AN ORDINANCIs APPROVING A PROJECT FOR THE INDUSTRIAL
DEVELOPMENT OF THE CITY OF JEFFERSON, COLE COUNTY,
MISSOURI, THE' PLAN FOR WHICH PROJECT WAS APPROVED BY
THE CITY COUNCIL Ole SAID CITY ON THE 2ND DAY OF APRIL,
1979; CALLING AND PROVIDING FOR THE HOLDING OF A
SPECIAL ELEC'T'ION WITHIN AND FOR SAID CITY OF JEFFERSON
FOR THE PURPOSE OI'' SUBMITTING TO THE QUALIFIED ELECTORS
OF SAID CITY A PROPOSITION TO ISSUE REVENUE BONDS OF
SAID CITY IN THE PRINCIPAL AMOUNT OF ONE MILLION, FIVE
HUNDRED THOUSAND DOLLARS ($1,500,000) FOR THE PURPOSE
OF PROVIDING FUNDS FOR THE INDUSTRIAL DEVELOPMENT OF
SAID CITY; AND DIRECTING THE GIVING OF NOTICE OF SAID
ELECTION.
WHEREAS, the City of Jefferson is a duly incorporated and existing City
of the Third Class situated in the County of Cole, State of Missouri; and
WHEREAS, the said City of Jefferson, by a vote of four-sevenths (4/7)
of the qualified electors voting thereon, is authorized by the provisions of
Section 27 of Article VI of the Constitution of the State of Missouri and Section
100.010 et seq. , Vernon's Annotated Missouri Statutes, to issue its revenue bonds
to provide funds for a project for industrial development; and
WHEREAS, the amount of indebtedness proposed to be incurred will not
exceed any constitutional or statutory limit; and
WHEREAS, at a meeting of the City Council of the City of Jefferson held
on the 2nd day of April, 1979, the said Council did find that it would be to the
best interests of and advantageous to said City to adopt and promote a project for
industrial development under the aforesaid constitutional and statutory provisions;
and
• WHEREAS, by a majority vote of the City Council, the City of Jefferson
did adopt on said 2nd day of April, 1979, nkxWxx)6m. 9263 of said City
containing a plan for a project for the industrial development of said City, which
plan was thereafter duly submitted by said City to the Division of Commerce and
Industrial Development of the Department of Consumer Affairs, Regulation, and
Licensing of the State of Missouri; and
WHEREAS, the plan so submitted did include all of the information required
by the aforesaid constitutional and statutory provisions; and

WHEREAS', on Lhe 17tb— (Illy of Anri1 1979, the aforesaid
Division of Commerce and Industrial Development did approve the aforesaid plan and
project as submitted and on the 1 7th dray of At)ril 1979, did notify
the said City of such approval; and
WHEREAS, the City Council of said City of Jefferson is now authorized
by the aforesaid constitutional and statutory provisions, upon approval of the
aforesaid project by ordinance, to proceed to carry out the project according to
the plan so approved; and
WHEREAS, the City Council of said City of Jefferson does now find and
® determine that, in carrying out the project according to the plan so approved, it
would be advisable to direct the submission of the proposition hereinafter set
forth at a special election to be held for that purpose:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON,
COLE COUNTY, MISSOURI, AS FOLLOWS:
SECTION 1. That the project for the industrial development of the City
of Jefferson, Missouri, as set forth in a resolution adopted by the City Council
of the said City on the 2nd day of April, 1979, and approved by the Division of
Commerce and Industrial Development of the Department of Consumer Affairs, Regula-
tion, and Licensing of the State of Missouri on the day of ,
1979, shall be and the said project is hereby approved.
® SECTION 2. That a special election shall be and the same is hereby
called and ordered to be held in the City of Jefferson, Missouri, on Tuesday, the
5th day of June, 1979, for the purpose of submitting to the qualified electors of
said City the following proposition, to-wit;
PROPOSITION
To issue revenue bonds of the City of Jefferson,
Cole County, Missouri, in the amount of One
Million, Five Hundred Thousand Dollars
($1,500,000) to be payable solely from the
revenue: derived from a project for industrial
development, and not to be a general obligation
of said City of Jefferson, for the purpose of
providing, funds for such industrial development

project under the provisions of Section 27 of
Article V1 of the Constitution of the State of
Missouri and Section 100.010 et seq. , Vernon's
Annotated Missouri Statutes.
SECTION 3. That the qualified electors of the City residing in the
several election precincts located within said City shall vote at the polling places
enumerated in the "NOTICE, OF SPECIAL BOND ELECTION" as hereinafter set forth in
Sections 7 and 10 of this Ordinance; that the polls of said election shall be
opened at the hour of :;ix o'clock in -the morni.nr, Central Daylight Saving Time,
on said date and shall be kept open until the hour of seven o'clock in the after-
noon, Central Daylight Saving Time, on said date; that no person shall be permitted
to vote in said election unless he or she is duly registered and unless his or her
name thereby appears in the County record and the precinct record for the County
® and precinct in which he or she resides; and that no person shall be eligible to
vote unless he or she shall have registered before 5:00 P.M. , Central Daylight
Saving Time, on Wednesday, the 9th day of May, 1979.
SECTION 4. That the County Clerks of Cole and Callaway Counties, Mis-
souri, shall conduct, within their respective jurisdictions, the election herein
provided for, and each shall serve as the election authority for said election
within his jurisdiction, and the said County Clerks shall perform the duties re-
quired of them as election authorities for said election under the provisions of
Chapter 115, Vernon's Annotated Missouri Statutes.
SECTION 5. That the County Clerks of Cole and Callaway Counties, Mis-
souri, as election authorities for the election herein provided for, shall give
• the notice of said election required of them by law, shall appoint the election
judges for each polling place within their respective jurisdictions at which said
election is to be held, and shall supply all ballot boxes, ballots, tally sheets,
precinct registers, and other supplies necessary for the conduct of said election.
SECTION 6. That the ballots to be used at said special election shall
be in substantially the following form, to-wit:

SECTION 7. That the City Clerk be and is hereby authorized and directed
to prepare and cause to be published in The Daily Capitol News and in the Jefferson
City Post-Tribune, being newspapers published and of general circulation in said
City, a notice of said special election in substantially the following form, to-wit;

in the City of Jefferson, Cole County, Missouri, on

Cole County, Missouri, in the runount of One
Million, Five Hundred Thousand Dollars

The Polls of stitd election at the plaeva above indicated will
be opened at the hour of six o'clock in the morning, Central
Daylight Saving Time , and will remain open until the hour of
seven o'clock in the evening, Central Daylight Saving; Time, on
the aforesaid elate. Except for absentee ballots cast by persons
in Federal service, no perr:on shn.11 be allowed to vote whose
name does not appear in the precinct register without the ex-
press sanction of the election authority, and, in order to vote
in said election, a person must be registered no later than
5:00 P.M. , Central Daylight Saving Time, on Wednesday, the 9th
day of May, 1979•

The said notice shall be published in said newspapers once a week for
at least three (3) consecutive weeks and on the same day in each week. The first
publication shall be made at least twenty-one (21) days before the date of said
special election, and the last publication shall be made within two (2) weeks of
the date of said election.
SECTION S. That, in order to comply with the provisions of Section
115.125, Vernon's Annotated Missouri Statutes, the City Clerk be and the said Clerk
is hereby directed to transmit to the County Clerks of Cole and Callaway Counties,
Missouri, who shall serve as the election authorities for the election herein pro-
vided for, a notice in substantially the following form, to-wit:

This is to notify you that the Council of the City of
Jefferson, Cole County, Missouri, on the 17th day of April,
1979, did call a special bond election to be held on Tuesday,
the 5th day of June, 1979. So that you may be Informed as to
the question to be submitted to the qualified electors in said
election, I am enclosing herewith the following:

1. A certified copy of Ordinance No. of
said City, passed and approved on April 17, 1979, which said
Ordinance calls and provides for the holding of said special
bond election;
2. A suggested form for the notice which you are re-
quired to give pursuant to the provisions of paragraph 2 of
Section 115.127, Vernon's Annotated Missouri Statutes; and
3. A suggested form for the notice which you are re-
quired to give pursuant to the provisions of Section 115.131,
Vernon's Annotated Missouri Statutes (if you do not elect to
give the notice contemplated by Section 115.129, Vernon's
Annotated. Missouri Statutes) .
Your attention is called to the fact that Section 6 of the ordi-
nance calling and providing for the holding of the said election
specifies the form of the ballot to be used at said election.
The notice referred to in paragraph 2, above, should
be published in The Daily Capitol News, the Jefferson City
Post-Tribune, the Kingdom Daily News, and the Fulton Daily
Sun-Gazette on the 21st and 31st days of May, 1979, and the
notice referred to in paragraph 3, above, should be published
in The Daily Capitol News and in the Kingdom Daily News on the
4th day of June, 1979.
