ORDINANCE NO. 9�to AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CLERK OF THE CITY TO EXECUTE A CONTRACT WITH THE CAPITAL CITY TELEPHONE COMPANY, RELATING TO THE 911 EMERGENCY SERVICE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City of Jefferson, to execute a written contract with the Capital City Telephone Company, relating to the 911 Emergency Service. Section 2. A copy of said Contract is hereto attached. Section 3. This ordinance shall take effect and be in force from and after the date of its passage and approval. (Description and Location of Equipment, Facilities, and Service) In the event that the contract for the use of the equipment, facilities, or service described above is terminated by the customer within the minimum service period of 60 months, the undersigned customer, or its assigns, agrees to pay to the Telephone Company termination charges equal to S 1 I ,1 Rn nn reduced by 1/ 60 for each month service is retained, with propor- tionate reductions for fractional portions of a month. Where the 'use of a portion of the equipment, facilities, or service, subject to termination charges under this agreement, is terminated within the minimum service period, termination charges apply equal to the Ift-Ija net cost of that portion of the equipment or facilities, the use of which is terminated, reduced 60 for each month service is retained, with proportionate reductions for fractional portions of a month. If, at the customer's request, engineering, manufacturing, or installation work once begun is stopped and the installation is not completed, the customer agrees to pay the net costs incurred in lieu of the above termination charge. (Description and Location of Equipment, Facilities, and Service) In the event that the contract for the use of the equipment, facilities, or service described above is terminated by the customer within the minimum service period of 60 months, the undersigned customer, or its assigns, agrees to pay to the Telephone Company termination charges equal to $ 31.820.00 reduced by 1/ 60 for each month service is retained, with propor- tionate reductions for fractional portions of a month.
