PAUL STREET BETWEEN FSSISSIPPI STREET AND NOTRE DAME STREET RESERVING TO THE CITY AN �13ASEMENT IN THE RIGHT OF WAY VACATED FOR SANITARY SEWER, SURFACE ATER DRAINAGE, AND PUBLIC UTILITY PURPOSES, AND AUTHORIZING AND IIRECTING THE MAYOR AND CLERK OF THE CITY TO EXECUTE ALL INSTRUMENT REQUIRED TO CONFIRM IN THE ABUTTING PROPERTY OWNERS THEIR RIGHT OF VERSION IN THE VACATED AREA. WHEREAS, it has been shown to the City Council of the City of { efferson, Missouri, that owners of land adjacent to and abutting 1hpon a portion of St. Paul Street between Mississippi Street and �otre Dame Street , have petitioned the City Council to vacate a �art of the right of way of Water Street as a public thoroughfare; f Ld WHEREAS, it has further been shown that it would not inconven- ience the public or the citizens of the City to discontinue as a right of way for a public thoroughfare and vacate a part of St. Pau � l 16treet, as described in Section 1 of this ordinance, subject to a �eservation in the City of an easement in that portion of St. Paul treet vacated for the maintenance, repair, location and relocatio t f all sanitary sewer, surface water sewer or public utility facili�- ies now existing or hereafter to be constructed within said right f way, NOW THEREFORE E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MI195OU I, S FOLLOWS: Section 1. The City Council of the City of Jefferson, Missour' , hereby declares it necessary, reasonable and proper to discontinue _ as a right of way for a public thoroughfare and forever vacate the ollowing described portion of St. Paul Street in said/City, sub- i�. ect to the reservation in -the City of the easement mentioned in ection 2 of this ordinance: s "All that portion of St. Paul Street between Mississippi Street and Notre Dame Street adjacent to Lots 122, 123, 79 and 80 of Wolfrum Subdivision. " t t ({i Section 2. The City of Jefferson, Missouri, does hereby ex- j pressly reserve to itself, its successors and licensees, and all 1public utility companies within the City, an easement in, under, over and upon that portion of the right of way of St. Paul Street, as described in Section 1 of this ordinance, for purposes of repai - ing, maintaining, servicing, locating and relocating all sanitary sewer surfact water drainage and public utility facilities now ex- isting or hereafter to be constructed within said area. Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, subject to the easement expressly reserved in Section 2 of this ordinance, as is provided • by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized and directed to execute all inst u- ments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 0 this ordinance, in the right of way vacated.
