! AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A
REVISION AND CODIFICATION OF THE ORDINANCES OF THE CITY OF
iiJEFFERSON, MISSOURI, ENTITLED "THE CODE OF THE CITY OF JEFFERSON,
? MISSOURI", PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT
INCLUDED THEREIN, WITH CERTAIN EXCEPTIONS, AND FOR OTHER PURPOSES
I' HEREINAFTER SET OUT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
IMISSOURI, AS FOLLOWS:

+� Section 1. There is hereby adopted by the City Council that
( certain Code entitled "The Code of the City of Jefferson,
Missouri," containing certain Ordinances of a general and
�� permanent nature as compiled, consolidated, codified and indexed
,
in Chapters 1 to 36, both inclusive, of which Code not less than
three copies have been and are now filed in the office of the
City Clerk.
Section 2. The provisions of such Code shall be in force on

and after April 1, 1978, and all Ordinances of a general and
permanent nature adopted on final reading and passage on or before
January 17, 1977, and not contained in such Code are hereby
repealed from and after April 1, 1978, except as hereinafter
® provided.
I� Section 3. The repeal provided for in the preceding section
of this Ordinance shall not affect any offense or act committed
or done, or any penalty or forfeiture incurred, or any contract or
right established or accruing before April 1, 1978; nor shall it
affect any prosecution, suit or proceeding pending or any judgment
rendered prior to April 1, 1978; nor shall such repeal affect any
Ordinance or resolution promising or guaranteeing the payment of
money for the City, or authorizing the issue of any bonds of the
�{ City, or any evidence of the City' s indebtedness or any contract
jor obligation assumed by the City; nor shall it affect any annual
tax levy; nor shall it affect any right or franchise conferred by
! Ordinance or resolution of the City Council on any person or

corporation; nor shall it affect any ordinance adopted for purposes
which have been consummated; nor shall it affect any Ordinance
which is temporary, although general in effect , or special,
although permanent in effect; nor shall it affect any Ordinance
relating to the salaries , travel allowances , etc . , of the City
officers or employees ; nor shall it affect any Ordinance annexing
territory to the City; nor shall it affect any Ordinance n naming,
renaming, opening, accepting or vacating streets or alleys in the
City; nor shall it affect any Ordinance relating to the zoning
map; nor shall it affect any Ordinance adopted on final reading
land passage after January 17, 1977; nor shall it affect any of the
following Ordinances or amendments thereto: (a) Sections 1327 to
1331 of the Revised Ordinances of 1956, relative to the City Hall,
or Sections 311 to 313 of the Revised Ordinances of 1956, relative
to the City Hall janitor; (b) Ordinance No. 8017, approving and
setting forth bylaws of the Mid-Missouri Regional Planning
Commission; (c) Ordinance Nos . 8311, 8343 and 8555, authorizing
mutual assistance contracts between the City and certain other
Missouri political subdivisions for cooperation between the Fire
Departments of the contracting parties in case of major conflagra-
tion or disaster; or (d) Ordinance No. 8627, authorizing a
contract for mutual police cooperation and assistance between the
City and certain other Missouri municipalities .
Section 4. Except as provided in the Code adopted by this
Ordinance, whenever in such Code or in any ,bther Ordinance of the
City, or in any rule, regulation or order promulgated pursuant to
such Code or other Ordinance of the City, any act is prohibited or
is made or declared to be unlawful or an offense or a misdemeanor,
or whenever in such Code, or in such other City Ordinance, rule,
regulation or order the doing of any act is required or the failure
to do any act is declared to be unlawful, where no specific

penalty is provided therefor, the violation of any such provision
of the Code adopted by this Ordinance or any other Ordinance of

the City or of any rule, regulation or order promulgated pursuant
to such Code or other City Ordinance, shall be punished by a fine
not exceeding five hundred ($500.00) dollars, or by imprisonment
for a period of not exceeding three (3) months, or by both such
fine and imprisonment.
Whenever any provision of the Revised Statutes of
Missouri, or other statute of the state, limits the authority of
the City to punish the violation of any particular provision of
the Code adopted by this Ordinance or other City Ordinance or rule,
regulation or order promulgated pursuant thereto to a fine of less
amount than that provided in this section, or imprisonment for a
shorter term than that provided in this section, the violation of
such particular provision of such Code or other City Ordinance,
rule, regulation or order shall be punished by the imposition of
not more than the maximum fine or imprisonment so authorized, or by
both such fine and imprisonment.
Whenever any provision of the Revised Statutes of
Missouri, or other statute of the state, establishes a penalty
differiiAgg from that provided by this section, for an offense
similar to any offense established by the Code adopted by this
Ordinance or other Ordinance, rule, regulation or order of the
City, the violation of such City law, Ordinance, rule, regulation
or order shall be punished by the fine or imprisonment established

for such similar offense by such state law.
Each day any violation of the Code adopted by
this Ordinance, or any other City Ordinance or rule, regulation or
order promulgated pursuant thereto, shall continue shall constittut.e

Section 5. It is hereby declared to be the intention of the

City Council that the sections , paragraphs , sentences , clauses and
+" phrases of this Ordinance and the Code hereby adopted are
severable, and if any phrase, clause, sentence, paragraph or
section of this Ordinance or the Code hereby adopted shall be
declared unconstitutional or otherwise invalid by the valid

judgment or decree of a court of competent jurisdiction, such
unconstitutionality or invalidity shall not affect any of the
remaining phrases, clauses , sentences , paragraphs and sections of
this Ordinance, or the Code hereby adopted.
Section 6. This Ordinance shall be in full force and effect
