AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
AND DIRECTING THE MAYOR AND CLERK OF THE CITY TO EXECUTE A
WRITTEN AGREEMENT WITH THE MISSOURI STATE HIGHWAY COMMISSIO
ON MAINTENANCE OF OLD ROUTE "B".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk of the City are hereby authorized and
directed, for and in the name of the City, to execute a written agreement with
the Missouri State Highway Commission on maintenance of that portion of
old Route "B" located inside the City Limits.
SECTION 2. Said agreement shall read in words and figures as follows:

SECTION 3. This ordinance shall take effect and be in force from and after
its passage and approval.

MAINTENANCE AGREEMENT
This agreement executed on this AV " day of
19 , by the State Highway Commission of Missouri, hereinafter called

"Commission", and the City of Jefferson City, hereinafter called "Agency":
Because of the construction of a relocated section of highway, Commis-
sion no longer considers it economically feasible to maintain a section of
state highway,designated as State Route B, Cole County, from Station 39+25
to Station 45+30, as shown on Exhibit A attached hereto and made a part here-

of, said section of highway generally extending from existing Route B begin-
. '
ning at Station 39+25 and extending in a southerly direction for a distance
of 0.115 miles to Station 45+30. The said section of old Route B is located
Ah in Section 29, Township_44 North, Range 11 West. However, because of a desire
of Agency to maintain said section of highway to provide service to certain
areas, Commission will retain said highway so long as Agency, with its own
forces or by contract, shall provide reasonable maintenance thereon in a
manner similar to other highways maintained by Agency in the area.
in the event said highway is not maintained in an acceptable manner by
Agency, 'then Commission may, after 60-day notice to Agency of its intention
to do so, terminate this maintenance agreement and abandon the right-of-way
for said highway, so that same may be disposed of by Commission in the man-
ner provided by law.
In the event Agency shall find that there is no longer cause for main-
tenance of the section of highway herein involved, and shall so advie Commis-
sion, Commission will then advise Agency of the date on which maintenance may
terminate, such date to be within 90 days from receipt of such notice from
the Agency to the Commission.
This contract is executed under authority of Section 31, Article IV,
Constitution of Missouri, 1945, authorizing maintenance of state highways
by political subdivisions.
