Lite, Bud weiser , Pe psi, etc. and every other form of advertising just doesn’t do it for him. He agreed with Commissioner Sanders comments stating there are high quality umbrellas. Commissioner Fremarek would like the wording strengthened for cleaning and maintenance. He stated pavers can get dirty quickly even just with foot traffic. He also wanted to have it defined as far as the trash receptacles that the businesses o ffer be consistent with Village design so that there just isn’t a plain garbage can outside. Commissi oner O’Rourke asked if outdoor entertainment has been discussed and if it would be allowed. Planner Proulx stated it is currently not identified. He stated it could be a temporary use possibly. Commissioner O’Rourke asked if dogs would be allowed in t he outside eating areas. He said it would be something to think about. Village of Plainfi eld Plan Commission Minutes October 21, 2008 Page 8 of 8 Commissioner Sanders asked if it needs to be elaborated that the trash receptacles should be emptied before the closing of th e day. He was referring to the outside receptacles. C ommissioner Fremarek’s thought was that they should be of high quality. He would also encourage that they need to be emptied nightly. Commissioner Bonuchi agreed. Commissioner Renzi asked if someone wanted to do an awning, since we have the Façade Imp rovement Program, should it be linked to the façade improvements. Planner Proulx stated that was understood. Chairman Sobkoviak stated Planner Proulx did a good job. Planner Proulx thanked the Commissioners for their comments. At 8:45 p.m. Commissioner Renzi made a motion that the Plan Commission recommend approval of the proposed text amendment to the Village of Plainfield Zoning Ordinance to establish regulations to permit certain outdoor uses within the public right -of -way in the B -5 Traditional Busi ness District Zoning District taking into consideration the discussion of the Plan Commission. Commissioner Kachel seconded the motion. Chairman Sobkoviak called for a vote by roll call. Aye: Sanders, Peck, Kachel, Renzi, O’Rourke, Bonuchi, Chairman Sob koviak Nay: 0 The motion is carried 7:0 DISCUSSION: Commissioner Renzi asked about the status of changing the zoning to have an automobile use as a second tier use. Village Planner Garrigan stated that would come before the Commission some time in Nov ember. Commissioner Renzi asked about parking for bikes along the bike paths. Chairman Sobkoviak noticed strategically located bike racks during his visit to the outside mall in Minneapolis and th ey were well used . Commissioner O’Rourke also stated i n Minneapolis with the life style many people do ride bikes. Chairman Sobkoviak stated at the mall in Minneapolis cars are not allowed. They allow buses, cabs, and bikes. Commissioner Peck reminded everyone to vote and cited the early voting hours in th e Village.
