BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1 . The Mayor and Clerk of the City are hereby authorized and directed , for and in the name of the City, to execute a written contract with Central Missouri Professional Services , Inc. , for engineering design and inspection services . for the Airport Levy Project. SECTION 2. A copy of said contract is attached hereto. I SECTION 3. This ordinance shall take effect and be in force from and after its passage and approval. Hyder , President of the City Council of the City of Jefferson, Missouri , a municipal corporation of the third class of the State of Missouri , Party of the First Part , and who acts for and on behalf of the City of Jefferson , Central Missouri Profes- sional Services , Party of the Second Part , WITNESSETH: THAT, WHEREAS, the City Council of the City of Jefferson, Missouri , did on the .Dl t' day of , 19 7a , award to the Party of the Second Part, Central Missouri Professional Services , Inc. , the contract for the design and field inspection of the Airport Levee oject. 1p NOW, THEREFORE, for and in consideration of the awarding of this contract and the work thereunder by said First Party hereto, the City of Jefferson, Missouri , to the Second Party Central Missouri Professional Services , Inc. , the said Second Party does hereby contract and agree to do and perform said work, above specified and referred to, for the lump sum of $17 ,500. 00. In addition, the necessary surveying work for right-of-way and easement acquisition, plus any necessary soil borings and analysis shall be paid for on an hourly basis . NOW, BY THESE PRESENTS, it is agreed and understood by the parties Am 4preto that this contract is entered into subject to all existing ordinances of the City of Jefferson pertaining to the plans , specifi- cations , and estimates of the costs of construction to be prepared by the Party of the Second Part. The Second Party agrees to prepare all documents , construction plans and specifications, maps and provide the field inspection for the com- pletion of construction of. the Airport Levee Project to the satisfaction of the Director of Public Works of the City of Jefferson , Missouri , or his designated representative. The Second Party agrees to perform his services under the contract i such a manner and at such times so that any contractor who has work perform, or contract to execute can do so without delaying or other- wise Y g wise hindering any other contractor in the area. A 2 - The City of Jefferson shall be responsible for competitive Lidding requirements and shall work with the Second Party to meet Tovisions required by state and federal agencies. Ownership of all documents , construction plans , specifications , and maps prepared or obtained in regard to the Airport Levee Project shall be delivered to and become the property of the First Party, basic survey notes and sketches , charts , computations and other data shall be made available upon request without restriction or limitation on their use. The Party of the Second Part agrees to perform the required sur- veying for right-of-way and easement acquisition, and the preparation of the related legal documents. The Second Party also agrees to supply required soil . borings and analysis. The above portion of this agreement, surveying for right-of-way and easements , the preparation of the related legal documents , and any soil borings and analysis shall be paid for on an hourly basis . The Second Party agrees to completely indemnify and hold harmless the City of Jefferson for any and all damages , injuries , actions , costs , attorneys ' fees and all other expenses whatsoever , arising out of the performance of said work whether the property or persons damaged are the servants and employees of the Second Party, or third parties in no manner connected with said work. All interlineations , corrections , deletions and changes herein have been made prior to the execution of Os contract. The City of Jefferson reserves the right at any time to suspend or terminate this contract upon seven (7) days written notice. In event of termination the Party of the Second Part shall receive due com- pensation for services performed to termination date. Services , Inc. , the said Second Party does hereby contract and agree to do and perform said work, as specified herein and referred to, for the lump sum of $17 ,500. 00 Upon receipt of a signed copy of this Engineering Services Contract , the Party of the Second Part agrees to perform the following services : 1. Prepare all documents , construction plans and specifications , maps , and provide for the field center line controls for the completion of construction of the Jefferson City Memorial Airport Levee Project. 2. Provide a resident inspector to do and perform said work as specified below: a. Coodinate all field work such that the general contractor and/or any subcontractors shall procede and complete work ' as quickly as possible. b. Verify field controls to allow for the necessary construction staking and verify elevations and slopes staking to conform with plans and specifications . Note any and all changes to be submitted to the Department of Public works for drawing of as-built construction plans. C, Provide supervision during the placing of embankments and the testing of soil to assure quality control as per plans and specii?.cations. d. Provide daily written reports as to the progress of the pro- ject with submission of said reports made on a monthly basis to .the Department of Public Works and the Airport Commission. 3. Prepare an itemized cost estimate to be submitted to the Director of Public Works and the Jefferson City Airport Commission prior to advertisement for bids . 4. Prepare sufficient copies of the plans and specifications for construction bidding purposes and be available as necessary for their interpretation as required by prospective bidders . f S. Be present during the opening of bids to assist and advise prior to the awarding of a contract . G. Submit monthly reports to the Director of Public Works and the Amok Jefferson City Airport Commission as to the progress of the project. 7. Prepare change orders with the knowledge and written approval of the Director of Public Works . 8. Supply all field changes in written form to the Department of Public Works who will then revise the original construction plans . All documents , constructions plans , specifications and maps prepared in regard to this project shall remain the pro- perty of the Second Party. The Department of Public Works shall be provided with a reproducible set of construction plans, specifications and maps. Basic survey notes and sketches , charts, computations and other data shall be made available upon request without restriction or limitation on their use. 9. Payment for this contract shall be made upon request of the Party of the Second Part, monthly, on a percentage of work completed basis . The Party of the Second Part shall submit a statement to the Director of Public Works with payment being made upon his approval. The City shall retain ten (10%) percent of the total amount of this contract to be released in ninety (90) days , after completion of the project upon approval of the Director of Public Works . 10. Request for payment during the construction contract shall first be reviewed and approved by the Second Party who will then submit the request to the Director of Public works for final approval . Request for payment shall be made on no less than a monthly interval with ten (10%) percent of the construction contract retained from the final payment which shall be released in ninety (90) days after completion of the project upon approval of the Director of Public Works . 11. The Second Party agrees to perform his services under this contract in such a manner and at such times to expedite the progress of the general contractor and/or subcontractors on the project. 12. The Second Party shall work with the First Party in complying with all requirements of state and federal agencies in regard to competitive bidding and wage scale . The Party of the Second Part also agrees to perform the following services in regard to the Jefferson City Memorial Airport Levee Project i which shall be paid for on an hourly basis , these rates being included in this contract as Appendix A. a, Provide required surveying for right-of-way acquisition and easements , prepare all related legal descriptions . The Party of the Second Part anticipates the total charge for work based on an hourly basis not to exceed $4, 000 The Party of the Second Part also agrees to perform the following services in regard, to soil analysis for the Jefferson City Memorial Airpo];t r Levee Project which shall be paid for on an hourly basis . The soil mcsanic firm of Layne-Western Company, Inc. , shall assist the Party of the Second Part with this portion of the contract , a schedule of their hourly rates being attached as Appendix B. a. Perform the required borings and determine existing water table levels to establish the ability of the soil along the alignment of the levee to support the proposed construction. b. Perform the required borings to determine the location of suitable materials to construct said levee . c. Provide written analysis with recommendations by a unified system to allow for the design, the drawing of construction plans , and the construction of said levee as economically as possible. d. Provide the necessary compaction and density tests during . construction to insure proper placement of soil , said tests to be taken at 300 foot intervals and in lefts of twelve (12) inches . e. Provide assistance during construction with any problem which may arise. The Party of the Second Part anticipates the total charge for work done under this portion of the contract not to exceed $18, 000 The Party of the Second Part agrees that all services shall be under the direction of a Professional Engineer registered in the State of Missouri. He shall be assisted by qualified personnel. All services rendered shall bei&rried to completion without undue interruption and shall receive normal priority over subsequent authorization of other clients of the Engineers. The Second Party agrees to completely indemnify and hold harmless the City of Jefferson and any and all damages , injuries , actions, costs, attorneys ' fees and all other expenses whatsoever, arising out of the perfor- mance of said work whether the property or persons damaged are the servants and employees of the Second Party, or third parties in no manner connected with said work. All interlineations , corrections , deletions and changes herein have been made prior to the execution of this contract. The City of Jefferson reserves the right at any time to suspend or terminate this contract upon seven (7) days written notice . The proposed levee would be about 20,500 feet long and 10 to 15 feet high. During periods of continental glaciation, the Missouri River eroded a channel about 80 to 100 feet below the existing level and approximately two miles wide at Jefferson City. At the end of the glacial period, the channel was filled with sand, silt, and clay. As filling tool: place the river meandered back and forth across the valley, thus depositing material , eroding material previously deposited and then redepositing material . In general , the lower deposits are coarser materials and the upper materials are silty and clays. A reconnaissance of the site indicates the surface soils are Primarily silts and clays , but sandy soil is present at a number of locations. Potential problems of a levee are: 1. Ability of tho soil along the levee alignment to support the levee. 2. Availability of suitable material to construct the levee. 3. Underseepage problems. Judging from the surface sails , ' suitable material for the levee would be present in some areas, but mould probably be scarce in others. Whether underseepage would be a problem would depend on the type and thickness of surface soils and fluctuation of the ground water level with •,, river stage. Our investigation would be directed toward identifying and de- 1, . ' lineating potential problems . At present, there is no information regarding ground water levels at the site in relation to river stages. As a result , it is proposed that 2 recording piezometers be installed at the beginning of the investigation. One would he f talled riverward of the levee and the other landward. The next p would be to make from 5 to 10 borings along the proposed gnment to determine overall conditions . Probably, three of the borings would be drilled to bedrock with piezometer pipes in- stalled, while the other borings would probably be terminated at a depth of 25 to 30 feet. After completing the initial borings , it would be necessary to make additional borings along the pro- posed levee alignment and landward of the levee. The number of holes required would depend on the variability of the soil conditions ' ericountered. For estimating purposes , it is assumed that 15 borings would be required and they would be 25 feet deep. It would be necessary to seal all holes drilled landward of the levee. The information obtained would be analyzed and a report would he prepared which would present the data and present our recommenda- tions.
