AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING
AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY TO EXECUTE
A WRITTEN CONTRACT WITH CLARKSON CONSTRUCTION COMPANY FOR
RIGHT-OF-14AY FOR CONSTRUCTION OF THE EXTENSION OF STADIUM
BOULEVARD WEST,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS :
SECTION 1. The Mayor and Clerk of the City are hereby
authorized and directed, for and in the name of the City, to
execute a written contract with Clarkson Construction Company
for right-of-way for construction of the Extension of Stadium
Boulevard West.
SECTION 2. Said contract shall read in words and figures
as follows :

SECTION 3. This ordinance shall take effect and be in
force from and after its passage and approval .

Party of the First Pert , and who acts for and , on behalf of the City
of Jefferson , and CLARKSON CONSTRUCTION COMPANY,

Party of the Second Part , WI'MESSI?TH :
That for and in consideration of mutual promises and covenants
herein contained , tlhe Party of the Second Part does agree to prepare
and execute a Warranty Deed for certain portions of the Southeast
Quarter of the Northwest Quarter of Section 11 , Township 44N, Range
1 2W, a description of which is attached hereto , to be used as street
right-of-way for the construction of the extension of Stadium Boule-
vard. The cost of which shall be jointly shared by both parties as
set forth by this agreement .
In connection with and as a part of the consideration the Party
of the First Part does agree as follows :
1) To complete the building of the proposed roadway from �
Missouri Boulevard to frog liol 1 ow 11011d by December,
1979 , with said road to be built to existing standards
of the City of Jefferson .
2) To final grade , fertilize , seed , and mulch all dis-
turbed areas , which are not paved and insure the
protection within reason of a.11 trees in the right-
of-way.
3) To allow for four (4) 60 foot right-of-way access
points , their location to he mutually agreed upon
by both parties and to all.ow a maximum of one pri-
vate drive access point per 200 linear foot of front

4) To provide sanitary sewer crossings to he located to
naturally serve the property as agreed t=o by• both
parties . G

Part agrees to participate up to fifty (50%) percent of the total
cost of construction of the roadhvay�and necessary ap urtenances

It shall be imclerstood that berore tlhe City execute a contract ,
for the building of said roadway a check in the amount of the
Party of the Second Part ' s participation shall be deposited with ;
,the City Clerk , Jefferson City , Missouri.. It shall he further
understood that there will he no assessment for future improve-
ments made to the roadway which the City might initiate .
