PROFESSIONAL SERVICE CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to design plans and
specifications and perform engineering services during construction of the Post
Boulevard, repair and repaving project (the "Project"); and
WHEREAS, engineering is a a professional service exempt from the requirement
of public bidding pursuant to NJ.SA. 40A:l 1-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Killam Associates at
a maximum cost not to exceed $29,400.00 billable per attached contract.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with NJ. SA 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.
BE IT FURTHER RESOLVED that the Purchasing Agent be and is hereby
authorized to advertise the Project for competitive bids in accordance with law.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on June 30, 1998.

As per Resolution Number 98-184.
THE CONTRACTOR does hereby agree to perform the following
ENGINEERING SERVICE FOR PLANS & SPECIFICATIONS DURING
CONSTRUCTION OF POST BLVD., REPAIR AND REPAVING PROJECT.
NOT TO EXCEED $29,400.00
THE INDEMNIFICATION AGREEMENT ON THE REVERSE OF THE PURCHASE ORDER SHALL BE LIMITED
TO THE VENDOR's NEGLIGENT OR WRONGFUL ACTS.
According to the terms set forth in RESOLUTION., and Purchase Order 98-1618.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
IN WITNESS WHEREOF, the parties hereto have hereunder set their hands and seals or
caused these presents to be signed by their proper corporate officers and their corporate
seals to be hereto affixed, the day and year written above.
