INTRODUCED BY COUNCILMAN �i ORDINANCE NO. / 3 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDI- NANCE NUMBER 8175 RELATING TO THE KEEPING OF DOGS, CATS AND OTHER ANIMALS, AND ENACTING A NEW ORDINANCE RELATING TO THE SAME SUBJECT, AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Definitions. As used in this ordinance, the following terms shall mean: ® (a) Owner: Any person, group of persons, firm or cor- poration owning, keeping or harboring a animal. (b) Dog: Any member of canine family over six months of age. �1 (c) Pup: Any member of canine family under six month of age. (d) Kitten: All domestic species or varieties of the genus felis, six months of age or under. (e) .Cat: All domestic species of the genue felis, over the age o f six months. . (f) Exposed to Rabies: Any animal, whether licensed and vaccinated for rabies or not, which has been bitten by, been fighting with or has consorted with an animal known to have rabies. ` (g) Impound: To apprehend, catch, trap or net an anima and thereafter confine it. (h) Euthanize: To put to death in a humane way. (i) Registration-Vaccination: The procedure of vac- cinating for rabies and issuing an ap- propriate certificate. The words shall be interchangeable. (j ) Tag: Any object, regardless of shape or size, which bears a registration number and the words "registered and vaccinated for rabies" which ' has been issued by any licensed veterinarian in the City of Jefferson. (k) At Large: Any animal shall be at large when it is off of the premises of its owner and not under the reasonable control of the owner, or any member of his immediate family, or his agent. �1 (1) Reasonable Control: Any animal shall be under rea- sonable control when the animal is on the pre- }! mises of its owner or, when the animal is not on its owner' s premises, when the animal is with and obedient to its owner, his or her a- gent, or some member of the owner' s family. (m) Not Under Reasonable Control: A animal shall be deemed to be "not under reasonable control" when not upon the premises of its owner and not within the immediate custody of, and obed- ient to, its owner, the owner' s agent, or j some member of the owner' s family, or, when { the animal damages the person or property of anyone other than the owner, except when the animal is in defense of its owner, the owner' s family or property. Section 2. Dogs & Cats to be Vaccinated. It shall be unlaw- ful for the owner of any dog or cat to keep, harbor or permit a dog or cat to be within the confines of the City of Jefferson, Missouri, until and unless such owner secures a certificate from a licensed veterinarian and the dog or cat displays a tag of reg- istration - vaccination. t Section 3. Procedure. The owner of a dog or cat may pre- sent same at his or her expense to a veterinarian to receive a protective dose of rabies vaccine. The owner shall receive one (�s copy of a certificate and a colored tag, both bearing a registra- r tion vaccination number. This tag and certificate only shall be iF evidence of registration - vaccination and confer the right to ASk ! keep said dog or cat in the City of Jefferson, Missouri. The veterinarian shall keep one copy of the above certificate on file by name and the third copy shall be presented to and held by the } City Collector who shall keep the same on file by number. Section 4. Time Requirements. The vaccination procedure de- scribed in the preceding section may be carried out at any time between June lst and June 30th of the year; the resulting vaccina tion shall be good and valid for a period of one year. �! Section 5. Display. The tag issued shall be attached to the Ij dog or cat for which it was issued by means of a secure collar or harness. • Section 5. Lost Tag. If a tag is lost, another tag of the same shape may be obtained from the veterinarian who issued the original, upon presentation of the original certificate and pay- ment of fifty ( .50) cents to the veterinarian. I� y} Section 7. Transfer of Tag. A tag shall not be transferred from the dog or cat to which it was issued to any other dog or I cat. ! Section B. Dog or Cat License Required. It shall be unlaw- ful for the owner of a dog or cat within the City of Jefferson to keep said dog or cat in said City unless a license has been ob- tained from the City Collector and displayed o t e do or cat; � y Col ecto n h g } provided it shall not be necessary for a dog or cat to be license I if the dog or cat is kept on the owner' s property at all times. !` Section 9. License, Cost, to be purchased when. The cost of said license shall be one ($1. 00) dollar to be paid to the City I Collector. Said license shall be valid for a period of one (1) ® year and shall be purchased annually between July lst and July 15th of each year. E Section 10, Licensing Procedure. The owner of a dog or cat shall present to the City Collector a certificate from a licensed veterinarian in the City of Jefferson, Missouri, showing that !! E} said dog or cat has been immunized from rabies within forty-five (45) days prior to the date on which application for the license is made. { Upon payment of the sum of one ($1. 00) dollar, the City Col- i f, lector shall immediately enter in the City Dog and Cat Register the date of payment, the number of entry, by whom paid, the breed, ' sex, metallic plate on which shall be plainly marked, cast or I engraved thereof words and figures indicatin g t h e Y ear for which the tax has been paid, and a number corresponding with the number of entry in said City Dog and Cat Register, and further that the owners name and address be placed upon the collar. Section 11. Display of Identification. Each dog or cat shall have securely attached, by means of a secure collar or harness, a license, a rabies vaccination tag and an identification tag, stating the name, address and telephone number of the owner. Section 12. Humane Officer - Registry Entries. The City � Collector shall make out and deliver to the Humane Officer, on the iii 1 S�{ I I xa �i r: 15th day of July annually, a copy of all entries made and entered in said Dog and Cat Register, and each week thereafter the subse- quent entries as may be entered into said Dog and Cat Register. k j� Section 13. Animals brought into City. Any animal brought i into the City between July 15th and June 1st of the following year, shall be sti,bject to the regulations and provisions of this ordinance.. i, Section 14 . Animals, prohibited from Running at Large. It t) shall be unlawful for the owner of any animals to let such animal ?� run at large, whether licensed or not, at any time within the Cit I of Jefferson, Missouri. In any prosecution for a violation of this provision of this ordinance, proof that the animal described in the complaint was owned by the person named as defendant in iM the complaint shall constitute a prima facie presumption that the �i y owner of the animal let such animal run at large during the time s; when, and at the place where, such violation occurred. ii Section 15. Female animal to be confined when. It shall be junlawful for the owner, or any person in control or custody, of i� any female animal, to fail to keep said animal confined on the l' premises of the owner, or the person in control or custody, durin I the animals' period of salacity. j Section 16. Vicious animals be muzzled. It shall be unlaw- ful for any person to keep or harbor within this city any danger- ous or vicious animal, or suffer or permit such dangerous or }� vicious animal to be or run at large upon any public street, sidewalk or thoroughfare or on the premises occupied by the owner i 1� or keeper of said animal, or on the premises of any other person, within this city, unless such animal is properly and securely 1i muzzled. Section 17. Barking or Howling Dogs and Pups. It shall be t unlawful for any person to keep or harbor within this city, any dog or pup, which by loud, frequent or habitual barking, howling or yelping, shall annoy or disturb any neighborhood or persons. k it Section 18. Dogs or Pups putting Persons in Fear. It shall be unlawful for any person to keep or harbor within this city, 7 any dog or pup which by habitually jumping upon or threatening 4 1 persons upon any public street, sidewalk or thoroughfare within t� ii 1� •kr ,f 1 this city, shall cause such person or persons to be put in fear ® = of injury. Section 19. Animals o8 School Premises. It shall be unlaw- ful for the owner or keeper of any animal to fail to keep said fI animal from interfering with the normal and usual activities of I the teachers and students in any public, parochial or private school within this city. Section 20. Impoundment of Animals. All animals found in f this city, in violation of any provision of this ordinance, shall I be impounded by the Humane Officer in some suitable place provide by him or the City Council. Section 21. Notice of Impoundment. The Humane Officer shall ® exert all effort to identify any animal impounded and to notify the owner thereof of such impoundment and the reason therefor. Section 22. Redemption of Impounded Animal. The owner of any impounded animal or any other person, with the authority of the owner, may redeem said animal within a period of seventy-two (72) hours after impoundment by paying to the Humane Officer the f sum of five ($5 . 00) dollars for each twenty-four (24) hour period►, i or fractional portion thereof, for the expense of keeping, feed- t ing and sheltering said animal during the term of impoundment. Any impounded dog or cat which does not have proof of rabies i vaccination, shall be released only upon the payment of a twenty- five ($25. 00) dollar bond. Said bond shall be returned upon proof of vaccination being furnished to the Humane Officer. Section 23. Failure to Redeem. Any animal that is impounded and not redeemed within seventy-two (72) hours after notice thereof is given to the owner, or, in the event the owner of the !� animal cannot be determined, any animal that is not redeemed wit - i' ? in seventy-two (72) hours after impoundment, may be euthanized by the Human Officer, or given to any person who asks for said r, j animal, upon payment of the accrued fees above provided for and execution of an affidavit that all steps necessary will be taken a s to comply with the provisions of this ordinance within forty- eight (48) hours. i c: 1+j �i , ! Section 24 . Animal Bite Procedure. The owner of any animal ( which bites any person, regardless of the circumstances or whether the animal is vaccinated or not, shall be required to place the animal in a veterinary hospital maintained by a licensed veteri- narian for a period of fourteen (14) days following the evening of ! the day of the bite, for clinical observation. All expenses shall be borne by the owner of the animal. If such animal develops 11if symptoms of rabies, it shall be allowed to die a natural death, or, the animall shall die while within confinement for any reason, :Ithe head of such animal shall be removed by the veterinarian and �lsubmitted to any qualified official laboratory. If at the end of said fourteen (14) day period the animal is alive and healthy, it may be released to its owner, if said animal fulfills all other conditions of this ordinance prior to said release, but said anima : shall not be permitted to run at large thereafter. Section 25. Suspected Rabid Animal. Any animal or pet Irodent which exhibits clinical symptoms of rabies, may, after i notice is given to the owner, be impounded by the Humane Officer lion or off the property of the owner. The animal or rodent may be #held for fourteen (14) days at the city' s impounding facilities i ' for clinical observation and, if alive and free from rabies at the expiration of that p eriod, shall be returned to the owner at no expense. As an alternative procedure the owner may designate any vet- erinary hospital in the City as a place of detention for said i:fourteen (14) day period. ALL expense, under this procedure, shat be borne by the owner. �! Section 26. Exposed to Rabies. Any animal or pet rodent, ;which has been exposed to rabies, should be immediately destroyed ��unless of provided. otherwise If the owner is unwilling to have said kianimal or rodent destroyed by the Humane Officer, one of the fol- lowin g alternatives must be followed: f' I' • r r' ij f; (a) Strict isolation in an animal hospital for six (6) months. �i (b) If no previous vaccination has been given within a period of three (3) years with LEP (flury strain) I vaccine, or within one (1) year using vaccine of nervous tissue origin, administer post-exposure treatment and confine in a kennel for three (3) months. Post exposure treatment may consist of administration of anti-rabies serum (0. 5 ml./ Kg. b.w. ) , followed by one (1) to three (3) doses chicken embryo vaccine within seven (7) days, or fourteen (14) injections of nervous tissue vaccine. (c) If the animal has been vaccinated previously within one (1) year with nerve tissue or kelev strain vac- cine, or within three (3) years with flury strain vaccine, it is recommended that the animal be re- vaccinated and restrained by a leash or confined at home for thirty (30) days. i { Section 27. Quarantine. Whenever the Mayor shall deem it ® Lecessary, because of the prevalence of rabies among the animal E! opulation of the City, County or State, strict quarantine may be laced on all animals in the City. Upon such proclamation by the ayor, all animals shall be confined in the owner' s home, tied up for placed on a leash and under the direct physical control of a '4 6ompetent person at least fifteen (15) years of age. Any animal { ;found otherwise shall be impounded, or if impossible to capture E; ;.hall be shot and killed by any policeman of the city. Section 28. Right of Entry. The Humane Officer, and his de- ignee, shall have the right of entry to any property or premises .i.thin the City, for the purpose of determining if the provisions cif this ordinance are being complied with, and for the further pur- ose of examining and impounding any animal exposed to or exhibit- . ng clinical symptoms of rabies. Section 29. Poisoning Animals Prohibited. No person, or per- ons, shall feed or place so as to constitute a direct or obvious azard to man or animal, or shall offer or tempt any animal with py liquid, or meat, of any food product which shall (a) cause rostration, convulsion, pain or suffering as a prelude to death, 1� (b) death, or (c) be proven to be toxic or lethal in the amount 'resent to any man or domestic animal by competent medical or vet- f rinary authority. Section 30. Refusal to Deliver Animals to Humane Officer. No t �j i� ij I( person shall refuse to deliver up to the Humane Officer his animal when requested to do so under the provisions of this ordinance. Section 31. Notices of Dog and Cat Licenses. During the month of June of each year, the City Collector shall cause notice to be given to the owners of dogs and cats within this City that tha annual licenses must be secured between July 1st and July 15th of the same year. Section 32. Collector to Settle Accounts. The City Collecto shall settle for all monies received by him under the provisions of this ordinance in the same manner and at the same time he ac- counts for other monies received by him. Section 33. Humane Officer to Settle Accounts. Upon redemp- tion of any animal by the owner, the Humane Officer shall execute a receipt in triplicate showing the amount of the money received by him for feeding, sheltering and caring for said animal during the period of impoundment. One copy thereof. shall be given to the j�I owner, one copy shall be retained by the Humane Officer, and on the (ijlast day of each month, the third copy shall be filed with the Cit Collector along with the monies so received, and the City Collecto shall issue a receipt therefor. Section 34. Any person, firm or corporation violating any of ,the terms of this ordinance shall be deemed guilty of a misde- �meanor and shall be fined not more than one hundred ($100.00) dol- Ilars or imprisoned not more than ninety (90) days, or by both such fine and imprisonment. Section 35. Repeal Clause. Ordinance Number 8175 of the City of Jefferson, Missouri, be, and the same is hereby repealed. Section 36.
