ORDINANCE NO.
N ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
THE MAYOR AND CLERK OF THE CITY TO EXECUTE A CONTRACT WITH
JOHN L. HUNTER, INC. , FOR THE RENOVATION OF LIGHTING, FIRST
LEVEL, EXISTING CITY PARKING GARAGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk of the City are hereby authorized
and directed, for and in the name of the City of Jefferson, to execute a written
contract with John L. Hunter, Inc. ,for the renovation of lighting, first level,
existing city parking garage for the sum of $6, 400. 00.
SECTION 2. A copy of said c ontract is attached hereto.
SECTION 3. This ordinance shall take effect and be in force from and
after its passage and approval.

THU AGREEMLNT, made and entered into this .`' day- of
1978 , by and between the City of
Je erson City, Missouri , Party of the First Part , here-
inafter referred to as the "OWNER" and John L Hunter , Inc .
Party of the Second Part , hereinafter referred to as the
"CONTRACTOR" for the Renovation of Lighting, First Level ,
Existing Parking Garage .
WITNESSETH:
ARTICLE 1 . It is hereby mutually agreed that for and
in cosnidera ion of the payments as provided for herein to
the Contractor by the Owner, the said Contractor shall
furnish all labor, equipment , and material and shall perform
all work necessary to complete the improvements in a good
and substantial manner, ready for use and in strict accord-
ance with this contract , a copy of which is filed pursuant
to the law in the office of the legal representative of the
Owner.
ARTICLE 2 . It is hereby turther agreed that in consider-
ationof the faithful performance of the work by the Contractor ,
the Owner shall pay the Contractor the compensation due him
by reason of said faithful performance of the work, at stated
intervals and in the amount certified by the Engineer , in
accordance with the provisions of this Contract . Based upon
estimated quantities used to evaluate the total estimated
contract price for work included in the Contract is the sum
of Six Thousand Four Hundred and 00/100 ($6 ,400 . 00) .
ARTICLE 3 . It is hereby further agreed that , at the
completion of the work and its acceptance by the Owner, all
sums due the Contractor be reason of this faithfull perform-
. anee of the work, taking into consideraLLon additions to or
deductions from the contract price by reason of alterations
or modifications of the original contract by reason of "Force
Account" work authorized under this contract in accordance
with the provisions of this contract , will be paid the
t Contractor by the Owner after ;aid completion and acceptance .

ARTICLE 4. It is hereby further agreed that any reference
herein to the Contract" shall include all "Contract Documents"
as the same are listed and described in the General Conditions ,
Special Conditions issued in connection with the City of
Jefferson City, Missouri , Renovation of Lighting of the First
Level of the Existing Parking Garage , made a part of this
agreement as fully as if set out at a length herein, and that
this contract is limited to the items in the Proposal as signed
by the "Contractor" and included in the "Contract Documents".
ARTICLE 5 . In conformity with the Special Provisions
of these specifications , the amount of liquidated damages
for this contract shall be Fifty Dollars ($50. 00) per working
day. This contract shall be completed within ninety (90)
working days .
IN WITNESS WHEREOF, the Party of the First Part and the
Party of the Second Part , respectively, have caused this
agreement to be duly executed in the day and year first
written herein in five (5) copies , all of which to all
intents and purposes shall be considered as the original.
