AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CALLING AN
ELECTION IN THE CITY TO SUBMIT TO THE QUALIFIED VOTERS THEREOF A
PROPOSITION TO EXTEND THE PRESENT CORPORATE LIMITS OF THE CITY TO
INCLUDE UNINCORPORATED AREAS OF LAND CONTIGUOUS TO THE PRESENT
CORPORATE LIMITS OF THE CITY,
WHEREAS, the City Council of the City of Jefferson, Missouri,
adopted a Resolution on February 4, 1974, to annex an unincorporat-
ed area of land contiguous to the present city limits, said
unincorporated area of land being described as follows:
Beginning at the northeast corner of New Madrid
Private Survey 2638, thence southerly along the east
line of said Private Survey 2638 a distance of 4086 .8
feet, thence north 64°11 ' west, 2635,07 feet, thence
south 84 015' west, 1466.89 feet; thence south 6° 00'
east to the center of the Missouri River; thence
southeasterly along the centerline of the Missouri
River to the north-south quarter-quarter section line
in the west half of Section 23, Township 44 North,
Range 11 West; thence northerly along the quarter-quarter
section lines of Section 23, 14 and 11 ofTownship 44 North,
Range 11 West, to the toe of the bluff; thence northwest-
erly along the toe of the bluff to its intersection with
the south bank of the Halifax Diversion Channel, said
intersection being approximately 300 feet east of the
centerline of U .S.Route 54 and approximately 900 feet
north of the centerline of the M.K.& T. Railroad; thence
northwesterly along the south bank of the Halifax Diversion
Channel to its intersection with Turkey Creek; thence
westerly and southerly along the south and east banks of
Turkey Creek to a point lying 200 feet perpendicularly
from the north right-of-way line of present U. S.Route 63;
thence southeasterly and parallel to the northerly
right-of-way line of present U. S.Route 63 to a point
lying south 56°12' westiof Station 7569+27,2 on the
north right-of-way line of the M.K.T.Railroad; thence
north 56 12 ' east to said Station 7569+27.2 on the
north right-of-way line of the M.K.&T,Railroad; thence
southeasterly along the north right-of-way line of the
M.K.& T. Railroad to the west line of Section 11,
Township 44 North, Range 11 West; thence southerly to
the point of beginning, all in Callaway County, Missouri.
and,
WHEREAS, the City of Jefferson, Missouri, did cause to be
filed in the Circuit Court of Callaway County, Missouri, in Case
No. 31, 743, a suit for a declaratory judgment authorizing the City
to annex the area of land described above; and

WHEREAS, on the 15th day of April , 1975, the Circuit Court of
Callaway County, Missouri, did enter its judgment in said suit,
authorizing the annexation into the City of the unincorporated
area of land described above, upon the consent of a majority of
the qualified voters of the City voting at an election to be held
for such purpose in said City, the judgment having become final;
and,
WHEREAS, the Mayor and City Council of the City of Jefferson,
Missouri, with the consent of a majority of the legal voters of
said City, voting at an election to be held for such purpose, by
the passage and approval of a City Ordinance, have power to extend
the limits of the City over territory contiguous thereto; and,
WHEREAS, the Mayor and City Council of the City of Jefferson,
Missouri, believe an election should be held in the City to
determine if a majority of the qualified voters voting thereat are
in favor of extending the limits of the City to include the
unincorporated areas of land hereinbefore described;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. An election shall be held in the City of
Jefferson, County of Cole, Missouri, on Tuesday, the 6th day of
April, 1976, in order to submit to the qualified voters of said
City the following proposition, to-wit:
PROPOSITION NO. 1.
That the corporate limits of the City of Jefferson, Missouri,
shall be extended to include the following described unincorporated
area of land contiguous to the present city corporate limits:
Beginning at the northeast corner of New Madrid
Private Survey 2638, thence southerly along the east
line of said Private Survey 2638 a distance of 4086. 8
feet; thence north 64°11 ' west, 2635.07 feet; thence
south 84°15' west, 1466.89 feet; thence south 6°00' east
to the center of the Missouri River; thence southeasterly
along the centerline of the Missouri River to the north-
south quarter-quarter section line in the west half of
Section 23, Township 44 North, Range 11 West; thence
northerly along the quarter-quarter section lines of
Sections 23, 14 and 11 of Township 44 North, Range 11

West, to the toe of the bluff; thence northwesterly
along the toe of the bluff to its intersection with
the south bank of the Halifax Diversion Channel, said
intersection being approximately 300 feet east of the
centerline of U. S.Route 54 and approximately 900 feet
north of the centerline of the M.K.& T. Railroad;
thence northwesterly along the south bank of the Halifax
Diversion Channel to its intersection with Turkey Creek;
thence westerly and southerly along the south and east
banks of Turkey Creek to a point lying 200 feet perpen-
dicularly from the north right-of-way line of present
U.S.Route 63 ; thence southeasterly and parallel to the
northerly right-of-way line of present U. S.Route 63 to
a point lying south 56°12 ' west of Station 7569+27.2
on the north ri§ht-of-way line of the M.K.& T. Railroad;
thence north 56 12' east to said Station 7569+27.2 on
the north right-of-way line of the M.K.& T. Railroad;
thence southeasterly along the/north right-of way line
of the M.K.& T. Railroad to the west line of Section 11,
Township 44 North, Range 11 West; thence southerly to
the point of beginning, all in Callaway County, Missouri.
Section 2. That the said election shall be held in all wards
and precincts in the City at the polling places selected by the
City Council and published as provided for in Section 10.080 and
10.090 of Ordinance No. 7593 of the City, as amended. Polls of
said election shall be open at the hour of six A.M. , and continue
open until the hour of seven P.M. , on said date. Said election
shall be held and conducted and the results thereof shall be
certified, canvassed, and declared in all respects in conformity
with the Constitution and Laws of the State of Missouri governing
elections in said City of Jefferson, and in accordance with the
ordinances of said City.
Section 3. That the City Clerk be and she is hereby
authorized and directed to give notice of said election by
publication in the Jefferson City Post-Tribune, a daily newspaper
printed and published in the City of Jefferson and of general
circulation therein. Said notice shall be published in said
newspaper once a week for four consecutive weeks , and on the same
day in each week. The first publication of said notice shall be
made at least twenty-one (21) days before the date of said election
and the last publication shall be made within ten (10) days of the
date of said election. The notice to be published shall be
substantially in the following form, to-wit:

CITY OF JEFFERSON, MISSOURI.
Notice is hereby given that an Election shall be held in the City
of Jefferson, Cole County, Missouri, on Tuesday, April 6, 1976, to
submit to the qualified voters of the City the following
proposition:

That the corporate limits of the City of Jefferson, Missouri, shall
be extended to include the following unincorporated area of land
contiguous to the corporate city limits :

half of Section 23, Township 44 North, Range 11 West;
thence northerly along the quarter-quarter section lines
of Sections 23, 14 and 11 of Township 44 North, Range 11
West, to the toe of the bluff; thence northwesterly
along the toe of the bluff to its intersection with the
south bank of the Halifax Diversion Channel, said
intersection being approximately 300 feet east of the
centerline of U.S.Route 54 and approximately 900 feet
north of the centerline of the M.K.& T. Railroad; thence
northwesterly along the south bank of the Halifax Diversion
Channel to its intersection with Turkey Creek; thence
westerly and southerly along the south and east banks of
Turkey Creek to a point lying 200 feet perpendicularly
from the north right-of-way line of present U.S. Route 63;
® thence southeasterly and parallel to the northerly right-
of-way line of present U.S.Route 63 to a point lying
south 56°12' west of Station 7569+27.2 on the north
right-of-way line of the M.K.& T. Railroad; thence north
56 12 ' east to said Station 7569+27. 2 on the north right-
of-way line of the M.K.& T. Railroad; thence southeasterly
along the north right-of-way line of the M.K.& T. Railroad
to the west line of Section 11, Township 44 North, Range
11 West; thence southerly to the point of beginning, all
in Callaway County, Missouri.
The election will be held at the voting places in each precinct of
each ward of the City to be selected by the City Council and
published in the manner provided by ordinance.
The polls at said election shall be open at the hour of six o'clock
lH.M. and will continue open until the hour of seven o'clock P.M. on
said date.
All persons who are legal voters in said City will be entitled to
vote at said election.
Given under my hand and corporate seal of the City of
Jefferson, Missouri, this day of February, 1976.

Section 4. The City Clerk is hereby authorized and directed
to furnish the judges and clerks of said election with all poll
books , tally sheets, ballots , ballot boxes and all other materials
and supplies necessary and required for the conduct of said
election, and the ballot to be so provided shall be printed in
substantially the following form:

thence southerly to the point of beginning, all in
Callaway County, Missouri.
