AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, ORDERING A SPECIAL ELECTION TO
DETERMINE WHETHER TO WITHDRAW FROM THE FORT WORTH
TRANSPORTATION AUTHORITY, SUCH SPECIAL ELECTION TO BE
HELD ON SATURDAY, MAY 14, 2016; ESTABLISHING PROCEDURES
FOR THE ELECTION, INCLUDING EARLY VOTING, AUTHORIZING
A JOINT ELECTION ADMINISTRATION CONTRACT WITH
TARRANT COUNTY; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR NOTICE AND PUBLICATION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 41.001 of the Texas Election Code (the "Code") specifies that the
second Saturday in May is a "Uniform Election Date" and that a special election of a City may
be held on such day; and
WHEREAS, May 14, 2016 is thus designated as a uniform election day; and
WHEREAS, by this Ordinance, it is the intention of the City Council to call a special
election to submit the issue of whether the City of Richland Hills, as a unit of election, should
withdraw from the Fort Worth Transportation Authority, such special election to be held on the
uniform election date referred to above; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for Special Election.
The City Council hereby orders that a special election shall be held in the City of
Richland Hills on Saturday, May 14, 2016 (or on an earlier date if authorized by the legislature
or a court of competent jurisdiction), at which there shall be submitted to the qualified voters of
Richland Hills for adoption or rejection the following proposition:
Shall the Fort Worth Transportation Authority be continued in the City of
Richland Hills?
YES

Section 2. Joint Election Administration Contract.
The City Secretary is hereby authorized to contract (the "Contract") with Tarrant County
for joint election services. In the event of a conflict between this Ordinance and the Contract, the
Contract shall control.

Section 3. Polling Place.
The main polling place for the Election shall be as follows:
Richland Hills Community Center
3204 Diana Drive
Richland Hills, Texas
Other polling places may be provided as provided in the Contract. The polls shall be open from
7:00 a.m. to 7:00 p.m. on the date of the election, in accordance with and pursuant to the
requirements of the Texas Election Code.
The City shall constitute a single election precinct for said election.
Section 4. Ballots and Election Method.
Combined ballots may be utilized containing all of the offices and propositions to be
voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote
for any office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance shall be conducted exclusively on Tarrant County's electronic voting system, or as
otherwise provided in the Contract. On Election Day, voters shall have a choice between voting
on Tarrant County's electronic voting system or by a paper ballot that is scanned at the polling
place using Tarrant County's voting system. All expenditures necessary for the conduct of the
election, the purchase of materials therefore, and the employment of all election officials are
hereby authorized, and shall be conducted in accordance with the Contract and the Code.
Section 5. Early Voting.
a. Early voting by personal appearance. The Tarrant County Elections Administrator
("Elections Administrator") is hereby designated as the Early Voting Clerk for the election, as so
indicated in the Contract. Early voting by personal appearance shall be on the dates provided by
law. The main early voting site shall be at Richland Hills Community Center, 3204 Diana Drive,
Richland Hills, Texas. Specific days, times and locations shall be designated by the Elections
Administrator and included in the Contract and shall be in compliance with state law.
b. Early voting by mail. The Elections Administrator shall be responsible for the Early
Voting applications and ballots. Applications for early voting by mail may be delivered to the
County of Tarrant, Elections Administrator, 2700 Premier Street, Fort Worth, Texas 76111, as
provided by law. The City Secretary is directed to forward applications and ballots she may
receive to the Elections Administrator as provided in the Contract.
c. Early Voting Ballot Board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the

Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 6. Notice.
Notice of said election shall be given as required by the Texas Election Code, and a copy
of this Ordinance shall be sent to the Executive Committee of the Fort Worth Transportation
Authority, the Texas Department of Transportation and the Comptroller immediately upon
approval of the City Council.
Section 7. Election Officials.
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as authorized in the Contract and Chapter 271 of the
Texas Election Code. The presiding judge shall appoint elections clerks as may be necessary for
the proper conduct of the election. The election judge, or the alternate election judge in the
absence of the election judge, and the election clerks shall constitute the early voting ballot
board. The election judge, and alternate election judge, and election clerks shall be qualified
voters of the city.
Section 8. Governing Law.
The election shall be held in accordance with the City Charter, the Constitution of the
State of Texas, the Texas Election Code, and Texas Transportation Code Chapter 452, and all
resident qualified voters of the City shall be eligible to vote at the election.
Section 9. Necessary Actions.
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, Texas Transportation Code Chapter 452, the City Charter, and the City Code in carrying
out and conducting the election, whether or not expressly authorized by this Order.
Section 10. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.

Section 11. Notice and Publication.
This Ordinance shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the Special
Election. A copy of the Ordinance shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least one year before the election. Notice shall be
published in the newspaper in accordance with state law.
Section 12. Effective Date.
This order shall be effective upon adoption, signature and attestation.

UNA ORDENANZA DEL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, QUE ORDENA UNA ELECCION
ESPECIAL PARA DETERMINAR SI HA DE RETIRARSE DE LA
AUTORIDAD DE TRANSPORTE DE FORT WORTH, TAL ELECCION
ESPECIAL SE CELEBRARA EL SABADO 14 DE MAYO DE 2016; SE
ESTABLECEN PROCEDIMIENTOS PARR LA ELECCION,
INCLUYENDO LA VOTACION ANTICIPADA, QUE AUTORIZA EL
CONTRATO DE ADMINISTRACION DE UNA ELECCION CONJUNTA
CON EL CONDADO DE TARRANT; COMPRENDE UNA CLAUSULA
DE DIVISIBILIDAD; COMPRENDE LA NOTIFICACION Y
PUBLICACIUN; E INCLUYE UNA FECHA DE VIGENCIA.
POR CUANTO, la Seccion 41.001 del Codigo Electoral de Texas (el "Codigo") precise
que el segundo sabado de mayo es la "Fecha de Eleccion Uniforme" y que una eleccion especial
de la Ciudad podra ser celebrada en dicho dia; y
POR CUANTO, el 14 de mayo de 2016, por to tanto, se designa como el dia de la
eleccion uniforme; y
POR CUANTO, mediante esta ordenanza, es la intencion del Concejo Municipal de
convocar una eleccion especial para presenter la cuestion de si la Ciudad de Richland Hills,
como unidad electoral, debe retirarse de la Autoridad de Transporte de Fort Worth, dicha
eleccion se celebrara en la fecha de eleccion uniforme antes mencionada; y
AHORA, POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, RESUELVE QUE:
Seccion 1. La Orden Electoral para la Eleccion Especial.
El Concejo Municipal ordena, por la presente, que una eleccion especial se celebre en la
Ciudad de Richland Hills el sabado 14 de mayo de 2016, (o en una fecha mas temprano si
autorizado por la legislature o un Corte de competente jurisdiccion)en la que se sometera a los
votantes calificados de Richland Hills la aprobacion o rechazo de la siguiente proposicion:
~Se debera continuer con la Autoridad de Transporte de Fort Worth en la Ciudad
de Richland Hills?

Seccion 2. El Contrato de Administracion de la Eleccion Conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a contratar (el "Contrato") con el
Condado de Tarrant para los servicios de la eleccion conjunta. En caso de conflicto entre la
presente Ordenanza y el Contrato, el Contrato prevalecera.
Seccion 3. El Centro Electoral.
El principal centro electoral para la Elecci6n sera el siguiente:
Centro Comunitario de Richland Hills
3204 Diana Drive
Richland Hills, Texas
Se podran tener otros centros electorates Began to dispuesto en el Contrato. Los lugares de
votacion se abriran de 7:00 a.m. a las 7:00 p.m. en el dia de la election, de acuerdo con y en
cumplimiento con el Codigo Electoral de Texas.
La Ciudad constituira un solo distrito para dicha election.
Seccion 4. Las papeletas y el metodo de votacion.
Se podran utilizar papeletas combinadas que contengan todos los cargos y proposiciones
que se someteran a votacion en cada centro electoral, siempre y cuando que no se le de a ningan
elector una papeleta o que se le permita votar por un cargo o proposition para la cual no es
elegible para votar. La votacion anticipada en persona se llevara a cabo exclusivamente en el
sistema electoral electronico del Condado de Tarrant o de la manera dispuesta en el Contrato. El
dia de la election los electores tendran la oportunidad de escoger entre el sistema electoral
electronico del Condado de Tarrant y la papeleta que se digitalizara (escanea) en el centro
electoral utilizando el sistema electoral del Condado de Tarrant. Todos los gastos necesarios para
la realization de la election, la compra de materiales, por to tanto, y el empleo de todos los
funcionarios electorates se autorizan, por la presente, y se llevaran a cabo de conformidad con el
Contrato y el Codigo Electoral.
Seccion 5. La Notation Anticipada.
a. La votacion anticipada en persona. Se designa por la presente al Administrador de
Elecciones del Condado de Tarrant ("El Administrador de Elecciones") como el Official de la
Election Anticipada, como asi se indica en el Contrato. La votacion anticipada en persona se
llevara a cabo en las fechas previstas por la ley. El principal centro electoral sera el Centro
Comunitario de Richland Hills ubicado en 3204 Diana Drive, Richland Hills, Texas. Los dias, las
horas y los lugares especificos seran designados por el Administrador de Elecciones e incluidos
en el Contrato y deberan estar en conformidad con la ley estatal.
b. La votacion anticipada por correo. El Administrador de Elecciones estara a cargo de
las solicitudes y las papeletas de la votacion anticipada. Las solicitudes de la votacion anticipada
por correo podran ser enviadas al Condado de Tarrant, Administrador de Elecciones, 2700
Premier Street, Fort Worth, Texas 76111, Began previsto por la ley. Se ha instruido a la

Secretaria de la Ciudad a enviar cualquier solicitud y papeleta que reciba al Administrador de
Elecciones, de acuerdo a to previsto en el contrato.
c. Junta de votacion anticipada. Los votos de la votacion temprana, tanto en persona
como por correo, seran escrutados por la Junta de Votacion Anticipada, que se crea por la
presente. De acuerdo con el contrato, el Condado de Tarrant nombrara a la Junta de Votacion
Anticipada para procesar los resultados de la eleccion anticipada.
Seccion 6. Notification.
El aviso de dicha eleccion sera dado como to exige el Codigo Electoral de Texas y una
copia de esta ordenanza debera ser enviada al Comite Ejecutivo de la Autoridad de Transporte de
Fort Worth, el Departamento de Transporte de Texas y al Contralor inmediatamente despues de
la aprobacion del Concejo Municipal.
Seccion 7. Los Funcionarios Electorates.
El juez electoral, el juez electoral suplente y la junta de la votacion seran designados por
el Administrador de Elecciones del Condado de Tarrant, segun to autorizado en el contrato y en
el capitulo 271 del Codigo Electoral de Texas. El Juez Presidente nombrara a los funcionarios
electorates que sean necesarios para que se realicen bien las elecciones. El juez electoral, o en su
ausencia, el juez electoral alterno, y los funcionarios electorates constituiran la junta de la
eleccion anticipada. El juez electoral, el juez electoral suplente y los funcionarios electorates
deberan ser electores calificados de la ciudad.
Seccion 8. La Ley Aplicable.
La eleccion debe llevarse a cabo de acuerdo a los Estatutos de la Ciudad, la Constitution
del estado de Texas, el Codigo Electoral de Texas y el capitulo 452 del Codigo de Transporte de
Texas, y todos los electores calificados residentes de la Ciudad seran elegibles para votar en la
eleccion.
Seccion 9. Las Acciones Necesarias.
El alcalde y la Secretaria de la ciudad, en consulta con el Procurador de la ciudad, estan
autorizados y dirigidos a tomar todas las acciones necesarias para cumplir con las disposiciones
del Codigo Electoral de Texas, el capitulo 452 del Codigo de Transporte de Texas, los Estatutos
de la Ciudad y el Codigo de la Ciudad para la realization de las elecciones, aunque no se haya
autorizado expresamente por la presente Orden.
Seccion 10. La Clausula de DivisibiGdad.
Se declara por la presente que es la intention del Concejo Municipal que las secciones,
parrafos, oraciones, clausulas y frases de esta orden sean divisibles y que si alguna frase,
clausula, oration, parrafo o Seccion se declarara nula o inconstitucional mediante el valido

dictamen o juicio de un tribunal de jurisdiccion competente, dicha nulidad o inconstitucionalidad
no afectara a ninguna de las restantes frases, clausulas, oraciones, parrafos y secciones de esta
orden, ya que la misma hubiese sido promulgada por el Concejo Municipal sin la incorporacion
en esta orden de dicha frase, clausula, oracion, parrafo o Seccion nula o inconstitucional.
Seccion 11. Notificacion y Publicacion.
Esta Ordenanza servira como la Orden de Eleccion (segun to exige la Seccion 3.001 del
Codigo) y como la Notificacion de Eleccion (segun to exige la Seccion 4.001 del Codigo) para la
Eleccion Especial. Una copia de la Ordenanza se publicara en el tablon de edictos que se utiliza
para publicar los avisos de las juntas del Concejo Municipal, al menos un aiio antes de la
eleccion. Se publicara en el periodico un aviso de la eleccion de conformidad con la ley estatal.
Seccion 12. Fecha de Vigencia.
Esta orden entrara en vigor tras su aprobacion, firma y certificacion.
