Chairman Sobkoviak called the meeting to order at 7:00 p.m., and led the pledge to the flag. Roll
call was taken, the Park, School, Fire and Library district representatives were absent. The
December 5, 1995 minutes were approved as presented. Chairman Sobkoviak wished the Plan
Commission Happy Holidays, and congratulated Jeff on being employee of the year. He also
challenged the Plan Commission to come up with ideas for buffering the houses that back up to
arterials, besides using fences for privacy.
PLANNING & DEVELOPMENT REPORT:
Planner Durbin reported:
Thornton Oil signage and outside sales will be brought into compliance. The Keller Annexation
Agreement public heariang was held. Utility tax at 4% was passed excluding government. Wallin
Woods was tabled, the downtown design competition has been started, and we will forward a letter
of intent. The Sweetwood Annexation was approved, and the Ordinance for the Comprehensive
Plan was approved.
The secretary was directed to publish the 1996 schedule for the Plan Commission.

This Annexation Agreement proposes the establishment of B -3 zoning for the 27 acre site. Staff finds
this zoning to be acceptable under the new Comprehensive Plan and the Village's downtown sector
plan.
The Annexation Agreement does not provide for any freeze of Zoning Ordinance, Building Codes,
Subdivision Ordinances or other governing standards that apply to development on the subject site.
The applicants have agreed to develop their property in accordance with standards applicable at the
time of development.
The developers have agreed to pay any an all lawfully imposed recapture fees. The developers have
asked to establish a recapture ordinance in the event they have oversized or deepened their utilities
for their benefit of adjoining properties while incurring extra costs on themselves to do so. This is
generally acceptable. The Village has in the past entered into similar agreements with other parties.
The agreement provides that the Village shall guarantee at no cost to the owner /developer sufficient
plant capacity to adequately treat sewage generated from the property when fully developed. The
agreement however requires 12 months prior notice of pending dvelopment and the guarantee is
to be limited to 500 PE or 50,000 gal per day. This provision does not provide waiver of any tap -on
fees for the sanitary sewer plant usage.

The developer has asked for conditional site development permit for grading of the subject property
prior to Final Plat approval. The agreement requires that the property owners or developer assume
all risk with regard to such work, and therefore have agreed to modify any grades contrary to the
final grading plan.
This paragraph provides that the developer shall not be obligated to construct roadway
improvements not provided for as part of this agreement or plans for development of the property
that they may later submit. Reference to Preliminary Plat should be added to this paragraph for sake
of clarification.
This section provides for waiver of the Village's $1750 per acre residential Annexation Impact Fee
and waiver of the $3500 per acre Commercial Annexation Impact Fees. Additionally the applicants
have asked that no zoning fees be imposed upon the subject property as well.
The Annexation Agreement recognizes that the Postal Service shall not be subject to regulations
under local Zoning and Building Codes. The agreement also specifies that the Postal Service
property will be developed for postal purposes in accordance with current plans recently presented
to the Village. The agreement allows for construction of the Post Office facilities prior to the
establishment of B -3 Business zoning if desired.
The Annexation Agreement as presented with this report is in general compliance with Village
policies and previously submitted staff review materials. No major issues remain unresolved with
regard to the Keller Annexation Agreement. Therefore, Staff has no objections to proceeding with
Ordinances in this case.
Staff recommended approval of the Annexation Agreement with minor revisions.
Discussion of the Commissioners included the total monies requested to be waived. A rough
estimate by T. Spika, was $95,000.00. Debate centered around the value of the six acres given to
the Post Office, in relation to the $95,000.00 fees waived. It was decided that a note be made in
the minutes that it is recommended that these waivers have been allowed because of the six acre
site donated for a Post Office, to allow an extention of the downtown core area to the west. It was
felt that was an appropriate vehicle to accomplish that objective. R. Schinderle made a motion to
recommend to the Village Board, the approval of the Annexation Agreement subject to the deletion
of the last two lines of Paragraph 3, and the establishment of B -3 Zoning for Case No. 511 -
111595.AA. The Plan Commission felt the waiver of Impact Fees should be granted due to the
petioner donating six acres for the Post Office in that it is the Village's wish to extend the down
town core area to the west. Seconded by L. Kachel. Roll call vote. K. O'Connell, yes; L. Kachel,
yes; T. Spika, yes; R. Schinderle, yes; W. Manning, yes; A. Anderson, yes; Chairman
Sobkoviak, yes. Motion carried. 7 yes 0 no.
