Public Announcements and Comment: Members of the public may address the Conservation Commission on matters not on the meeting's agenda for a maximum of 3-5 minutes at the Chair's discretion. The Conservation Commission will not reply to statements made or answer questions raised during public comment but may add items presented to a future agenda. Joint Meeting of the Select Board Water Commissioners and Conservation Commission_ to discuss Town of Brewster Hunting Policy Each year the Town revisits the hunting policy. Last year portions of the Punkhom were approved for hunting. Chris Miller (CM) has been in touch with the Town Manager. CM suggest a joint meeting with the Water Commission and Select Board. CM discusses potential date of October 2, 2023 but Water Commissioners are not able to make a quorum but might have a quorum on Monday, October 16, 2023 at 6:00 PM. Poll taken of Conservation Commissioners as to their availability; a Conservation Commission quorum can assemble on October 161. CM notes that Conservation Commission would bring language similar to the 2022 policy, which is pposted on the website, talking about land under the care and custody of the Conservation Commission and other boards and the hunting policy. 6. Discussion 6a. Conservation Permit Forms and Submittal Documents Revisions — Bill Grafton BG requests more time to present and suggests tabling this discussion item. 6b. 228 Cranview Road 20-12 (51 -18 -7) -Request for Commission direction on conservation permitting: existing stairs/periodic maint, deck expansion and unpermitted landing — Sam Paine Page 1 of 8_ Conservation Commission Meeting Minutes — September 26, 2023 Sam Paine (SP) — applicant -- present via zoom. Sam is a new resident who purchased the subject property over the summer. References due diligence meeting with Bill Grafton (BG) discussing the property, existing permits including several Certificates of Compliance and current proposals as SP considers property maintenance and restoration. SP shows existing decking. Landing on the right of the property has not been documented up to the current date. SP notes that all decking is in need of repair. Rear deck amend footprint with Conscomm permission. BG shows the As -Built plan, provided as part of SP's submittal depicting the 50 and 100 -foot buffers. BG displays the existing conditions plan as well. SP notes that basement floods during rain events. SP proposes to relocate footings on the left side of deck away from the retaining wall, which is starting to fail and rot. SP would like to steer traffic to decking so that there is less foot traffic on the bank itself. SP would like to undertake restoration and redecking of the front and side, ripping up existing boards and removing any rot. Mike Tobin (MT) asks if stairs were permitted? BG states that they were depicted on approved site plans under MassDEP Chapter 91 indicating that they were there for an extensive period of time. MT asks about the landing Conservation permit? BG states that the landing was not permitted. MT suggests an Notice of Intent (NOI) for all three activities. BG references MassDEP Chapter 91 licesne approval and plans that depict the stairs as well as a recent Commission decisions to allow an RDA for Susan Silver at 366 Run Hill Road to repair here existing stairs. BG agrees that all the projects collectively qualify for NOIs, but wants to put it to the Commission for a determination. An NOI would bring the landing into conformance and provide long-term maintenance capacity through extensions or a Certificate of Compliance with Ongoing Conditions. BG inquires if the Commission will consider the option to waive the requirement for a surveyed plan. BG asks if SP has someone to help with the plan preparation. SP states that he would need to reach out to someone local. Kimberly Pearson (KP) asks if there is another plan that was referenced? BG confirms that plans from a Certificate of Compliance associated with the property are not represented in the documents being presented. BG notes that the 50 - foot buffer runs through the decking. Casey Chatelain (CC) notes that the discussion is about increasing structure either at the edge of the 50' buffer or even within the 50 -foot buffer, which clearly qualifies the proposal as an NOI. The Commission discusses the validity of an RDA for the stairs only. The Commission agrees that a combined NOI for all three (3) activities is required. BG asks if SP is a candidate to waive engineered drawings associated with the NOI. MT affirms that he would like to see engineered drawings. KP Moves to require submittal of an NOI for stair replacement, unpermitted landing, and deck expansion at 228 Cranview Road. Bruce Evans (BE) Second. Approved 5-0-0. 6c. Draft Nov 22, 2022 Meeting Minutes for Commission Review & Ratification by Commissioners. Bill Grafton distributed draft meeting minutes and did not receive any comments. Mike Tobin (MT) asks for objections and receives none. Gary Kaser (GK) moves to approve the meeting minutes of November 22, 2022. KP second. Approved 5-0-0. 7. Requests for Determination of Applicability 7a. Vesper 149 Fiddler's Lane. 48-34 (18-38-1). New RDA# 23-17. Joshua and Sarah Brunelle propose a septic system upgrade; a portion of which lies within the 100 -ft buffer zone to a bordering vegetated wetland. Page 2 of 8 Conservation Commission Meeting Minutes — September 26, 2023 Brian Goss, current property owner, and Josh Brunelle (JB), prospective buyer present. Jason Ellis (JE) present via zoom. Brian Goss notes during the September 12, 2023 Commission Public Meeting that a septic upgrade was approved but the wetland was not. The Commission requested a wetland line delineated via a third party. Applicant received a list of acceptable people and hired Paul Shea, who had wetland line field delineated and provided the locations to Jason Ellis for depiction on the revised site plan. The Commission additionally asked the applicant to remove unpermitted fill/green waste which had been ongoing for years. BG received post cleanup photos and visited the site to confirm tha the green waste was removed. BG notes that applicant needs a Commission approved wetland delineation for the Board of Health, and that the property owner and prospective property owner undertook the cleanup of the violation in the wetlands and buffer zone to the wetlands per Commission directive. Bruce Evans (BE) moves to approve a Positive Determination No. 5 for the Bylaw, a Positive 2A for the wetland delineation and a Negative No. 3 for work within the buffer zone including standard special conditions. Gary Kaser S (GK) Second. Approved 5-0-0. 8. Notices of Intent _ 8a. 104 Canoe Pond Drive, SE9-1952.24-60 (36-230). Continued public hearing. Hongying Xie Revocable Trust -2012 proposes to install a seasonal aluminum dock, as well as After -the -Fact approval of an existing kayak rack within inland bank, bordering vegetated wetland, land under waterbodies and waterways, and bordering land subject to flooding and buffer zone to bordering vegetated wetlands. Continuation Requested. BG advises tha the the applicant has requested in writing a continuation to December 12, 2023. Gary Kaser (GK) moves to continue to the December 12, 2023 Commission Public Meeting to allow the applicant's consultant additional information to address the Commission's request for additional information. Second KCP. Approved 5-0-0. 8b. 178 Bonnie Doone Cartway 102-13 (8-7). Continued public hearing. SE9-1893 Amended. 178 Bonnie Doone Cartway LLC requests a determination for after -the -fact and proposed minor deviations including restoration plantings, changes to hardscape, improved drainage, beach stair details, vegetative management and date for removal of "the eastern cottage" which is a portion of the mitigation to the approved Order of Conditions SE9-1893 within the buffer zone to coastal dune and bordering vegetated wetlands. Continuation Requested. BG advises tha the the applicant has requested in writing a continuation to the October 10, 2023 BCC Public Meeting. Kim Pearson (KP) moves to continue the Request For Amended Order of Conditions under SE9-1893 to October 10, 2023. Gary Kaser (GK) Second. Approved 5-0-0. 8c. 10 Nancy May Path, 91-14-798 (7-11-1). Continued public hearing. SE9-1550 Amended. Nancy & Mina Kaddis request a determination for the relocation of a beach access stair with seasonal base, removal of existing and approved but not constructed hardscape as well as mitigation plantings within coastal beach, coastal bank, land subject to coastal storm flowage and buffer zone to coastal bank. Bob Perry (BP) present for applicant. BP notes the Kaddis family is seeking a seasonal, independent beach access stairway to relieve congestion that builds on the common beach access stairway. The previous Conservation Administrator suggested an Administrative Review, which was not appropriate so the applicant prepared a Requet for Amended Order of Conditions (RAOOC). BP discussed the proposed location of the stairs and the mitigating reduction in constructed surfaces. The seasonal stairway is proposed to be detachable stored in the off season off the coastal beach. Mitigation plantings of the surrounding area and an existing board covered path would be planted. BP notes very good growth of bayberry on the premises and suggested bayberry and beach plums would fit in that wood covered pathway once the wood is removed. BP also points out that the area to the right of the home is would also be Page 3 of 8 Conservation Commission Meeting Minutes — September 26, 2023 planted with native coastal shrubs and beach grass. The prosposed stairway is a simple, post-supported structure, which would require drilling some of the stones in revetment to put in clips to hold seasonal unit. Kim Pearson (KP) notes that she visited the site with Bill Grafton (BG) and noticed that 70% coverage of invasive vegetation. KP ventures that the chances of healthy growth in area without addressing invasive vegetation is pretty slim. KP suggests hand removal of invasive species as part of the planting plan. BP agrees, but notes that it is a small site that is also struggling with animal browsing. The Kaddis family are not likely to take the herbicide approach, but would be likely to remove invasive species by hand. BP notes that the property is a condominium area with invasive species potentially spreading from other properties. BP suggests `aggressive hand removal.' MT notes that the native plants need to survive for three (3) successive growing seasons with annual monitoring. BG recommends getting a qualified wetland scientist to close out this and an old enforcement order issued to a prior owner. BG suggests adding standard vegetative management conditions with a qualified wetlands scientist. Bruce Evans (BE) moves to close and issue an Amended Order of Conditions for SE9-1550 including standard special conditions and the requirement for the plantings to take place during the Fall 2023 Planting Season, documented 100% survivability through (3) three successive growing seasons and (3) three years of monitoring to start over each time new plantings are planted and ongoing conditions for periodic maintenance of the stairs. Gary Kaser (GK) second. Approved 5-0-0. Gary Kaser recuses from voting and discussion. 8d. 0 Beach (aka 0 Landing Drive) 82-1(48 79-1). Continued public hearing. SE9-1957. Beechwood Landing Property Owners Association, Inc proposes to construct an open wooden shade structure on an existing deck located within land under water bodies (Long Pond, a great pond). John O'Reilly (JO) present for applicant Greg Bookack, president of Beechwood Landing POA. Presented several weeks ago, and went back to Beechwood Landing Property Owners Association (BLPOA) with Commission's suggestions. JO states that the revised site plans reflect a shortened shade structure and moved shade structure to the middle of the deck. Regarding the materials questioned, JO states that the trim would match decking and roof would be constructed in wood, perhaps a cedar that would weather to a light grey. Did hear at the last minute from Natural Heritage and Endangered Species Program (NHESP) which issued a no adverse effect and no take letter. Mike Tobin (MT) states that a wood roof would look nice. Kim Pearson (KP) did research on this kind of structure. It's not something we see on Cape Cod ponds. KP is happy to take in new information. KP does not believe that it meets the aesthetic values we are trying to approve on Cape Cod. Casey Chatelain (CC) notes that the project benefits a great number of people and meets every other requirement other than aesthetics. Bruce Evans (BE) moves to close and issue an Order of Conditions for SE9-1957 including standard special conditions. CC second. Approved 3-1-0 by a roll call vote. CC: Aye, BE: Aye. MT: Aye. KP: Nay. Greg Boocack (GB) relates his longevity in Brewste and wants to state that the project will not be an eyesore. 8e. 283 Hamilton Cartway 81-1(47-83-2). Continued public hearing. SE9-1956. Frank & Laura Kolb propose a septic replacement and construction of additions to an existing single family dwelling within the 100-foot buffer zone to bordering vegetated wetlands and inland bank to (Greenland Pond & Long Pond, great ponds). John O'Reilly (JO) present for Applicant. Noted Commission didn't have too many concerns. JO revised the site plans to address roof runoff and did receive comments from Natural Heritage and Endangered Species Program (NHESP) which provided a no adverse effect and no take letter. Opens to commissioner questions. Page 4 of 8 Conservation Commission Meeting Minutes — September 26, 2023 Bruce Evans (BE) moves to close the public hearing and issue an Order of Conditions for SE9-1956 with standard Special Conditions. Kim Pearson (KP) second. Approved 4-0-0. Gary Kmer returns to the meeting. 9. Request for Certificate of Compliance 9a. 2342 Main Street 78-121(16-83). Brewster Conservation Trust. SE9-1819 BG performed a site visit at the subject site with BCT staff on 9/20/2023. BG notes that Special Condition A30 requires an environmental consultant to provide a closure letter. BCT removed a building and revegated and they have formally requested a waiver of this requirement which seems entirely reasonable. BG suggests approving a complete COC. Kim Pearson (KP) moves to approve a complete Certificate of Compliance for SE9-1819 at 2342 Main Street waiving the requirement under Special Condition A30 for a statement from an environmental consultant. Bruce Evans (BE) second. Approved 5-0-0. 9b. 92 Seaman's Lane 12-59 (38-34). Brewster Conservation Trust. SE9-1825 BG performed a site visit at the subject site with BCT staff on 9/20/2023. The structure has been removed. BG requested the 2022 Annual Monitoring Report which was provided. BG observed that Special Condition A30 includes the requirment for a statement from an environmental consultant. They have formally requested a waiver of this requirement which seems entirely reasonable. BG found a second, older permit for the subject site that would be superceded by sE9-1825 so BCT would need a a Certificate of Compliance for SE9-758 as well. Bruce Evans (BE) moves to approve a complete Certificate of Compliance for SE9-1825 at 92 Seamens Lane waiving the requirement under Special Condition A30 for a statement from an environmental consultant. GK second. Approved 5-0-0. 9c. 92 Seaman's Lane, 12-59 (38-34). Brewster Conservation Trust. SE9-758 BG performed a site visit at the subject site with BCT staff on 9120/2023. BG notes that this approved Order of Conditions preceded the SE9-1825 OOC that was just closed out tonight under a complete Certificate of Compliance. BG suggests that the structure (a hunting shelter) has been removed under SE9-1825 and this is now a simple procedural close for the prior Order of Conditions/SE9-758. BCT has also requested a waiver of the As -Built which is required under Special Condition A39; this request seem entirely resonable. Bruce Evans (BE) moves to approve a complete Certificate of Compliance for SE9-758 at 92 Seamens Lane waiving the requirement under Special Condition A39 for submittal of an As -Built. Kim Pearson (KP) second. Approved 5-0-0. 9d. 34 Red Wing Cartway, 69-79 (5-156). Jared & Amy Noering. SE9-1795 Bill Grafton (BG) performed a site visit. The initial project was approved and issued on 9/19/2018 for Donald Berig for constrution of a shed, deck and stairs as well as native plantings along the top of the coastal bank and along a stockade fence within the 0-50 foot buffer zone. This property was sold to the Noerings who wished to build a different house and submitted a new NOI that was approved and issued under SE9-1833 issued on 9/16/2019. The more recent SE9-1833 Orders included a much more elaborate planting plan within the 100 -foot buffer with grasses and shrubs. In addition, the coastal bank was planted with low lying shrubs and grasses and beach renourishment was included. The photos submitted before the Noerings purchased the property indicated that there were few trees in place and some of the remaining trees were treated and removed in keeping with the approved plans. There is a requirement for three (3) years of monitoring under SE9-1833 and it appears that a 2021 Annual Monitoring report was submitted so Page 5 of 8 Conservation Commission Meeting Minutes — September 26, 2023 they will owe a few monitoring reports effective this November per the Special Conditions. BG can convey this to them as part of the letter accompanying Extension Order of Conditions under SE9-1833 that was approved on 9/12/2023. BG suggests that an Invalid Certificate of Compliance (COC) be issued since the work was not completed and is now encompassed in SE9-1833. Bruce Evans (BE) asks for clarification on what an Invalid COC means. BG explains there are four (4) types of Certificates of Compliance including: Complete, which means the project is finished, Ongoing which is rare and unusual, Partial, which would be used under subdivisions and Invalid means that they didn't complete the work. Under SE9-1795, the Noerings decided to build a different house and submitted a new NOI that became Order of Conditions/SE9-1833 so they didn't complete the work approved under SE9-1795 Bruce Evans (BE) moves to approve an Invalid Certificate of Compliance for SE9-1795 at 34 Red Wing Cartway. Kim Pearson (KP) second. Approved 5-0-0. 10. Request for Extension Order of Conditions 10a. 660 Crowell's Bog Rd, 72-30 (40-10-12). Ari & Joann Daskalakis. SE9-1752 Bill Grafton (BG) notes that Crowell's Bog is on a great pond, Long Pond. This Order of Conditions (OOC) is for construction of a seasonal dock, vegetative management (establihsing a vista corridor) and mitigation plantings. There were two Minor Change to Plans in 2020 for removal of (1) Eastern White Pine and previousy (4) Eastern White Pines. Special Condition A37 of the OOC states that the mitigation plantings shall be installed within the planting season immediately following the vegetation removal. Since there are no annual monitoring reports, it is uncertain whether the removal took place or not and if the mitigation plantings took place. Additionally, there is a Ch. 91 License No: 14628 but the Commission does not have this nor the recorded version in the project jacket. Ch 9 1 s become invalid if not recorded within 60 days of issuance. BG notes that we need the recorded version of the Ch. 91 License. BG suggests that due to the lack of annual monitoring reports and recorded Ch. 91 that the Commission approve no more than 2 years for this extension. Bruce Evans (BE) moves approve a 2 -year extension order of conditions for SE9-1752 to September 26, 2025 and direct the Conservation Administrator to include notes in the cover letter regarding the requirement for annual monitoring, precon/work notification meetings before the commencement of subsequent vegetative management, submittal of the implementation report for the mitigation plantings and submittal of the recorded Ch. 91. Gary Kaser (GK) second. Approved 5-0-0. Kim Pearson (KP) abstains herself, as she lives three houses away from the property. 10b. 257 Crocker Lane, 69-4 (5-203). Jane & Mark Fields. SE9-1591 BG notes this original Order of Conditions (OOC) and the Amended OOC (AOOC) approval is for coastal stabilization (coir envelops, sand -drift fence and beach nourishment). Annual Monitoring had been performed by a consulting company until roughly 2019 but progressively the homeowner has been reporting to Conservation Administrator Aguiar. BG spoke to the homeowner and advised that the Commission has draft guidance for monitoring reports and so long as the criteria is met the homeowner should be allowed to continue to provide the reports which was suggested by Commissioner McKenna during a public meeting in Spring 2023 and working well in the case of Frank King, 112 Governor Prence. The Original and Amended Order of Conditions have been Extended 4 times to date and saved by the Tolling Provisions with 462 days to 2/13/2024. In general, there are good elements in reference to the comments above including attention to the need for the renourishment. Special Condition All indicates that the coir envelops need to remain covered and that beach renourishment is required if the coir envelops are exposed. The coverage of the coir Page 6 of 8 Conservation Commission Meeting Minutes — September 26, 2023 envelops that triggers the need the beach renourishment may been satisfactory not to require the beach renourishment. As such, there is at least one waiver request circa 2019 in the project jacket to waive the beach renourishment. There are no 2020, 2022 nor 2023 annual monitoring reports which are due by May 151b of each year. BG observed that the Special Condition A24 for a $2,000 bond was submitted and then returned in 2017 per a July 10, 2017 Memorandum from Conservation Administrator Aguiar indicating that the project was complete as per "the appended Statements of the Compliance". BG notes that the Commission ratified in Spring 2023 that all performance bonds remain in the designated Town account until a Certificate of Compliance has been approved, issued, recorded with the Barnstable County Registry of Deeds and evidence of the recording is provided to the Conservation Administrator. Presently, there is no bond in place as per Special Condition A24. BG suggests a 2 -year extension as it appears that the homeowners are succeeding in maintaining the permit validity and the field conditions. They exercised a wavier and return of the bond. BG suggests he provide comments about the need for annual monitoring reports as per the Commission's draft guidance and submittal of the $2,000 bond. Bruce Evans (BE) moves to approve a 2 -year extension order of conditions for SE9-1591 to September 26, 2025 and direct the Conservation Administrator to include notes in the cover letter regarding the requirement for annual monitoring, precon/work notification meetings before the commencement of subsequent vegetative management and submittal of the $2,000 bond as per Special Condition A24 with the understanding that the bond remains with the Town for the duration of the permitted project until a Certificate of Compliance is approved, issued, recorded with the Barnstable County Registry of Deeds and evidence of the recording is presented to the Conservation Administrator.GK second. Approved 4-0-1(KCP Abstained). 11. Show Cause 11a. 2628 Main Street, 89-14 (15-113-2). Continued - Brown. Unpermitted cutting and clearing of vegetation within 25 feet of inland wetlands as well as the placement of fill on and within 100 feet of inland wetlands. Bill Grafton (BG) notes that meetings have been difficult to schedule between all parties: David Schlessinger (DS), Chris Miller (CM) and BG will meet Monday or Tuesday of the coming week. Recently, Steve McKenna (SM) did a site visit and viewed revised plans with BG and CM. BG suggests that Commissioners visit the office and view revised plans. BG & CM marked up the revised site plans and latest revision of the Stipulated Consolidated Order. Discussion of farm plan as part of a consolidated order ensued. Kim Pearson (KP) asks if they met the deliverable date that was asked of them? BG replies that the Commission may not have ratified lifting the original deliverable date, despite several continuances, which would be done to give applicant more time in general. BG agrees that it's now September, and this application needs to pick up the pace. CM notes that we have a plan, but that it doesn't have everything anticipated. KP notes that there was a quid pro quo for them to do some activities if they met a certain. BG — they were allowed to remove Japanese knotweed and branches just beyond 100 -foot buffer. Bruce Evans (BE) asks if neighbor's attorney is present? No he is not. Bruce (BE) moves approve a continuation to the October 10, 2023 Commisson public meeting. Gary Kaser (GK) second. Approved 5-0-0. 12. Request for Minor Change to Plan _ — 12c. 648 Satucket Road, SE9-1866. Cordner. Terry Cordner (TC) and Jeremy Ross (JR) present. JR has helped the property owners retain a vista corridor for years. JR, TC and Bill Grafton (BG) met several items identifying vegetation within the two established vista corridors that are blocking the pond view. There is also vegetation within the no touch central corridor that are encroaching on the Page 7 of 8 Conservation Commission Meeting Minutes — September 26, 2023 vistas. JR has submitted a hand marked up version of the approved site plan detailing the specific trees that the Cordners would like to prune along with a request including pictures marked up detailing the view from the Td story deck that is the viewing location of the pond. JR notes four tupelo trees, the last of which is on the bank are part of the request but that every branch that needs to be cut is smaller than 4" in diameter. JR indicates that the proposed cutting should be done to maintain the vista corrdidor but will not negatively impact the plants. JR addresses each picture within his report to provide the Commission with a detailed description of each reach request. JR addresses VC1A — black cherry on median between no -cut and right side VC. Per BG recommendation to remove hanging dead branch to be removed. Also would remove grapevine and bittersweet that is on the tree. BG notes that applicant is taking care to maintain the 90% of the tree canopy as per the Special Conditions. Casey Chatelain (CC) acknowledges the specificity. Chris Miller (CM) asks how the photos become part of a plan? BG acknowledges that the marked photos will not make it onto a site plan in this case. BG notes the submittal in this case the report with the pictures becomes part of an approval which references the request and any changes from the Commission and is attached to the approval. This associates the specific request including the pictures to the approval which is kept physically and digitally by the Conservation Department. BG suggests that the vote is to approve the Minor Change to Plan (MCTP) as proposed. Bruce Evans (BE) moves to approve the Minor Change to Plan as proposed for Cordner SE9-1866 at 648 Satucket Road.
