Eastern Standard Time From: To: One ruling on my request to remove some trees at 9 Shipwatch Circle was that removing the magnolia that was among them required a mitigation fee of $450. 1 am appealing that decision. The tree ordinance requires mitigation only for the removal of significant trees and the definition of a significant tree includes that it has a DBH of ten inches or greater. The magnolia in question is one that I planted several years ago and now has several dead limbs. It has two trunks, six and three inches in diameter.
