HomeMy Public PortalAboutORD09011 f ! � I ILL NO. y� ,INTRODUCED BY COUNCILMAN ORDINANCE NO. q u ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING RDINANCE NO. 7950 OF THE CITY OF JEFFERSON, MISSOURI , ECLARING TREES ON PRIVATE PROPERTY TO BE A NUISANCE UNDER ERTAI,N-CONDITIONS, BY REPEALING SECTIONS 6, 7 AND 8 THEREOF, ND BY ENACTING IN LIEU THEREOF NEW SECTIONS 6 , 7 AND 8 EATING TO THE SAME SUBJECT MATTER. E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, ISSOURI, AS FOLLOWS : Section 1. Sections 6 , 7 and 8 of Ordinance No. 7950, f the City of Jefferson, Missouri, be and the same are ereby repealed. Section 2,. There are hereby enacted three (3) new provisions to be known as Sections 6, 7 and 8 authorizing for the abatement of trees on private property which are Lclared to be a nuisance, as follows : I ORDINANCE NO. 7950 Section 6. Abatement of Nuisance By_ City and Collection of Costs. In any case where a person required under Sections 1 and 2 hereof cannot be compelled for any reason to abate the nuisance defined in said Section, by prosecution under Section 7 hereof, the City, through { its contractors and/or agents, may enter upon the premises, cut the trees and/or branches, and abate such nuisance. The City shall solicit and take at least two (2) competitive bids from persons, firms or corporations engaged in the business of cutting trees and award the job of cutting the trees and/or branches to the lowest bidder. When the contractor selected by the City cuts the trees and/or branches on the premises where the condition of nuisance existed, the City shall issue its warrant to the contractor, in payment for said work, and the City Clerk shall certify to the City Collector the cost of the work, and the City Collector shall add the cost thereof to the tax bill on the real estate involved, and the cost of cutting the trees and/or branches shall be collected by the City Collector at the same time and in the same manner as other taxes on said realty are collected annually. Section 7. Failure to Abate Nuisance a Misdemeanor. Any person notified to cut trees and/or branches within ten (10) days of such notice, who shall fail to do so and abate such nuisance within the time specified in the notice, shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine of not more than One Hundred ($100.00) Dollars; and every day I. such nuisance continues after the date specified for the abatement thereof in the notice provided for in Section 5, shall constitute a separate and distinct offense, punishable by a like fine. Section 8. Right of Entry on Premises. Any person or contractor employed or contracted by the City Department of Health for the abatement of a nuisance, and any agent or employee of such contractor, shall have the right of entry for that purpose into and upon any premises, and it shall be unlawful to interfere with any person or contractor, contracted by the City Department of Health, for the purpose of sanitary inspection, or the discovery for abatement of any nuisance.
