PROFESSIONAL SERVICE CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to evaluate Borough
roadways in order to determine conditions and establish priority order for future
repair and repaving; and
WHEREAS, engineering is a a professional service exempt from the requirement
of public bidding pursuant to N.J.S.A. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Killam Associates at
a maximum cost not to exceed $33,500.00 billable per attached contract.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT 1S FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with NJSA. 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.
IT 1S FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on June 30, 1998.

THE CONTRACTOR does hereby agree to perform the following
ENGINEERING SERVICE TO EVALUATE ROADWAYS FOR FURTURE REPAIR
AND PAVING.
NOT TO EXCEED $33,500.00
THE INDEMNIFICATION AGREEMENT ON THE REVERSE OF THE PURCHASE ORDER SHALL BE LIMITED
TO THE VENDOR's NEGLIGENT OR WRONGFUL ACTS.
According to the terms set forth in RESOLUTION.' and Purchase Order 98-1615.
THE BOROUGH does hereby agree to pay the C~ontractor the sum set
forth in Resolution.
