Case No. 185-614882 - Larry Capista requesting rezoning from B-2
and Residence A to B-1 for property located at the Southeast corner
of Lockport and Division Streets.
Messrs. Larry Capista and Charles Sharp were present. Mr. Capista
stated it is their intention to build two buildings, one on the north
side of the property, and one on the south side with both buildings
facing Route 59. He is not sure at this time what will go in the
buildings. There is a possibility of a branch bank locating there,
which would have a drive-up facility. If the bank would seek to locate
there, the developers would seek to vacate the alley and reroute it to
another location on the property.
Mr. Capista presented a tentative site plan that showed the two
buildings, each about 3500 square feet, with driveways onto the property
from Lockport, Division and Chicago Streets. The plan showed that the
alley will be maintained as it currently exists.
He then discussed some of the concerns that were brought up in past
hearings (Hardee's, Burger King), and that are also listed in the
Village Planner's report to the Board. He said the alley would be
maintained as it exists now, with improvements on the property such as
signs and possibly a speed bump; any trees that can be saved will be
saved; and that they plan to construct the buildings in keeping with
the historical nature of the area. .
Regarding the Chicago Street improvements, Mr. Waldock's report
suggested the developers should improve the entire width of the road
surface and install curb and gutter on each side of the street for the
length of their frontage, 166.99 feet. Mr. Sharp stated that if the
street was improved by the Village they would be willing to pay their
fair share. After a long discussion regarding street improvements,
Chairman Simmons suggested that further negotiations on this matter
should be discussed with the Village Board.
Regarding the traffic to and from Lockport Street, the Plainfield
School District suggested Lockport Street access be limited to egress
only and no left turns permitted. Mr. Capista said that all ingresses
and egresses are needed.

Several residents expressed their concerns regarding the alley and
Mr. and Mrs. John Zary expressed concern about the distance between
the parking area and their home. They said there is only 20 inches
between their stairs and the property line and they don't want a fence
on the property line.
M. Krippel moved to recommend to the Village Board that they approve
the rezoning request of Larry Capista from B-2 and Residence A to
B-1 for the property at the Southeast corner of Lockport and
Division Streets.with the stipulation that the staff is entitled to
a review of the architectural design of the buildings.
Seconded by W. Schempf. Vote by roll call.
Anderson, yes; Mentzer, yes; Bayer, yes; Krippel, yes; Sobkoviak, yes;
Simmons, no. 6 yes, 1 no. Motion carried.
Chairman Simmons stated he voted "no" due to the precendent set at
past hearings of tabling cases without proper notice to adjacent
property owners. But he said he supports the rezoning.
Mayor Latta briefly clarified the Village's policy on notifying
adjoining landowners.
