Chairman Simmons called the meeting to order at 7:30 p.m. Roll call
was taken. L. Kelly, D. Norris, J. Eichelberger, and J. Wilson were
absent.
Chairman Simmons declared the minutes of the April 18, 1989 meeting
approved as presented upon Secretary checking tape regarding the
sentence "They could live with B -4, but do not like the B -3;" on the
second page, last paragraph. This is correct. The homeowners were
stating they could live with the B -4 paralleling Route 30, but do not
like the B -3 on about 14 acres of the site because of impact on Lake
Renwick, buffering, and what types of businesses will go in.
Case No. 217- 41489AZ Chobar Trust Annexation Agreement and
Establishment of I -1 Industrial Zoning. Location: Van Dyke Road
along east side of Van Dyke between 143rd and the EJ &E tracks.
Applicant,. James K. Chobar Jr. Trust is requesting annexation of a
triangular parcel located on the east side of Van Dyke Road. The area
is surrounded by industrial zoning. The Comprehensive Plan projects
industrial uses for the subject site. Property is developed at this
time with a metal storage building 42' x 138.5'. Also on the site is
a single- family residence and metal shed to the rear of the residence.
The annexation agreement proposes the establishment of I -1 industrial
zoning on the site as well as providing for the continuance of the
existing land uses. Presently there is a towing operation utilizing the
site. There is an occupied residence on the site. This is not in
conformance with the I -1 standards. The annexation agreement addresses
this issue and allows for the continuance of this nonconforming use.
Also included with this agreement is the desire to split the property.
The parcel is now one property. Lot split proposal is also requested
for approval with the annexation agreement.
No major issues identified with this annexation agreement. The zoning
is compatible. The land uses have been previously determined to be
consistent with I -1 regulations as long as storage is completely
enclosed. In this case a fence would be suitable. The fence is also
addressed in the annexation agreement.

Mr. Chobar stated they have already put up a nice fence of about
125 feet to screen the cars from the public. He has no objection to
the screening of the cars.

the house was damaged more than 500. Mr. Chobar stated he requested
a stipulation that he be allowed to rebuild at his discretion and not
have to come back to the Board.
Mr. Waldock referred to paragraph 9 in the Annexation Agreement. The
Board interpreted this paragraph to say that the house could be
rebuilt.
No objections were received from adjoining landowners.
J. Sobkoviak moved to recommend to the Village Board that they approve
the Annexation Agreement and establishment of I -1 zoning with the
stipulation of moving the pool within 10 feet of the lot line, and
including subdivision of the property as shown on the sketch. Seconded
by J. Anderson. Vote by roll call.
Krippel, yes; Sobkoviak, yes; Schempf, yes; Anderson, yes; Mentzer, yes;
Bayer, yes; Simmons, yes. 7 yes, 0 no. Motion carried.
