Consola, M. Krippel, EX-OFFICIO PRESENT: M. Gehrke ALSO PRESENT: P. J. Waldock, Village Planner S. Hart, Secretary Chairman Sobkoviak called the meeting to order at 7:05 p.m. Roll call was taken. J. Ray, R. Zimmerman,G. Krahn, K. Hummel, J. Eichelberger, and G. Bott were absent. There being no additions or corrections, Chairman Sobkoviak declared the minutes of January 7, 1992 approved. Continuing Case No. 237-0101789Z Continuation of the Zoning Ordinance Update Process. General discussion regarding Public Hearings, and the Zoning Map, the need for notification of landowners and the plans for Public Hearings, regarding the zoning ordinances. JACK LOMAR (RESIDENT): Pete could you go through this once more as to how this PUD will effect my property? P. WALDOCK: What we had anticipated there was down zoning the adjoining property. And then providing for a PUD designation adjoining that zoning, which allows for continued use of existing retail occupants of that site. JACK LOMAR: The hardware is now closed, I am concerned about what might go in there, with the PUD designation. With a PUD just about anything could go in there. That bothers me. M, KRIPPEL: They can propose anything. P. WALDOCK: it will still require public hearings, to do any land use that is not specifically listed. You would follow all the same steps that you would to rezone any property. Even without a PUD designation, someone could request a rezoning of the property. You haven't lost anything with a PUD designation, in fact you have gained, because of the extra restrictions of that category. JACK LOMAR: Once you pass this thing, it will be Village wide, how will you stop an individual? PLAN COMMISSION MINUTES January 21, 1992 Page 2 P. WALDOCK: Through the legal rezoning process, just deny it. JACK LOMAR: I think the purpose of zoning is to protect the Single- Family home owner. P. WALDOCK: I agree, the purpose of zoning is to provide for an organized land use pattern within a community, so that it protects not only Single-Family home owners, but it protects apartment owners, all property owners. Jack has indicated that B-2 allows more under this text, than B-2 does today. He has indicated that he would be concerned if B-2 would be established for the John Bays property, next door to his house, without some more constrictive controls. That is why I proposed B-1 with a PUD. To make every- body happy, if he can't agree with that, we may change our proposal to get something that the neighborhood can live with as well as Mr. Bays. JACK LOMAR: That is with the existing covenants, can they be changed. P. WALDOCK: By mutual consent. The covenant is between the Village and the property owner. JACK LOMAR: He got that B-2 zoning because of the Covenants. P. WALDOCK: I believe he will be agreeable to a PUDI because it is the same thing he agreed to in 1985. obviously the mapping issue is going to be a delicate one. I don't think at this point we should let that influence how we draft our text. We should start out with our ideal, and give it a chance to make it work. M. KRIPPEL: Pete, before we go too far into this process and public hearings, I think it makes sense to review the document at a whole, then once we have done that, take a look at the map. P. WALDOCK: When we pass the draft on to the Village Board, our next step will be to look at the map, I want to get the draft out of the way before we start on the map. M. KRIPPEL: To identify any problem areas on the map in the event we have to pull the document back and make some changes as a result of viewing the map. P. WALDOCK: The next step that we will do, is the Village attorney and I will sit down, and he will have an opportunity to through this in greater detail than he has now. The text is based on an established code with in the State of Illinois, so he is not anticipating finding a great deal of legal concerns, I expect him also to find some areas of disagreement. BASEMENT: delete "partly" and add 1150% or more below grade." FLOOR AREA: "basement floor area" Check for conflict with bulk requirements. Check for draft to define tri-level. MOBIL HOME: If we are not going to address them in the ordinance, we ought not to address them in the definitions. or check out Naperville, or Aurora Mobil Home provisions Ordinance.
